ORDINANCE NO. 38-1997
A GENERAL ORDINANCE AMENDING SECTIONS 96.12(g) AND 96.12(i) OF
THE CITY OF RICHMOND CODE
WHEREAS, Chapter 96 of the City of Richmond Code regulates streets and sidewalks
within the City and includes procedures for utilities to perform cuts or
excavation work on said streets and sidewalks; and
WHEREAS, it is desirable to require any utility performing cuts or excavation in any
street, sidewalk, or alley to repair the same in compliance with standards
set forth by the City Engineer; and
WHEREAS, it is also desirable to prohibit utilities from excavating in an improved
street, sidewalk, or alley within one year after the improvement except in
the case of emergency.
NOW, THEREFORE, be it ordained by the Common Council of the City of
Richmond, Indiana that the following Sections of Chapter 96 of the City of Richmond
Code are hereby amended as follows:
1. A new 96.10(h) shall be added to read:
96.10(h) Excavation and Backfill
The applicant shall excavate and backfill any cut in a street, sidewalk, or
alley in conformance with City standards on file in the office of the City Engineer.
All utility work shall also meet the requirements of the respective regulatory
commissions.
2. A new 96.10(i) shall be added to read:
96.10(i) Excavation in Improved Streets, Sidewalks, or Alleys
No applicant shall excavate in an improved street, sidewalk, or alley
within one year after the improvement, except for emergencies as approved by the
City Engineer.
3. 96.10(h), as currently in force, shall be re -codified as 96.100).
4. 96.12(g) is hereby deleted.
5. Sections 96.12(h) and (i), as currently in force, shall be re -codified as 96.12(g)
and 96.12(h) respectively.

the City of Richmond, Indiana.
