A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHLAND
HILLS,TEXAS, ORDERING A GENERAL ELECTION FOR THE OFFICES
OF CITY COUNCIL PLACES 1, 3 AND 5; SUCH REGULAR ELECTION
TO BE HELD ON SATURDAY, MAY 1, 2021; ESTABLISHING
PROCEDURES FOR THE ELECTION; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, May 1, 2021, is designated as a uniform election day; and
WHEREAS, by this resolution, it is the intention of the City Council to call the 2021
General Election as required by the City Charter and by other law, designate a polling
place for the election, and establish and set forth procedures for conducting the election;
and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS, THAT:
Section 1. Election Order for General Election
The City Council hereby orders that a general election shall be held in the City of
Richland Hills on Saturday, May 1, 2021, at which the following officials will be elected:
City Council, Placel
City Council, Place 3
City Council, Place 5
Section 2. Joint Election Administration Contract
The City Secretary is hereby authorized to execute the contract (the "Contract")
with Tarrant County joint joint election services. In the event of a conflict between this
Resolution and the Contract, the Contract shall control.
Section 3. Election Day Polling Place
On May1, 2021, Election Da

*Vote Centers — City voters may vote at any of the additional Election Day Vote Centers
open under full contract services with the Tarrant County Elections Administration.
Section 4. Filing Dates
In accordance with Section 143.007 of the Texas Election Code, eligible persons
wishing to become candidates must file an application with the City Secretary of the City
of Richland Hills, Texas 76118, and may do so beginning Wednesday, January 13, 2021
and continue through Friday, February 12, 2021, until 5:00 p.m. Each application shall
be on a form meeting the requirements of Section 141.031 of the Texas Election Code.
Section 5. Ballots and Election Method
Combined ballots may be utilized containing all of the offices and propositions to
be voted on at each polling place, provided that no voter shall be given a ballot or
permitted to vote for any office or proposition on which the voter is ineligible to vote. Early
voting by personal appearance and Election Day shall be conducted on Tarrant County's
Hart Intercivic Verity Voting System v. 2.3.1. All expenditures necessary for the conduct
of the election, the purchase of materials therefore, and the employment of all election
officials are hereby authorized and shall be conducted in accordance with the Contract
and the Code. The order in which the names of the candidates are to be printed on the
ballot shall be determined by a drawing by the City Secretary pursuant to state law. Notice
of the time and place for such drawing shall be given in accordance with the Code.
Section 6. Early Voting
Early voting by personal appearance. The Tarrant County Elections Administrator is
hereby appointed as the Early Voting Clerk for the election, as so indicated in the
Contract. Early voting by personal appearance shall be held at Tarrant County Vote
Centers. The main early voting location shall be located at the Tarrant County Elections
Center, 2700 Premier Street, Fort Worth, Texas 76111. On at least two weekdays during
the early voting period, the location for early voting shall be open for at least twelve (12)
hours as mandated by state law. Early voting by personal appearance begins on Monday,
April 19, 2021 and ends on Tuesday, April 27, 2021 during the hours listed below:
April 19 — 23 Monday— Friday 8:00 a.m. — 5:00 p.m.
April 24 Saturday 7:00 a.m. — 7:00 p.m.
April 25 Sunday 11:00 a.m. —4:00 p.m.
April 26 — 27 Monday— Tuesday 7:00 a.m. — 7:00 p.m.
b. Early voting by mail. Applications for a ballot by mail may be submitted
throughout the calendar year, beginning January 1 and must be received by Tarrant
County Elections no later than the close of business April 20, 2021. All voted ballots that
are returned on or before Election Day will be counted. Voted ballots mailed from outside
the United States may be counted if clearly postmarked on or before Election Day and
received by the Elections Administrator not later than the fifth day after Election Day.

(Effective September 1, 2015, you may submit by email a completed, signed with the
voter's original signature and scanned application to the Early Voting Clerk.):

c. Early voting ballot board. Early voting, both by personal appearance and by mail
shall be canvassed by an Early Voting Ballot Board which is hereby created. According
to the Contract, Tarrant County shall appoint the Early Voting Ballot Board to process
early voting results from the election.
Section 7. Notice
Notice of said election shall be given as required by the Texas Election Code.
Section 8. Election Officials
The election judge, alternate election judge, and ballot board will be appointed by
the Tarrant County Elections Administrator, as permitted by law. The presiding judge
shall appoint elections clerks as may be necessary for the proper conduct of the election.
The election judge, or the alternate election judge in the absence of the election judge,
and the election clerks shall constitute the early voting ballot board. The election judge,
and alternate election judge, and election clerks shall be qualified voters of the city.
Section 9. Governing Law
The election shall be held in accordance with the Constitution of the State of Texas
and the Texas Election Code, and all resident qualified voters of the City shall be eligible
to vote at the election.
Section 10. Necessary Actions
The Mayor and the City Secretary, in consultation with the City Attorney, are
authorized and directed to take all actions necessary to comply with the provisions of the
Texas Election Code, the City Charter, and the City Code in carrying out and conducting
the election, whether nor not expressly authorized by this Order.
Section 11. Severability Clause
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this order are severable and if any
phrase, clause, sentence, paragraph, or section shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this order, since the same would have been
enacted by the City Council without the incorporation in this order of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
Section 12. Notice and Publication
This Resolution shall serve as the Order of Election (as required by Section 3.001
of the Code) and as the Notice of Election (as required by Section 4.001 of the Code) for
the General Election. A copy of the resolution shall be posted on the bulletin board used
for posting notices of the meetings of the City Council at least twenty-one (21) days before
the election. Notice shall be published in the newspaper in accordance with state law.
Section 13. Effective Date
This order shall be effective upon its adoption.

RESOLUCION DEL CONCEJO MUNICIPAL DE LA CIUDAD DE RICHLAND
HILLS, TEXAS, QUE ORDENA UNA ELECCION GENERAL PARA LOS CARGOS
DE LOS LUGARES 1, 3 Y 5 DEL CONCEJO MUNICIPAL. ADEMAS, ESTABLECE
QUE DICHA ELECCION REGULAR SE LLEVARA A CABO EL SABADO 1 DE
MAYO DE 2021, DETERMINA LOS PROCEDIMIENTOS PARA LA ELECCION Y
PROPORCIONA UNA FECHA DE ENTRADA EN VIGENCIA.
POR CUANTO, se establece el 1 de mayo de 2021 como el Dia de Ia ElecciOn uniforme,
y
POR CUANTO, mediante esta resoluciOn, el Concejo Municipal tiene la intenciOn de
convocar a la ElecciOn General de 2021, segun to dispuesto por la Carta Organica Municipal y
por otra Iegislacion, designar un centro electoral para Ia eleccion, establecer y exponer los
procedimientos para su realizacion, y
POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE RICHLAND HILLS,
TEXAS, RESUELVE LO SIGUIENTE:
Seccion 1. Orden de Eleccion para la Eleccion General
Por la presente, el Concejo Municipal ordena la realizaciOn de una Eleccion General en Ia
Ciudad de Richland Hills el sabado 1 de mayo de 2021 para elegir a los siguientes funcionarios:

Concejo Municipal, lugar 5
Seccion 2. Contrato de Administracion de Eleccion Conjunta.
Por la presente, se autoriza a la Secretaria de la Ciudad a celebrar el contrato (el
"Contrato") con el Condado de Tarrant para los servicios de la elecciOn conjunta. En caso de
conflicto entre Ia presente ResoluciOn y el Contrato, este ultimo prevalecera.
Seccion 3. Ubicacion del Centro Electoral el Dia de la Eleccion
El 1 de mayo de 2021, el Dia de la ElecciOn, las urnas estaran abiertas de 7:00 a.m. a 7:00
p.m., y la votaciOn se Ilevara a cabo en los centros de votaciOn* del Condado de Tarrant, que
incluyen:

3200 Diana Drive
Richland Hills, Texas 76118
*Centros de votacion: los votantes de la ciudad pueden votar en cualquiera de los centros de
votaciOn adicionales para el Dia de la ElecciOn que esten abiertos bajo un contrato de servicios
integrales con Ia AdministraciOn de Elecciones del Condado de Tarrant.
Seccion 4. Fechas de Presentacion de Solicitudes
De acuerdo con la Seccion 143.007 del COdigo Electoral de Texas, las personas calificadas
que deseen postularse como candidatos deben presentar una solicitud ante la Secretaria de Ia
Ciudad de Richland Hills, Texas 76118, desde el miercoles 13 de enero de 2021 hasta el viernes
12 de febrero de 2021, a las 5:00 p.m. Cada solicitud debera cumplir con los requisitos de formato
establecidos en la Seccion 141.031 del Codigo Electoral de Texas.
Seccion 5. Boletas y Metodo de Eleccion
Se pueden utilizar boletas electorales combinadas que contengan todos los cargos y
propuestas que se votaran en cada centro electoral, siempre y cuando ningun elector reciba una
boleta electoral o se le permita votar por un cargo o propuesta para los cuales no tenga derecho
a hacerlo. La votaciOn anticipada en persona y la votaciOn del Dia de la ElecciOn se Ilevara a
cabo a traves del sistema de votaciOn Verity version 2.3.1. Por la presente, se autorizan todos
los gastos necesarios para la realizaciOn de la elecciOn, la compra de los materiales a tal efecto
y la contrataciOn de todos los funcionarios electorales; dichos gastos se realizaran conforme al
Contrato y al COdigo. El orden en que se imprimiran los nombres de los candidatos en la boleta
electoral se determinara a traves de un sorteo que realizara la Secretaria de Ia Ciudad conforme
a la legislaciOn del estado. La hora y la fecha del sorteo se notificaran de acuerdo con lo dispuesto
en el Codigo.
Seccion 6. Votacion Anticipada
Votacion Anticipada en Persona. Por la presente, se designa Secretario de Votacion Anticipada
para las elecciones al Administrador de las Elecciones en el Condado de Tarrant, como se indica
en el Contrato. La votaciOn anticipada en persona se Ilevara a cabo en los centros de votaciOn
del Condado de Tarrant. El lugar principal donde se Ilevara a cabo la votaciOn anticipada es el
Centro de Votacion del Condado de Tarrant ubicado en 2700 Premier Street, Fort Worth, Texas
76111. Mientras dure el periodo de votaciOn anticipada, el centro electoral de votaciOn anticipada
estara abierto, como minimo, doce (12) horas durante al menos dos dias de la semana, segun lo
dispuesto por la legislaciOn del estado. La votacion anticipada en persona comienza el lunes 19
de abril de 2021 y finaliza el martes 27 de abril de 2021 en el horario que se indica a continuacion:
19-23 de abril Lunes a viemes 8:00 a.m. a 5:00 p.m.
24 de abril Sabado 7:00 a.m. a 7:00 p.m.
25 de abril Domingo 11:00 a.m. a 4:00 p.m.
26 y 27 de abril Lunes y martes 7:00 a.m. a 7:00 p.m.
b. Votacion Anticipada or Correo. Sepuedenpresentar solicitudes para votaciOn mediante

boleta electoral por correo a lo largo del ano calendario a partir del 1 de enero. El personal de las
Elecciones del Condado de Tarrant debe recibir estas solicitudes antes del cierre de las
actividades laborales el 20 de abril de 2021. Se computaran todos los votos que se envien antes
del Dia de la ElecciOn, o ese mismo dia. Los votos que se envien por correo desde un lugar fuera
de los Estados Unidos se computaran si muestran claramente un sello postal con la fecha del Dia
de la ElecciOn, o una fecha anterior, y siempre que el Administrador Electoral los reciba, como
maximo, el quinto dia posterior al Dia de la ElecciOn. Las solicitudes completadas se pueden
enviar por correo, mensajeria contratada o comun, o fax (a partir del 1 de septiembre de 2015, se
puede enviar una solicitud completada con la firma original del elector que debera escanearse y
enviarse al Secretario de ElecciOn Anticipada por correo electrOnico) a las siguientes direcciones:

c. Junta para la Votacion Anticipada. Por medio de la presente, se crea una Junta para Ia
VotaciOn Anticipada, que se ocupara de escudrinar la votaciOn anticipada que se realice tanto en
persona como por correo. Conforme al Contrato, el Condado de Tarrant nombrara a la Junta
para Ia VotaciOn Anticipada a fin de que procese los resultados de Ia votaciOn anticipada de la
elecciOn.
Seccion 7. Aviso
El aviso de la elecciOn se realizara segun to dispuesto por el COdigo Electoral de Texas.
Seccion 8. Funcionarios electorales
La Administracion Electoral del Condado de Tarrant designara al juez electoral, al juez
electoral suplente y a la junta para Ia votaciOn, segun to permitido por la ley. El juez responsable
nombrara a los secretarios electorales, segun sea necesario, para el correcto desarrollo de Ia
eleccion. El juez electoral o, en su ausencia, el juez electoral suplente y los secretarios electorales
constituiran la Junta para Ia VotaciOn Anticipada. El juez electoral, el juez electoral suplente y los
secretarios electorales seran electores calificados de la ciudad.
Seccion 9. Legislacion aplicable
La elecciOn se realizara de conformidad con Ia Constitucion del Estado de Texas y el
COdigo Electoral de Texas, y todos los residentes de la ciudad que sean electores calificados
seran elegibles para votar en la eleccion.
Seccion 10. Medidas Necesarias
Se autoriza y ordena al Alcalde y a la Secretaria de Ia Ciudad, en consulta con la
Procuradora de la Ciudad, a tomar todas las medidas necesarias para cumplir con las
disposiciones del Codigo Electoral de Texas, la Carta Organica Municipal y el Codigo Municipal
para Ilevar a cabo la ElecciOn, independientemente de que esten o no expresamente autorizados
por esta Orden.
Seccion 11. Clausula de Divisibilidad
Por la presente, se declara que el Concejo Municipal tiene la intencion de que las
secciones, los parrafos, las oraciones, las clausulas y las frases de esta Orden sean divisibles, y
que si alguna sentencia o decreto validos de un tribunal con jurisdiccion competente declarara la
nulidad o inconstitucionalidad de alguna frase, clausula, oraciOn, parrafo o secciOn, dicha nulidad
o inconstitucionalidad no afectara a ninguna de las frases, clausulas, oraciones, parrafos y
secciones restantes de esta Orden, dado que estos hubieran sido promulgados por el Concejo
Municipal sin Ia incorporaciOn en esta Orden de ninguna de dichas frases, clausulas, oraciones,
parrafos o secciones nulos o inconstitucionales.
Seccion 12. Aviso y Publicacion
Esta ResoluciOn constituira Ia Orden de ElecciOn (segun lo dispuesto por Ia Seccion 3.001
del Codigo) y el Aviso de Eleccion (segun lo dispuesto por la Seccion 4.001 del Codigo) para la
ElecciOn General. Al menos veintiun dias (21) antes de la eleccion, se publicara una copia de la
Resolucion en la pizarra de anuncios que se utiliza para la publicaciOn de los avisos de las
reuniones del Concejo Municipal. El aviso se publicara en el periOdico, de acuerdo con lo
dispuesto por la legislaciOn del estado.
Seccion 13. Fecha de Entrada en Vigencia
Esta orden entrara en vigencia a partir del momento de su adopcion.
