HomeMy Public PortalAbout19690423CCMeeting11 Savannah Beach, Ga. April 23, 1969. The regular monthly meeting of Council was called to order at 3 :00 P.M. by Mayor Counihan. The Councilmen in attendance were Jack Daniels, Edward Jung, Robert Cary, George Schwarz, Milledge Jones and Dr. C. L. Hohenstein; also Town Attorney Bart t. Shea and Chief of Police J. W. Price. The following visitors and petitioners were in attendance: Mr. John Mock, Mr. Will Rogers, Mr.•Rchard Grosse, Mr. and Mrs. Thomas H. Gign iliiat, Charles Embrey and W. T. Mobley. Mr. rosse asked Council to do what it could to restrict the erection of signs and; billboards that would mar the beauty of our community. He suggested that a special committee or review board to screen applications for signs might also helpt He also spoke of the bad situation of having so much unimproved property in-the heart of the city. Mayor Counihan expressed his agreement with Mr. Grosse; and Councilman Jung felt that the suggestions of Mr. Grosse were commendable and stated that Council was working with the M.P.C. at the present time and that this should take care of a lot of his points. Mr. John Mock petitioned Council to replace his burned out home with a Jim Walters type building. It was decided to hold up on Mr. Mock's building; also a similar type building proposed by Mr. Harris Slotin until after the Metropolitan Planning Meeting on Wednesday, April 30th. Mr. Charles Embrey stated that he had a.possible solution as to how we'Might get the fishing pier repaired and usable. He suggested that certain repairs, which were pointed out from a drawing by the Mayor, would be made by him at a cost of approximately $100.00 labor and in return the Town would give him free rent next year. Council took this under advisement. Mr. and Mrs. Thomas H. Gignilliat appeared before Council to protest the sale of a portion of Inlet Avenue. He questioned the ;legality of the sale. Town Attorney Bart Shea ruled that if the majority of the voters vote in favor of the sale in our coming Referendum, then the Town would have the legal right to sell the property. Mr. W. T. Mobley, operator of,Nortrica's Fishing Camp petitioned Council for a beer license. He was advised by the Mayor that Council wanted his'sign'on 6th Street-taken down. Mr. Mobley agreed to do this as soon as he could get some help -and was told that he would be advised later in regard- to his application for -a beer license. Councilman Jack Daniels moved that the corrected Minutes for the 'Council Meetings of December, January and February be approved. The motion was seconded and unanimously carried. 12 The following corrections were made in the March Minutes: Third Paragraph; Pae'Two, "asked what are business people getting from Town" deleted; and Second Paragraph, Page Three, "be postponed indefinitely" was changed to read "tabled for time being ". They were then approved as corrected. Bills for the various departments were`'approved for'.paym'eit. With reference to bill in the amount of $110.00 for billboards to Hogan Outdoor Advertising, Councilman Hohenstein suggested that this should be a function of the Chamber of Commerce. After a discussion, Council agreed and recommended that this be taken up with Mr. Bill Streeter, President of the Savannah Beach Char'nber of Commerce. Councilman Cary requested a second reading on the Water Ordinance which is an amendment to an Ordinance enacted by the Mayor and Councilmen on September 16, 1964. The first reading was on March 19th. Following a reading of the Ordinance by Town Attorney Shea, Councilman Cary moved its adoption. It was seconded and unanimously carried. ORDINANCE Councilman Cary also suggested that we see if it is feasible to get water and sewage to some lots without it at the present time that are being advertised for sale. Town Attorney Bart Shea recommended that, no action be taken on this until we get a zoning ordinance. Councilman, Cary. announced the transfer of $10,000.00 from the Water Fund to the General Fund, $,000.00. in March and $5,000.00 in April. Councilman Milledge Jones announced that`re- surfacing of some of the streets and intersections had begun and will include Lovell Avenue from First to Tilton, Lovell Avenue from Fifth to Eighth, Tenth Street from Jones to Butler Avenue and Lovell Avenue from Ninth to Tenth Street; also the following intersections; Second Avenue and,llth Street, Second Avenue and 14th Street, Jones Avenue and 16th Street. Councilman Jones also announced that our public rest rooms.are being painted and cleaned up for the coming season, the fishing pier is under study. Councilman Jones moved that the eastward flow of traffic on Sixteenth Street be reversed. Following a discussion which brought out the fact that the time before the heavy traffic begins was short to attempt the change at this time, Councilman Jones withdrew his motion. Councilman Cary requested that the work be done on the water line to be run under Campbell Avenue before the resurfacing of the street. 13 Councilman Daniels moved that Council carryout the recommendations of the State Traffic Safety Engineer at Ellzey's Corner regarding curbside parking which recommended that parking be prohibited the width and 'length of the building and-across the street a distance of 25 feet in front of the store and that the curb in these areas be yellowed. The motion was seconded and unanimously carried. Councilman Daniels announced that he had received a request from a group who wished to operate a Teen Age and Young Adult Center in the partitioned off Surf Room in the Brass Rail Building. He moved that they be granted a license. The motion was seconded and unanimously carried. Councilman Daniels also announced that Francis Marion Sandstrom and James Harry McGuire had been hired as police off cers to fill vacancies created by recent resignations in the Police Department. He also stated that beach life guards wil go, on duty week -ends beginning May 3rd and full time. by Jun 3rd; also, that as of May 3rd the anti-litter beach patrol would begin functioning., , The beach' patrol _will also be responsible for picking up stray dogs. Councilman Cary brought to the attention of Council the fact that an article in the newspaper had announced the proposed closing of Tybee School, the only 'schoolin the system scheduled to be closed. The Council requested Councilman Hohenstein to look into this to see if there is anything that can be done about it. Councilman Jung moved that the salary of the Town Attorney be increased from $250.00 per month .to.$300.00 per month. The motion was seconded and unanimously carried. Councilman Jung moved that the sale of soft drinks on the beach be forbidden. It was seconded and unanimously carried. A second reading was made on the Ordinance amending an Ordinance enacted by Council on August 4, .1967, providing rules and regulations for the retail sale of alcoholic beverages, or distilled spirits,'by the drink, for consumption, on the premises. Councilman Milledge Jones moved the adoption of this Ordinance. It was seconded and unanimously passed on second reading. ORDINANCE Jung requested a second reading on the Ordinance providing for the rate of license taxes for the fiscal year beginning May 1, 1969 and ending April 30, 1970. He then moved adoption of this Ordinance. It was seconded and unanimously passed. ORDINANCE 14 Councilman Jung requested that the Ordinance providing for the taxation of real and personal property for the fiscal" year beginning- May 1, 1969 and -ending April. 30, -1970 ,be - placed on second reading -and adopted. The motion was seconded and unanimously passed. ORDINANCE Councilman Jung requested a secbnd reading on the Ordinance - to assess' and levy a license tax upon retail dealers engaged in the business of selling malt beverages, wine or spirituous liquors for the fiscal year beginning May l-, 1969 and ending April 30, 1970. Councilman Jung then moved the adoption of this Ordinance. The motion was seconded and unanimously approved. ORDINANCE Mayor Counihan announced that the estimated cost of repairs and alteration's to, the Community House amounted to $3,535.00. Councilman Jones moved that these repairs be made. The motion was seconded and unanimously carried. Councilman Daniels moved fishing camp operated by and unanimously carried. Mayor Counihan announced will be made at the next that we grant a-beer license to the Mr. W. T. Mobley. 3t was seconded' that the General Committee Appointments meeting of Council. Mayor Counihan announced the Bridget for the Fiscal Year May 1, 1969 to May 1, 1970. A motion to adopt this budget was seconded and unanimously carried. BUDGET The Clerk of Council read a letter from Councilman Milledge Jones to Mr. Messinger in Loma Linda, California regarding the run -down condition of his property here at Savannah Beach and requesting that he have something done about this within 30 days; also Mr. Messinger's reply asking for more information on this matter. This matter is°beiig turned over to Mr. Schwarz, Chairman Health and Sanitation. The Clerk of Council was instructed to write a letter to Mr. Edward Pasco regarding the lack of progress in the renovation of the building at Jones and First Street also to have him build a fence around the swimming pool on Sixteenth Street. Councilman Cary stated that the tenant in the Bates house on Lewis Avenue has turned the water back on three times after it was cut off. It was the opinion of E5uncil that the Ordinance be inforced and Chief Price was asked to get the money by Thursday April 24th or cut the water off and subpoena the tenant. 1 A motion was made and seconded that the resignation of Mr. Henry Buckley from the position of Town Clerk be accepted as of May 1st, 1969. It was passed unanimously. Council also requested that the $100.00 monthly payment to Mr. Buckley be called a consultant fee. Mayor Counihan announced that at some time in the near future we will set up a Henry Buckley Day,' with a gift and suitable honors. There being no further business, the meeting was adjourned subject to the call of the Mayor. 1 Clerk of Council ° (1212,-c-c Mayor 15 ti P.' • • • •I • •• • .■■ • _ Z r- ; 1 1 1 ORDINANCE AN ORDINANCE TO AMEND AN ORDINANCE ENACTED BY THE MAYOR AND COUNCILMEN OF SAVANNAH BEACH, TYBEE ISLAND, ON SEPTEMBER 16, 1964, DECEMBER 18, 1968, AND FURTHER AMENDED ON FEBRUARY 15, 1969, IN ACCORDANCE WITH THE PROVISIONS OF AN ACT ADOPTED IN 1922 AND SUBSE- QUENT ACTS AMENDING THE SAME, SO AS TO PROVIDE THAT THE OWNER OF ANY PROPERTY, WHETHER LOCATED WITHIN THE CITY LIMITS OF THE MUNICIPALITY OR BEYOND THE CITY LIMITS OF THE MUNI- CIPALITY, WHICH IS FURNISHED WATER BY THE MUNICIPALITY SHALL BE INDI- VIDUALLY AND PERSONALLY RESPONSIBLE FOR ANY AND ALL COSTS OR CHARGES FOR SAID WATER SERVICE, NOTWITHSTANDING THAT SUCH PROPERTY MAY BE LEASED TO ANOTHER BY THE OWNER THEREOF. BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, and it is hereby ordained by the authority thereof: SECTION 1: An ordinance enacted on February 15, 1969, is hereby further amended by striking therefrom the present SECTION 13, and by inserting therein the following new Section, designated SECTION 13. SECTION 13: Effective May 1, 1969, any individual, person, firm or corporation owning property either within the City'Limits of the Municipality or beyond the City Limits of the Municipality, which is supplied water by the Municipality shall be personally and individually responsible for the costs and charges of such water so furnished, notwith- standing that such property may be leased by the individual, person, firm or corporation owning the property to a tenant or another individual, person, firm or corporation. SECTION 14: All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. First Reading - March 19, 1969 Second Reading and Passed - April 23, 1969 1 1 AN ORDINANCE AN ORDINANCE TO AMEND AN ORDINANCE ENACTED BY THE MAYOR AND COUNCILMEN ON AUGUST V, 1967; AND FURTHER AMENDED ON AUGUST 9, 1967, PROVIDING FOR RULES AND REGULATIONS FOR THE RETAIL SALE OF ALCOHOLIC BEVERAGES OR DIS- TILLED SPIRITS FOR BEVERAGE PURPOSES BY THE DRINK AS PROVIDED BY GEORGIA LAWS 1964, PAGE 771 (GEORGIA CODE ANNOTATED, SECTION 58- 1083); TO PROVIDE A PENALTY FOR THE VIOLATION THEREOF; AND FOR OTHER PURPOSES. BE IT ORDAINED by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, in council regularly assembled, that the following rules and regulations for the retail sale of alcoholic beverages or distilled spirits for beverage purposes by the drink, such sales to be for the consumption on the premises only, shall be governed by the following, to -wit: (a) Said businesses shall be permitted to open and operate at any time on Monday through Saturday, except between the hours of twelve (12:01) a.m. on Monday through nine (9:00) a.m. on Monday, and four (4:00) a.m. through nine (9:00) a.m. on Tuesday through Saturday of each and every Week. (b) Said businesses will close not later than four (4:00) a.m. on Tuesday, through Saturday, and not later than twelve (12:00) midnight on Saturday of each and every week. (c) Said businesses shall be permitted to open and operate on Saturday of each and every week between the hours of nine (9:00) a.m. and twelve (12:00) midnight. (d) Said businesses shall not open and operate between the hours of twelve (12:00) midnight on Saturday through nine (9:00) a.m. on Mondays of each and every week. 1 1 (e) Said businesses shall not be authorized to do business other than during the hours herein stipulated. SECTION TWO The owner and operator of each such place of business shall be responsible for complying with the provisions, rules and regulations of this Ordinance. SECTION THREE: Any individual, person, firm or corporation violating any of the provisions of this Ordinance shall be cited to appear before the Recorder's Court of said Town, and upon conviction thereof, shall be subject to be fined in the sum of not more than One Hundred ($100.00) Dollars or be imprisoned for not more than thirty (30) days, either or both, or any portion of either or both, in the discretion of the Court, and /or revocation of license. SECTION FOUR: That portion of an Ordinance, dated August 4, 1967, and amended on August 9, 1967, together with all other Ordinances or portions of Ordinances conflicting with the provisions of this Ordinance are hereby revoked. The said report to the Clerk of Council of this municipality shall be made with twenty - four hours after the completion of said trade, purchase or ac- quisition of said junk or salvage. SECTION III: In the event any business or Calling not specifically mentioned in the above list set forth shall be established in the Town of Savannah Beach, Tybee Island, Georgia, the Mayor and Councilmen reserve the right to es- tablish a license fee for same by ordinance, which fee is to be of equal dignity as the license specifically mentioned in the above section provided, however, that such license shall not be more than the sum of $750.00. SECTION IV: This ordinance shall be subject to alteration or repeal in whole or in part at any time during the fiscal year beginning May 1, 1969, should it be deemed advisable, and no such amendment or repeal shall be construed to impair the right of Council to assess or levy tax for the whole of such year whenever made. SECTION V: Any person, firm or corporation owning or operating any riding devices, or passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a policy of insurance against personal injury and property damage, with a receipt showing that the premium theron has been paid for the length of time covered by the license, in such company and in such amount as may be approved by the Mayor and Councilmen for the benefit of any person or persons who may be killed or injured or sustain damage to pro- perty by reason of operation thereof. SECTION V -a: In Lieu of such policy of insurance, any person, firm or corporation owning or operating passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a Surety Bond in the amount of $5,000.00 for each vehicle operated by said person, firm or corporation, signed by surety company acceptable to the Mayor and Councilmen of Savannah Beach, said Bond guaran- teeing the payment of any loss or damage sustained by any person or persons by reason of the operation of such vehicle, the exact form of such bond to be approved by the Mayor and Councilmen of Savannah Beach. SECTION V -b: In lieu of such policy of insurance and /or such Surety Bond, any person, firm or corporation owning or operating a passenger vehicle for hire, before being issued a license therefor, shall deposit with the Clerk of Council a Real Estate Bond in the amount of $5,000.00 for each vehicle operated by said person, firm or corporation, signed by an owner of real estate who holds merchantable fee simple title to the same and acceptable to the Mayor and Councilmen of Savannah Beach, said Bond guaranteeing the payment of any loss or damage sustained by any person or persons by reason of the operation of such vehicle, the exact form of such Bond to be approved by the Mayor and Councilmen of Savannah Beach. If said Real Estate Bond is approved by the Mayor and Councilmen,- the applicant for license shall pay the fee for recording of said bond in the Clerk's office of the Superior Court of Chatham County, Georgia. 1 1 SECTION VI: The Mayor and Councilmen reserve the right to refuse to issue to anyone any licenses for any purposes for reasons sufficient to them. SECTION VII: Half year license - Removed from Ordinance. SECTION VIII: Any person, firm or corporation violating any of the provisions of Section I of this ordinance shall, upon conviction before the Mayor's Court of said Town, be subJect to be fined in the sum of not more than $100.00 or be imprisoned not more than thirty days, either or both, or any portion of either or both, in the discretion of the Court. SECTION IX: A11 ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed. 1 AN ORDINANCE TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY IN SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY 1, 1969, AND ENDING APRIL 30, 1970, AND FROM YEAR TO YEAR UNTIL REPEALED; AND FOR OTHER PURPOSES. SECTION I: BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority of the same, that the rate of taxation upon real estate and personal property within the limits of said Town of Savannah Beach, Tybee Island, for the fiscal year commencing May 1, 1969, shall be One and Twenty Hundredths (1.20%) per cent upon the assessed or returned value of same, the value of real estate improvements to be ascertained from the returns of the Committee on Assessments of said Mayor and Councilmen, and the valuation of personal property to be ascertained from the returns of the owners thereof in pursuance of the scheme and plan contaLned in Section I, II, III and IV of the Ordinance to provide for the assessment of taxable property in the Town of Savannah Beach, Tybee Island, Georgia, and the mode of valuing such pro- perty for taxation, and to carry into effect the provisions of the Act of the General Assembly of the State of Georgia approved August 19, 1922, Section 21, as amended; and it is further ordained that if any person or persons shall refuse to pay the taxes here- inabove set forth, within thirty (30) days after same shall become due, thaClerk of Council, as Ex- Officio Treasurer of the Town, shall issue execution therefor, and the further sum of $1.00 for costs, and the Chief of Police and Ex- Officio Tax Collector shall proceed with such execution in the same manner as now provided by law in such cases of execution lodged with the Sheriff of Chatham County. SECTION II: Any tax upon real property assessed and due shall be payable in semi- annual payments; the first half being due andpayable on or before May 1st of each year; the second half shall be due and payable on or before November 1st of each year. In the event that any tax is not paid when the same is payble, the outstanding amount shall be immediately executed, the fee for execution being $1.00, and in addition thereto an interest charge of one-half (h) of one (1%) per cent per month shall be assessed. The provisions of this Section shall not apply to licenses for doing business in said Town, said licenses being covered under separate ordinance. The provisions of this Section shall apply, 1 1 1 however, to those persons or companies required by the provisions of Section 92 -5902 of the Code of Georgia to make returns to the Comptroller General of Georgia. SECTION III: This ordinance sh11 continue in effect for each and every fiscal year hereafter unless and until re- pealed or changed by ordinance. SECTION IV: All ordinances or parts ofcrdinances con- flicting with the provisions of this ordinance are hereby repealed; provided, however, that so much and such parts of ordinances passed, as provide for the execution of tax assessments, or part thereof, shall continue and remain in force so as to authorize the Clerk of Council and Ex- Officio Treasurer to issue executions, and the Chief of Police and Ex- Officio Tax Collector to collect same until said taxes or assessments shall be fully paid. Mayor Clerk of Council 1 1 AN ORDINANCE AN ORDINANCE TO ASSESS AND LEVY A LICENSE TAX, UPON RETAIL DEALERS ENGAGED IN THE BUSINESS OF SELLING MALT BEVERAGES, WINE, OR SPIRITUOUS LIQUORS, FOR THE FISCAL YEAR BEGINNING MAY 1, 1969, AND ENDING APRIL 30, 1970; TO PROVIDE FOR THE COLLECTION OF SAID LICENSE TAX; TO PROVIDE FOR THE INSPECTION OF RECORDS AND BOOKS, BOTH WHOLESALE AND RETAIL DEALERS ENGAGED IN THE BUSINESS OF SELLING MALT BEVERAGES, WINE AND SPIRITUOUS LIQUORS; TO FIX PENALTIES FOR THE VIOLATION; AND FOR OTHER PURPOSES. SECTION I: BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, and it is hereby ordained by the authority of the same, that in addition to all other tax or license fees heretofore or hereafter imposed upon retail dealers engaged in Savannah Beach, Tybee Island, Georgia, in the business of selling malt beverages, wine, or spirituous liquors as defined under the laws of Georgia, there is imposed and levied upon all such retail dealers within the Town of Savannah Beach, Tybee Island, for the fiscal year beginning May 1, 1969, and ending April 30, 1970, a license tax for the privilege of doing such business in Savannah Beach, Tybee Island, to be computed and collected as hereinafter set forth. The term "Retail deters" shall include clubs and similar organizations. SECTION II: The amount of the license tax imposed by this ordinance on such dealers shall be computed on the following basis: (a) 200 per case on bottled malt beverages where con- tainers exceed 7 ounces, and 120 per case where containers con- tain 7 ounces or less. (b) $1.25 per 1/2 barrel of 15 -1/2 gallons on draught beer, proportionately in larger and smaller quantities. (c) 150 per quart or 1/5 gallon; 80 per pint or 1 /10 gallon; and 40 per 1/2 pint or smaller, on spirituous liquors. 1 1 (d) 60 per case on wine. (e) The aforesaid quantity license taxes shall be 50% of the amounts stated on all such legal alcoholic beverages manu- factured or produced in Georgia using all Georgia products in the production or manufacture of such beverages. The term "case" as applied to wine shall mean a carton or other container containing 24 bottles of pint size or small, or 12 bottles of quart size, or 1/5 size. Fractional parts of cases or barrels, kegs, or drums, or any other size or type containers, shall be computed proportion- ately. SECTION III: (a) The license tax imposed herein on malt beverages and wines shall be computable and payable monthly; (b) Each wholesale dealer or distributor selling, shipping or delivering malt beverages or wines to any retail dealers in the Town of Savannah Beach, Tybee Island, whether delivered to the retail, dealer's place of business in Savannah Beach, or elsewhere, for re -sale in Savannah Beach, shall, as a condition to the privilege of carrying on said business in Savannah Beach: 1. Keep true and correct records of all sales, shipments or deliveries of such malt beverages or wines to each retail dealer in Savannah Beach, such records to be preserved for a period of one year and to be made available on request for the inspection of any duly authorized representative of Savannah Beach, Tybee Island; 2. Collect from each such retail dealer in Savannah Beach and add on each invoice at the time of delivery of the malt beverages and wines, the amount of License Tax due under the terms of this ordinance, and hold the same in trust for Savannah Beach, Tybee Island, until such amount is remitted to the municipality as next provided; 3. On or before the 10th day of each calendar month, make a verified return to Savannah Beach, Tybee Island, for the monies collected from retail dealers for the month immediately preceding said report, accompanying said return with a remittance to Savannah Beach, Tybee Island, for all license taxes collected. 1 SECTION IV: If any whdesale dealer or distributor fails or refuses to make the returns herein provided, for, the Town of Savannah Beach, Tybee Island, shall notify said party in writing, and if the returns are not made and the license taxes remitted within five (5) days from date of said notice, the municipality may withdraw from said wholesale dealer or distri- butor the privilege of doing business in Savannah Beach be revoking his license. On such failure to make returns and pay the license taxes accrued, Savannah Beach, Tybee Island, shall proceed to assess the amount of taxes due under this ordinance from retail dealers who have purchased from such wholesale dealer or distributor, from the best: information available, and proceed to collect said license taxes as provided by ordinance for the collection of delinquent license taxes. SECTION V: Each wholesale dealer in spirituous liquors (which shall include all alcoholic beverages excepting beer and wine) shall keep 51 -A and 51 -B records available for inspection at all times by duly authorized agents and /or representatives of Savannah Beach, Tybee Island. Such records shall show the amount and quantity of each item sold by each wholesaler to each retailer and said wholesaler shall collect at the time of the delivery to said retailer the license tax under this ordinance. SECTION VI: It shall be a violation of this ordinance for any person, firm or corporation to sell at retail within the Town of Savannah Beach, Tybee Island, any malt beverages, wines, or spitituous liquors on which the license taxes herein provided, for have not been paid to the wholesale dealer or distributor for the municipality. SECTION VII: It shall be unlawful and a violation of this ordinance for any wholesale dealer or distributor, penon, firm or corporation, to deliver any malt beverages, wines, or spirituous liquors to any retail dealer in the Town of Savannah Beach, without first collecting the license taxes. SECTION VIII: It shall be unlawful for any person, firm or corporation engaged in the sale as a retail dealer of alcoholic, vinous or malt beverages, to have in his possession any of such beverages unless the tax required by Savannah Beach, Tybee Island, shall first have been paid to the wholesaler, dis- tributor or other source delivering or causing said beverages to be delivered to said retail dealer, and whenever any such bev- erages are found in possession of a retail dealer where records of the payment of said tax shall not appear upon the records of the wholesale liquor dealer to the municipality, it will be pre- sumed that said tax has not been paid and the burden shall be upon the retailer to prove said fact. SECTION IX: Any person, firm or corporation engaged in the distribution by wholesale of any of the beverages mentioned in said ordinance willfully violating the same shall be subject to revocation of their license to do business within the corporate limits of the town of Savannah Beach, and all liquor found in the possession of any retail establishment in said town of Savannah Beach which has not paid said tax or reported same under said ordinance shall be subject to confiscation by the municipal authorities of Savannah Beach, Tybee Island, in addition to the other penalties set forth in said ordinance, and sold by the Chief of Police and Ex- Officio Tax Collector, and the receipts thereof paid to the Clerk of Council and Ex- Officio Treasurer. SECTION X: Any retailers violating the provisions of this ordinance shall, in addition to the penalties hereinabove set forth, be subject to revocation of their license to do business in said town as provided in other ordinances of Savannah Beach, Tybee Island. SECTION XI: Any person, firm or corporation violating any of the provisions of this ordinance, or who shall assist any retail dealer in malt beverages, wines, or spirituous liquors in Savannah Beach, Tybee Island, to evade or avoid the payment of the license taxes herein provided for shall be guilty of a violation of this ordinance and on conviction thereof in the Mayor's Court of said town shall be fined not more than $100.00 or sentenced to imprisonment for not more than 30 days, or both punishments to be inflicted, in the discretion of the Recorder.
