HomeMy Public PortalAbout2021.010 - (01-19-21) RESOLUTION NO. 2021.010 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING AN EXTENSION TO THE AGREEMENT WITH WATERWORKS TECHNOLOGY FOR THE INTERIM MANAGEMENT OF THE WATER AND SEWER OPERATIONS FOR A NOT TO EXCEED AMOUNT OF $400,904 FOR A MAXIMUM ONE YEAR TERM; APPROVING WATERWORKS TECHNOLOGY TO WORK ON CAPITAL IMPROVEMENT PROJECTS; AUTHORIZING THE CITY MANAGER TO APPROVE ADDITIONAL SERVICES OR EMERGENCY SERVICES NOT TO EXCEED TWENTY-FIVE PERCENT (25%) OF THE CONTRACT PRICE; AND AUTHORIZING THE APPROPRIATION OF $69,387 FROM THE UNAPPROPRIATED SEWER FUNDS WHEREAS, all suppliers of domestic water to the public are subject to regulations adopted by the U.S. Environmental Protection Agency as well as under the California Safe Drinking Water Act; and WHEREAS, the City's Sewer System Management Plan calls for the City's sanitary sewer collection system facilities are properly operated, maintained and managed to reduce frequency and severity of sanitary sewer overflows (SSO) and their potential impacts on public health, safety, and on the environment; and WHEREAS, Section 64413.7 of the California Code of Regulations requires for each distribution system to designate at least one Chief Operator and one Shift Operator 22 CCR§ 64413.7; and WHEREAS, the Water and Sewer Division still has the Utility Services Manager and Utility Services Supervisor positions vacant; and WHEREAS, on January 15, 2019, the City Council approved a new contract between the City and Water Works Technology to continue to provide services for an additional year with a one year extension; and WHEREAS,the current contract with Water Works Technology expired on January 15, 2021; and WHEREAS, continued support from Waterworks Technology is needed to maintain operations continuity until such time that the Utility Services Manager position and other recommended staffing support proposed are recruited and filled. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Lynwood finds the immediate need to have a designated D5 certified Chief Operator on standby, and a D4 or D3 certified personnel for the appropriate management of the water and sewer divisions. Section 2. The City Council of the City of Lynwood approves a maximum 12-month extension (January 18, 2022) to the Agreement between the City and Waterworks Technology, Inc. in an amount not to exceed $400,904 to provide interim services to manage the water and sewer divisions, provide field and administration support for CIP projects, on-call services to address any emergencies and necessary support. Section 3. The City Council of the City of Lynwood authorizes the Mayor to execute an extension to the current Consulting Services Agreement attached hereto as Exhibit A in a form approved by the City Attorney. Section 4. The City Council of the.City of Lynwood authorizes Waterworks Technology to start immediately as soon as the resolution is adopted to be followed by an executed agreement and approved purchase order. Section 5. The City Council of the City of Lynwood authorizes the below appropriation.
