HomeMy Public PortalAboutOrd 031 Sewer Tariff (First published in th('~'UJd.f'l( on the ~day Of~, 1982) THE CITY OF BEL AIRE, KANSAS ORDINANCE No. 3/ AN ORDINANCE PROVIDING FOR A SEWER SERVICE CHARGE: ESTABLISHING THAT CHARGE; PROVIDING FOR BILLING OF SUCH CHARGE; PROVIDING FOR DELINQUENT PAYMENT, COLLECTION, DISCONTINUANCE OF SERVICE; ESTABLISHING A SEWER UTILITY FUND. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE: Section 1. Levy of Use Charge. There are levied on all persons, firms, corperations, organizations, pelitical units and political subdivisions and all other entities with premises in the corporate limits of the City as presently defined or hereafter altered or amended, and now or hereafter connected to the sewerage system of-the City, in addition to all other levies, assessments or charges herein before or hereafter provided, a charge fer the use ef the sewerage system of the City as hereinafter provided. Section 2. Basic Charges. There is levied on each sewerage system user having any sewer cennection with the sewerage system of the City, or otherwise discharging sewage, industrial waste, or other liquids, either direct or indirectly into the City sewerage system which ultimately enters the sewerage system the sum of seventy-five cents (.75~) per month. Section 3. Bills-Rendering The Department of Water of the City shall render bills for sewer service charges to all customers and owners of recerd of property connected to the City's sewerage system but not having metered water consumption. Bills so rendered shall include a charge for each month the premises were connected to' the sewer without regard to whether the premises were occupied or unoccupied during all er part of the billing period and whether or not water was actually discharged into the system during the billing period. Bills for sewer service charges to all other customers shall be rendered by the Department of Water in conjunction with the regular water bills to the person er legal entity designated to receive the water bills for water and water service. All bills fer sewerage charges shall be payable on er before the date shown on the statement. Section 4. Delinquent Payments-Collect ion-Discontinuance of Service-Interest. In the event any person, firm, corporation, political unit(except the United States and the State of Kansas) or organization living er operating on premises connected to a sanitary sewer, shall neglect, fail or refuse to pay the service charge fixed herein by the governing body of the city for the operation of the sewerage system, such charges shall constitute a lien upon the real estate served by the cennection to the sewer, and shall be certified by the clerk of the city to the county clerk of Sedgwick County, to be placed on the tax roll for collection, subject to the same penalties and collected in like manner as other taxes are by law collectible, and the governing body of the city is authorized to refuse the delivery ef water through the pipes and mains of a publicly owned waterworks until such time as such charges are fully paid. There is hereby created and ordered to be established in the treasury of the city a separate fund hereby designated as the "sewer utility fund". All revenues derived from the sewer service charges herein established including any investment earnings of such revenue shall, when received, be promptly paid into the "sewer utility fund." The moneys in the fund shall be used for the purposes and in the order following: (a) Paying the cost and expense of the administration, operation and maintenance of the sewerage system of the city; (b) Paying the cost of alteration, reconstruction, repair, improvement, extension and enlargment of the sewerage system of the city when authorized specifically by the gevertiing'bo-dy of the City' or as approved in the city's annual capital budget or annual operating budget; (c) Paying the principal of and interest on any bonds that have been heretofore or may be hereafter authorized and issued for the purposes of improving or enlarging or extending main sewers, pumping stations, operated as a part of the city's sewerage system. Such other accounts within the "sewer utility fund" may be established and maintained as as in the judgment of the City Council necessary for the proper administration of the city's sanitary sewerage system. Section 6. Effective date. This ordinance shall take effect and be in full force after its publication in the offical city newspaper. Passed and adopted by the City Council this L/~ day of May, 1982.
