EXECUTIVE SESSION
MAY 3, 3 996 4:00 P.M.
Call to Order: Roll Call,
CITY HALL
The Greencastle Common Council met in Executive Session on May ? 1996 at 4:10 p.m.,
Outside Citv Hall. Mavor Michael called the meeting to order. On the Roil Call_ the followma
were found to he present Councilor Roach- Councilor Hammer, Councilor Green- Councilor
Bavnard and Councilor Masten. Also present was Citv Attorney Zeiner.
This meeting was held to update the Council on the Hearing for Temporary lniunction died by
Res -Care. Attorney Zeiner reported to the Council that the Judge will take 7 -10 days to decide.
The decision is as to whether or not this is a lair housing issue. Attornev Zeiner told the Council
that the case presented by Res -Care is that basically thev feel nobody can tell them anything and
they can put their facility anvwhere they want because thev are dealing with handicapped
children. The City has a small risk if this case is found to be under the fair housing law and the
® Court can make the City pay attorney fees and damages because they were readv to house kids in
February and the City did not allow them to open. Res -Care reported in Court that they have
alreadv spent approximateiy 540,000.00 on attorney fees. Attorney Zeiner told the Council that
the question is do we want to take a hard -nose approach - it's the principle, they have not been
truthful at all and we were constantly told different stories orjust see where we go'? Attorney
Zcmer asked if the Council wanted to put something together, although he doesn't'':<now if we
can since they want to do it their way. it so- what restrictions do we want? What are the areas
that need to be defined? The schools will not be hurt. Res -Care has alreadv agreed that ail
tuition will be paid upfront. After much discussion, it was agreed that the best alternative was to
try to get some control over the facility. It was agreed that Mayor Nfiehae ?, Councilor Baynard
and Councilor Nfasten would meet with the adjoining property owners on Friday_ to discuss the
issues and concerns ofthe neighbors.
Being no further business Councilor Hammer made a motion to adjourn, seconded by Councilor
Roach. .Iote was unanimous.
