A RESOLUTION OF THE CITY OF RICHLAND HILLS,TEXAS TO THE
TEXAS STATE LEGISLATURE IN SUPPORT OF LEGISLATION TO
END THE ARBITRARY APPLICATION OF ANCILLARY SERVICE
CHARGES BY ELECTRICITY PROVIDERS.
WHEREAS,the City of Richland Hills is a home rule city acting under its charter adopted by
the electorate pursuant to Article XI, Section 5, of the Texas Constitution and Chapter 9 of the Local
Government Code; and
WHEREAS, the City recognizes the importance of electrical services and their impact on
Texas families, business, and the Texas economy more generally; and
WHEREAS,the City wishes to request the passage of legislation eliminating the arbitrary
and poorly delineated application of ancillary services charges by electricity providers onto Texas
consumers, and thereby prohibiting Gexa Energy, LP("Gexa")or any other service provider from
arbitrarily imposing ancillary services charges without any clarification as to where and how those
charges were derived; and
WHEREAS, the City wishes to express its disappointment that Gexa, or any other service
provider would continue to impose exorbitant ancillary charges onto consumers without
clarification as to where and how specifically those charges are derived; and
WHEREAS, the City wishes to request the passage of legislation mandating systematic
reforms to the method and process of how electricity providers impose ancillary service charges
onto municipalities and consumers more generally.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS,TEXAS:
SECTION 1.
That the Texas Legislature is hereby requested to immediately pass legislation that
prohibits Gexa or any other electric service provider from imposing ancillary charges onto
consumers without clarification as to where and how specifically those charges are derived.
SECTION 2.
That the City Manager is hereby authorized and directed to make this Resolution available
to all members of the Senate and House of Representatives on behalf of the City of Richland Hills,
Texas.
SECTION 3.
The resolution shall take effect immediately from and after its passage.
