HomeMy Public PortalAbout007-1987- ORDINANCE AMENDING CERTAIN SECTIONS OF CHAP 97AMENDED ORDINANCE NO. 771987 AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 97 OF THE RICHMOND CODE AS ADOPTED BY AMENDED ORDINANCE 47-1986 REGULATING THE PLANTING, MAINTENANCE, CARE AND REMOVAL OF TREES WITHIN THE PUBLIC RIGHT-OF-WAY. NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana that Chapter 97 of the Richmond City Code be amended to include the following: By amending Section 97.06 subparagraph 2(b) to read as follows: The Street Tree Commission may remove, prune, or cause to be removed, all trees, shrubs, or plants that are planted on the public -right-of-way or municipal property, when in its discretion the pruning or removal will be beneficial to the peace, health and safety of the public and public improvement where trees, shrubs or plants are detrimental to the growth of adjacent trees. The Street Tree Commission shall require adequate liability insurance of all contractors engaged to perform these activities. The Street Tree Commission shall require adequate liability insurance of all contractors engaged to perform these activities. And by adding subparagraph 3: It shall be the duty of adjoining property owners to care and maintain on a regular and routine basis street trees adjoining their property. Upon the occurrence of a dangerous condition involving a tree, the adjoining property owner shall take such steps as necessary to remove such dangerous condition. When practicable, the adjoining property owner shall make attempts to notify the city of the adjoining property owners need to cause the removal of the dangerous condition. Subparagraph 4: The City, Street Tree Commission, and any of its agencies may serve notice upon an adjoining property owner requiring the joint property owner to remove dangerous condition of a street tree adjoining their property. Upon such notice the adjoining property owner shall cause such dangerous condition to be removed within seven (7) days of the date of such notice. Failure to comply with the notice may result in the City taking such steps as necessary to remove the dangerous condition and asses all costs related thereto on the adjoining property owners' real estate as a lien.
