The legislation would re-establish the Big Payette Lake Water Quality Council (BPLWQC) which sunset in 2005. The State of Idaho has since assumed Department of Environmental Quality responsibility for compliance with the federal Clean Water Act and has responsibility for monitoring and reporting on the water quality of Big Payette Lake. This bill will not change that. Under this proposal the new BPLWQC would have 9 members appointed by the Governor including one elected member of the McCall City Council. A request to support similar legislation was presented to Council in January and February 2021. Council at that time asked for more information about how plans created under this legislation would impact the upcoming Valley County Waterways Management Plan and how the activities would be funded. A majority 1 of Council indicated interest in supporting the bill depending on those answers but before a letter of support . could be prepared, the city was informed the legislation would not move forward. As a result of the work session and additional comments from staff and legal counsel, the consultants were able to incorporate that information into the final draft for adoption. The consultant will work through those changes with Council. Attached is a memo and the final draft of the Access McCall: ADA Self -Assessment & Transition Plan. Parks on behalf of Pine Creek Ranch, LLC, analyzing the title history of the subject property in relation to the potential existence of a future roadway easement along the southern boundary of the subject property. Email received on December 20, 2022, from Sheree Sonfield, expressing support for a future roadway easement and pedestrian pathway. Recommendation On February 7, 2023, the McCall Area Planning and Zoning Commission recommended approval of CUP - 21 -03 with the following recommended conditions of approval: 1. Prior to the issuance of a building permit, the applicant shall receive final engineering approval. 2. Prior to the issuance of a certificate of occupancy, the applicant shall record a 70 -foot -wide easement along the entirety of the southern property boundary. The easement shall be dedicated to the public for the construction of a future public roadway, pedestrian pathways and associated snow storage and drainage. 3. Prior to the issuance of a building permit, the applicant shall provide a revised bicycle and pedestrian plan showing all bicycle and pedestrian pathways located on -site to be a minimum of ten -feet (10') in width and constructed to the standards identified in the McCall Area Pathways Master Plan, unless the pathways shown are within the 70 -foot wide easement required in fr�� Condition of Approval #2. Prior to the issuance of a building permit, the applicant shall provide a revised landscape plan utilizing plants from the Native and Suitable Plants List. 6. Pursuant to McCall City Code Section 3.13.034(8), conditional use permit approval shall lapse and become void whenever the applicant has not applied for a building permit within one year from the date of initial approval. 10. Pursuant to McCall City Code Section 3.16.08, design review approval shall lapse and become void whenever the applicant has not applied for a building permit within one year from the date of initial approval. 11. An expansion of an equivalent square footage to what is shown on the site plan associated with this application may be approved through a design review application and that an additional conditional use permit shall not be required. Additional transportation or other improvements may be conditioned within future applications. This project provides various building and mechanical replacement/upgrades to meet regulatory requirements, improve performance and efficiency, and enhance aesthetics. Major components include: • Replacement of the raw water pressure main 12 -inch flow meter • Replacement of antiquated electrical and ventilation components • Installation of variable frequency drives (VFDs) to improve pump performance, control, and energy efficiency • New roof, exterior siding and architectural elements to maintain the structure and improve aesthetics • Epoxy coating of interior concrete flooring, new exterior doors, and exterior pavers at doorwa r entrances Attached are select sheets of the design plans. No expansion of the building footprint or pump station capacity will occur with this project. All required design/architectural elements of the project have been submitted to the City Planner to provide Administrative Design Review Approval. The bid opening occurred on 4/20/23. The bid is being reviewed by the Project Engineer (Eric Landsberg of Clear Solutions Inc) for accuracy and responsiveness to the bidding specifications. A complete bid tabulation, recommendation for contract award, and draft contract agreement (or recommendation to reject all bids) will be presented to the Council on 4/27/23. Like many volunteer based non -profits the program is limited to available staffing and volunteers and relies heavily on volunteer board of director support. The Recreation staff has been asked numerous times over the years to assist with and/or operate the program. Providing youth with appropriate afterschool activities and supervision is important for the overall health of our community. The Department feels it is in a position to begin to provide more formalized assistance to the program. PLCA and the Department have developed the attached Memorandum of Agreement that will allow our staff the opportunity to assist with and learn more about the program. PLCA will reimburse the city for the staff time. In return, the Payette Lakes Community Association will receive reliable staffing assistance. The Memorandum of Agreement has been reviewed by the city attorney.
