HomeMy Public PortalAbout010-1987- ZONING - 1201 NORTH E STREETAN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1201 NORTH "E" STREET FROM M-1 LIGHT INDUSTRIAL DISTRICT TO M-1 SU AND PROVIDING FOR THE SPECIAL USE OF SAID PROPERTY AS A COMBINATION SERVICE STATION, CONVENIENCE STORE AND CAR WASH. WHEREAS, the Zoning Map which is a part of Ordinance No.2325-1968 designates and describes as M-1 Light Industrial District the property located at 1201 North "E" Street; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from M-1 Light Industrial District to M-1 SU Light Industrial Special Use and to authorize the Special Use of said property as a combination service station, convenience store and car wash; and, WHEREAS, a study of this Ordinance Commission the 24th day were heard from all parties and, was conducted by the Richmond City Plan of March, 1987, at which time remonstrances interested in or affected by this Ordinance; WHEREAS, the vote of the Richmond City Plan Commission was 9 to 0 in favor of recommending the passage of Amended Ordinance No. 10-1987. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to M-1 SU Light Industrial Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of Block "A" in Elizabeth Starr's Addition to the City of Richmond, Indiana, and being more particularly described as follows: Beginning at the northwest corner of said Block "A" said point also being the intersection of the east line of North llth Street with the south line of North "E" Street in said City of Richmond, Indiana, and running thencwe, from said beginning point, east along the south line of said North "E" Street and the north line of Block "A", a distance of one hundred sixty-six and thirty-five hundredths (166.35) feet to the intersection of said line with the west line of a public alley; thence south, along the west line, of said alley and the east line of said Block "A", a distance of ninety-five (95) feet; thence west, parallel to the south line of said North "E" Street and the north line of said Block "A", a distance of one hundred sixty-six and thirty-five hundredths (166.35) feet to a point in the west line of said Block "A" and the east line of said North 12th Street; thence north, along said line, ninety-five (95) feet to the place of beginning. SECTION 2. That as provided in Articles 34 and 48 of Chapter 154 of the Municipal Code, the following described use of the above described real estate is allowed as a Special Use as a combination service station, convenience store and car wash. SECTION 3. As a condition of being granted the Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a. The Special Use site plan and narrative accompanying the petition shall be marked Exhibit "A" and made a part of this Ordinance. b. All lights on the property shall be directed away from any residences in the area. SECTION 4. This Ordinance shall be in full force and effect from and after the passage and approval as by law required. BOOK 15PAGE238 SPECIAL ORDINANCE NO. 11-1987 AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA CERTAIN CONTIGUOUS TERRITORY, ADJACENT AND ABUTTING THERETO, DESCRIBING THE SAME, PROVIDING FOR THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. WHEREAS, Mary Raper and Myra Quakenbush, each owning one -hundred percent (100%) of certain parcels of land, all being within the hereinafter described area, have petitioned the Common Council of the City of Richmond, Indiana for the voluntary annexation of said hereinafter described area, as set out, and in accordance with T.C. 36-4-3-5, and, WHEREAS, the area to be annexed is contiguous and adjacent to the present boundary of the City of Richmond, Indiana. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana: SECTION 1. That the following described territory, adjacent to the corporate boundaries of the City of Richmond, be annexed to and hereby is declared to be a part of the said Wayne Township, Wayne County, State of Indiana, and more particularly described as follows to -wit: Located in northeast quarter of Section 10 Township 13 North, Range 1 West, Wayne Township, Wayne County, Indiana, and being more particularly described as follows: Beginning at the northwest corner of the northeast quarter of said Section 10 and in the centerline of Hodgin Road; thence with the north line of the northeast quarter of said Section 10 and the centerline of Hodgin Road, South 89 degrees 38 minutes 05 seconds East for 1825.55 feet to the northeast corner of Hunter's Pointe subdivision, Section Two as recorded in Plat Book 14, Page 265 of the Wayne County Plat Records; thence with the east line of said Hunter's Pointe subdivision, Section Two, South 0 degrees 27 minutes 06 seconds West for 431.34 feet to the true point of beginning of the tract hereinafter described; thence South 21 degrees 22 minutes 00 seconds East for 525.00 feet; thence South 54 degrees 10 minutes 00 seconds East for 245.00 feet; thence South 40 degrees 43 minutes 00 seconds East for 98.00 feet; thence South 48 degrees 15 minutes 00 seconds East for 410.00 feet; thence South 64 degrees 12 minutes 15 seconds West for 229.76 feet; thence North 89 degrees 29 minutes 57 seconds West for 907.00 feet to a point in the east line of Henley Hills Subdivision, Section Two as recorded in Plat Book 12, Page 285 of the Wayne County Plat Records; thence with the east line of said Henley Hills Subdivision, Section Two, North 0 degrees 30 minutes 03 seconds East for 630.00 feet to a point in the south line of said Hunter's Pointe Subdivision, Section Two; thence with the South line of said Hunter's Pointe Subdivision, Section Two, South 89 degrees 37 minutes 24 seconds East for 345.12 feet to the southeast corner of said Hunter's Pointe Subdivision, Section Two; thence with the east line of said Hunter's Pointe Subdivision, Section Two, North 0 degrees 27 minutes 06 seconds East for 444.00 feet to the true point of beginning; containing 13.131 acres. SECTION 2. This Ordinance shall be in full force and effect from and after its passage by Common Council and approval by the Mayor and the publication hereof as required by law.
