HomeMy Public PortalAbout047-1997 - Vacation - walkway alley east of North 10th Street and north of East Main Street1997007139 97JUL-1 AM10:11 WAYNE COUNTY RECORDER ORDINANCE NO.47-1997 A SPECIAL ORDINANCE VACATING A TEN FOOT (10') WALKWAY ALLEY EAST OF NORTH 10TH STREET AND IMMEDIATELY NORTH OF EAST MAIN STREET WHEREAS, The City of Richmond, Indiana by its Board of Public Works and Safety has petitioned Common Council of Richmond, Indiana, requesting the vacation of a ten foot (10') wide alley/walkway located east of North 10"' Street and running north and south between East Main Street and Sailor Street, the same being Vacation Petition No. � -1997; and WHEREAS, the two owners of all land abutting the above described public way have been notified of the pending vacation and expressed no objection thereto; and WHEREAS, it is in the best interest of the City of Richmond to vacate the alley and its current use of a public thoroughfare, but to have title to the alley initially remain in the name of the City to allow its transfer of the same in conjunction with the acquisition of the property belonging to the owner of the land west of the vacated alley; and WHEREAS, pursuant to Indiana Code 36-7-3-12, Council has conducted a public hearing on said petition May 19, 1997, after publishing legal notice thereof at least ten (10) days in advance of said hearing as required by statute; and WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond code 155.04(b), conducted a public hearing on said petition May CS 1997, after publishing legal notice thereof at least 10 days in advance of said hearings as required by ordinance; and WHEREAS, it is desirable to vacate said public way. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities and subject to a pedestrian right-of-way for the benefit of the property owner immediately east of the alley, the public way described below is hereby vacated as a public thoroughway, with title remaining in the City, but subject to an immediate transfer to the property owner west of the alley. A strip of ground ten feet (10') wide immediately east of Lot Number 127 in that part of the City of Richmond laid out by Charles W. Starr. 4&-33-330 - q 13. J U L 0 1 1997 �L DILLON R.W.C. f � RICHMOND ADVISORY PLAN COMMISSION RICHMOND, INDIANA May 15,1997 Mr. Robert Dickman, President Richmond Common Council Richmond, IN 47374 RE: Ordinance No. 47-1997 Dear Mr. Dickman: Please advise the members of Common Council that the Richmond Advisory Plan Commission conducted a special public hearing,Thursday May 15, 1997, on the petition of City of Richmond owner; Robert B. Goodwin, agent; requesting the vacation of the public place described as a strip of ground ten (10) feet wide immediately east of lot # 127 in that part of the City of Richmond laid out by Charles W. Starr, commonly known as the alley between East Main Street and Sailor Street immediately west of 1014 East Main Street, in the City of Richmond, Wayne County, Indiana. Notice was given to the owner of 1014 East Main Street ( The only adjacent property owner besides the City). They indicated no objection to the vacation and no interest in receiving their proportionate share of the alley upon its vacation.
