A RESOLUTION OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, VACATING AND ABANDONING THE NORTHERLY
25' OF THE RIGHT -OF -WAY COMMONLY KNOWN AS
OLEANDER WAY AS SHOWN ON THE PLAT OF GULF
STREAM PROPERTIES NO. 2, AS RECORDED IN PLAT
BOOK 18, PAGE 42, PUBLIC RECORDS OF PALM BEACH
COUNTY, FLORIDA.
WHEREAS, the owner of the land abutting the property
hereinafter described has petitioned the Town to abandon and vacate
the northerly twenty -five feet (251) of the right -of -way commonly
known as Oleander Way, located over and across the land more fully
hereinafter described; and
WHEREAS, said right -of -way is not paved and is not being used
by the public; and
WHEREAS, the Town Commission of the Town of Gulf Stream does
hereby find and determine that the necessity for the northerly
twenty -five feet of said right -of -way is no longer necessary for
use as a right -of -way nor is it necessary for public use as long as
the public utility easement described herein is dedicated as a
utility easement.
NOW THEREFORE BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, as follows:
That northerly twenty -five feet of the right -of -way , commonly
known as Oleander Way, as shown on the Plat of Gulf Stream
Properties No. 2, more particularly described as follows, to -wit:
That part of the right -of -way for Pandanus Road and
Oleander Way as shown on the Plat of Gulf Stream
Properties No. 2, recorded in Plat Book 18, Page 42, of
the public records of Palm Beach County, Florida,
described as follows:
Begin at the point of intersection of the centerline of
Pandanus Road (a 15 foot right -of -way) with the
Centerline of Oleander Gray (a 15 loot right-of -way) ;
thence easterly, along the said centerline of Pandanus
Road, 7.50 feet; thence southerly, along a line 7.50 feet
east of and parallel with the centerline of Oleander Way,
25.00 feet; thence westerly, at right angles, 15.00 feet;
thence northerly, along a line 7.50 feet west of and
parallel with the centerline of Oleander Way, 24.96 feet
to the centerline of Pandanus Road; thence easterly,
along said centerline, 7.50 feet to the point of
beginning.
be and the same is hereby vacated and abandoned.

In substitution for the right -of -way herein abandoned there is
hereby dedicated a new utility easement on the following described
property:
That part of the right -of -way for Pandanus Road and
Oleander Way as shown on the Plat of Gulf Stream
Properties No. 2, recorded in Plat Book 18, Page 42, of
the public records of Palm Beach County, Florida,
described as follows:
Begin at the point of intersection of the centerline of
Pandanus Road (a 15 foot right -of -way) with the
Centerline of Oleander Way (a 15 foot right -of -way);
thence easterly, along the said centerline of Pandanus
Road, 7.50 feet; thence southerly, along a line 7.50 feet
east of and parallel with the centerline of Oleander Way,
25.00 feet; thence westerly, at right angles, 15.00 feet;
thence northerly, along a line 7.50 feet west of and
parallel with the centerline of Oleander Way, 24.96 feet
to the centerline of Pandanus Road; thence easterly,
along said centerline, 7.50 feet to the point of
beginning.
The Town Clerk is hereby authorized to advertise and record
this Resolution pursuant to law.
PASSED AND ADOPTED in a regular adjourned session assembled
this 13th day of _ May , 1994.
