HomeMy Public PortalAbout19700121CCMeeting1 1 1 Savannah Beach, Georgia January 21, 1970 The regular monthly meeting of Council was called to order at 3:00 P.M. today with Mayor Michael J. Counihan presiding. The councilmen in attendance were Jack Daniels, Edward Jung, Robert Cary, Milledge Jones and George Schwarz. Councilman Hohenstein was reported sick. Also present was City Attorney, Bart Shea. Mr. Terrence Seyden, reporter for the Jaycees publication, was a visitor at the meeting. The Minutes of the meeting of December 17th, were approved as written. Councilman Jack Daniels, Police Commissioner, announced that in an effort to up grade the equipment in the Police Department, and in particular the squad cars, several new items had been purchased for each car. This included signal flares, traffic flashlights, measuring wheels, riot guns with cases and blankets to be used for accident victims. He also stated that we were in the process of securing first -aid kits to be used in emergencies; together with oxygen-and resuscitation equipment for each car. Councilman Daniels also reported on two new scooters which would be purchased in the near future for the use of the meter maids. Councilman Jones reported that the Department of Public Works was functioning smoothly and that there were no complaints. Councilman Jung reported that there had been some discussion as to the possibility of changing the beginning and expiration dates of our truck decals. They now run from January 1st through Decem- ber 31st. He stated that the reason for using the calendar year period for this tax was to bring in some income •during the slack time of the year. Councilman Jung then made,a motion that the vehicle decals run from January 1st to December 31st in accordance with our present Ordinance. The motion was seconded and unanimously carried. Councilman Jung reported on the recent meeting with. Mr. Ed..Meill, HUD representative and efforts to secure a Workable Program for Savannah Beach. He stated that another meeting had been set up for February 11, at which time -Mr,. Meill "'will come down to help us with our Application for Certification. Councilman Cary read a proposed set of rules to be followed by those who use our newly decorated auditorium and moved that they be adopted by Council. They were as follows: 68 1. NO SMOKING -- -There will be no smoking in the auditorium at any time -- strictly enforced. Any organization requesting the use of the auditorium will have a minmum of two (2) ushers to be on duty during the time they use it. Their main duties will be to act as fire marshals to see that this rule is enforced. 2. TABLES, CHAIRS, ETC., - -- No tables, chairs, etc., will be removed from the auditorium. 3. ORGANIZATION REQUESTS -- Any organization requesting the use of the auditorium will have to book the date in the City Hall before permission to use same. Person or persons requesting same will be responsible for any damages to property within the auditorium. The hall will be left in a clean condition. 4. NO INDIVIDUAL SHALL HAVE USE OF AUDITORIUM for private parties, or for charging of a fee for private gains. 5. SOUND EQUIPMENT can only be used and operated by authorized personnel, assigned by the Clerk of Council. 6. No nails may be used to erect signs, posters, etc. Signs may be placed on the walls provided they are put up with tape or some similar material. THESE RULES AND REGULATIONS ARE TO BE STRICTLY ENFORCED BY ORDER OF THE MAYOR AND COUNCIL, CITY OF SAVANNAH BEACH. The motion that these rules and regulations be adopted was duly seconded and unanimously passed. City Attorney, Bart Shea, read an Ordinance and Agreement which he stated would enable the Employees Retirement System, our Social Security Agent, to return to the municipality advanced deposits totaling $4,976.00 which were paid in to the Agency at the time of the inception of the Social Security program for employees of the city. He stated that in ,essence, by adopting this Ordinance, Council was merely pledging an amount whichr.t would receive in state grant funds as security for assurance that it will make collections from its employees, submit required reports and remit payments to the State Agency as agreed to in its Plan. Councilman Daniels moved that this Ordinance and Agreement be placed on first and second reading at this council meeting. The motion was seconded and unanimously passed. A motion was then made for the adoption of the Ordinance and Agreement. This motion was seconded and unanimously passed. O R D I N A N C E 1 1 With reference to the proposed lease for the Fishing Pier between the City and Mr. Embry, Attorney Bart Shea stated that he had prepared the lease as directed by Council but he would like instructions from Council on one item. He read his proposed wording of the addition which would cover the abatement of the rent in the event of an act of God or a natural disaster; also the burden of removing debris in the event of such disaster. Council unanimously agreed to add this to the lease. Mayor Counihan announced that in accordance with instructions from Council he had proceeded to employ a full -time playground director to take charge of our playground in Memorial Park. He stated that with the help of the Savannah Beach Jaycees some real nice equipment had been seoured at no cost to the City. He also stated that Mrs. Helen Cooper had-been selected for this job,and that the Clerk of Council had been instructed to get together with Mrs. Cooper and. work out. the details concerning the hours, etc. The salary was set at $1.50 per hour as a start- ing rate and it was thought that the playground should be open after school on week -days and on- Saturday mornings., He further stated that this marks the first time that the City of Savannah Beach has ever had a full -time playground director for our children. He-asked Council; if they had any objections to pro- ceeding along these lines -and there were none.° Councilman Cary asked that, if possible, when the tennis court is repainted and the new net is put up that we consider changing the direction of the court provided it would not cost too much. Councilman Daniels reported that, while in Atlanta for Mayor's Day, our entire group called on.Mr. Bacon of the. State Highway Department and received assurance from him that our re- surfacing program at the beach had beentp for early March starting and for completion during the month. Councilman Jung listed.. the streets to be re- surfaced as follows: Re- surface and widen North Campbell Avenue from Highway 80 to Van Horn Street. Re- surface North Lovell from Highway 80 (First Street) to the - -old Ft. , Screven gate. Re- surface Loop 26 'from Sixteenth Street to the Strand and Eighteenth Street from the Strand to Butler Avenue. Re- surface Seventeenth Street from the Strand to Butler Ave. Re- surface Butler Avenue from Eighteenth Street, north to Sixteenth Street. 70 Councilman Jung stated this schedule has been approved by the State Highway Department and funds have been made available for it. He also stated that the target date' for completion of this project has been set for the end of March, 1970. Councilman Daniels reported that our Erosion Control Bill was moving along nicely. It' has now passed the Senate and' is being watched over by all of our representatives ` in'the General Assembly. Mayor Counihan asked the Clerk to read the cut -off dates for registration for the April 6th election; also the time during which candidates may qualify. They were as follows: Candidates may qualify from 9:00 'A.M. on February 20th until '5:00 P.M.' on March 7th. Registration books will be open for °this election until 5:00 P.M. on March 7th (Saturday) It was also' announced that there would be no qualifying fee for candidates. Councilman Schwarz moved that the Chairman of 'the ' Fire Committee be given a free hated in his efforts to acquire the fire - fighting equipment which has been declared surplus by the City of Savannah. The motion was seconded and unanumously carried: Councilman Schwarz asked that reservations be made for about four rooms at Jekyll Island for the GMA Convention which will be held on June 21, 22, and 23. Mayor Counihan instructed the Clerk to' make reservations for four double rooms for this convention. Bills for the various departments were approved for payment. There being no further business, the meeting was adjourned until the next regular or special called meeting. Cle"k of Council 1 AN ORDINANCE To amend an ordinance providing Federal Old age and Survivors Insurance for city employees and providing for an amendment to the original Plan and Agreement with the Employees' Retirement System of Georgia; to repeal conflicting ordinances; and for other purposes. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, AND IT IS HEREBY ORDAINED BY AUTHORITY THEREOF: SECTION 1. The Mayor (or other designated official) of the City of Savannah Beach, Tybee Island, is hereby authorized and directed to execute an agreement amending the original Plan and Agreement with the Employees' Retirement System of Georgia, in substantially the form attached hereto as Exhibit "AP, prodding for the release of social security escrow deposits. SECTION 2. The City of Savannah Beach, Tybee Island, hereinafter referred to as "the City", agrees to abide by the rules and regulations of the Employees's Retirement System of Georgia, hereinafter called the State Agency, in regard to collections from city employees and in making reports and payments to the State Agency. SECTION 3, The City hereby pledges an amount which it would receive in State grant funds as security for assurance. that it will make collections from its employees, submit required reports, and remit payments to the State Agency as agreed to in its Plan.of Coverage of employees for social security benefits. The City further agrees that if the amount of State grant funds which it is entitled to receive in a calendar year is less than its annual payment to the State Agency, as may be determined by the State Agency, then the City shall deposit in escrow, when so notified in writing by the State Agency and in accordance with its rules and regulations, an amount which, when added to the City's State grant funds, would total an amount sufficient to meet its obligations of reporting and remitting collections. to the State Agency. SECTION 4. All ordinances or parts of ordinances in con- flict herewith are hereby repealed. ATTEST: City Clerk (SEAL) CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA By: 1 1 1 EXHIBIT a"Au" STATE OF GEORGIA EMPLOYEES1- RETIREMENT SYSTEM AMENDMENT TO PLAN AND AGREEMENT The City of Savannah Beach, Tybee Island, Georgia, here- inafter called "the City" herewith submits for the approval of and acceptance by the Board of Trustees of the Employees' Retirement System of Georgia a proposed amendment to Section IV of the original Plan and Agreements executed by the City on the 26th day of June, 1957, and the llth day of February, 1960, said amendment to provide that the State Agency may, in lieu of requiring social security escrow deposits, accept the City's pledge of an amount of its State grant funds to secure the State Agency against defaults in collections and payments by the City. Pursuant to Act No. 561 of the 1967 General Assembly, it is proposed that Section IV of the original Plan and Agreement as amended be further amended by adding a new subsection (d) (1) to read as follows: "IV. Contributions . . . (d) (1) The foregoing provisions with reference to the advance deposit are hereby waived and in lieu thereof the City hereby pledges an amount which it would receive in State grant funds as security for assurance that it will make collections from its employees, submit required reports, and remit payments 1 1 to the State Agencybas agreed to in its Plan of Coverage of employees for social security benefits. The City further agrees that if the amount of State grant funds which it is entitled to receive is less than its annual payment to the State Agency, as may be determined by the State Agency, then the City shall deposit in escrow, when so notified in writing by the State Agency and in accordance with its rules and regulations, an amount which, when added to the City's State grant funds, would total an amount sufficient to meet its obligations of reporting and remitting collections to the State Agency. Should the City default in submitting reports and remitting collections when due, then in lieu of depositing in escrow an amount to secure the State Agency in case of default, it is agreed that should such default occur on the part of the City, it shall be the duty of the State Treasurer, upon notification from the State Agecny, to withhold all state appropriations to the City until the City submits the required reports and remittances to the State Agency. The State Treasurer is hereby authorized and directed upon certified request of the State Agency, to remit to the State Agency from such withheld funds, the amount necessary to cover any remittances which the City may fail to remit to the State Agency. The City - 2- 1 agrees to abide by the rules and regulations of the State Agency regarding collections from municipal employees and making reports and payments to the State Agency. Should the City fail to make collections from its employees or fail to make reports and payments to the State Agency as agreed to in its Plan of Coverage, the City shall be subject to a penalty of ten percent (10 %) of the delinquent payments." This amendment to the original Plan and Agreement is entered into this 21st day of January, 1970.
