A GENERAL ORDINANCE AMENDING CHAPTER 154 OF THE CITY OF
RICHMOND CODE AND ESTABLISHING IMPROVEMENT LOCATION
PERMIT FEES AS PROVIDED FOR BY CITY OF RICHMOND CODE
WHEREAS, Chapter 154 of the City of Richmond Code regulates zoning within the
City of Richmond, Indiana; and
WHEREAS, said Chapter requires that an Improvement Location Perniit be obtained
prior to the excavation, construction, reconstruction, extension,
conversion, or alteration of any building or structure; and
WHEREAS, said Chapter provides that the fee charged for the issuance of
Improvement Location Permits shall be established by ordinance of the
Common Council of the City of Richmond, Indiana; and
WHEREAS, the Wayne County Assessor has requested that all incorporated cities and
towns in Wayne County require that all farm structures be regulated by an
Improvement Location Permit and that the fee for such permit should be
set at Five Dollars ($5.00); and
WHEREAS, said Chapter as currently written would require that an Improvement
Location Permit be obtained prior to such excavation, construction,
reconstruction, extension, conversion, or alteration of any farm structure;
and
WHEREAS, said Chapter does not contain a definition of farm structure thereby
making it problematic to charge a different fee for Improvement Location
Permits for farm structures; and
WHEREAS, it is desirable that Improvement Location Permit fees for farm structures
be uniform throughout the county.
NOW, THEREFORE, be it ordained by the Common Council of the City of
Richmond, Indiana as follows:
1. A new Section 154.13.33 is hereby added to the City of Richmond Code
defining farm structure. This Section shall read as follows:
"FARM STRUCTURE" - Any structure utilized for agricultural operations.
2. Current Sections 154.13.33 through 154.13.111 are hereby renumbered as
Sections 154.13.34 through 154.13.112.
3. The permit fee for Improvement Location Permits for farm structures shall be
set at Five Dollars ($5.00).
4. The Improvement Location Permit fee for all other structures shall remain at
its current rate of Fifteen Dollars ($15.00).
