IONA CITY HALL
DECEMBER 15, 2020 — 7:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, City
Attorney Andrew Rawlings, Public Works Director Zech Prouse (via teleconference) and City
Clerk/Treasurer Keri West.
ABSENT: None.
VISITORS: Ramona McIntire, Thomas McIntire and Deputy Chris Williams.
Mayor Gubler welcomed everyone and Council Attorney Rawlings led the Pledge of Allegiance.
A roll call was taken by Clerk West to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of
November 17, 2020 were reviewed. Council reviewed the finance reports for the period ending
November 30, 2020 (17% of the fiscal year elapsed). The City had $1,063,619.66 in the bank
and routine bills had been paid, "Exhibit A".
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
consent agenda as presented. Council Member McNamara seconded the motion. All in favor.
Motion carried.
ITEMS OF BUSINESS:
Approval of 2021 City Council Meeting Dates— Clerk West stated the proposed schedule for
the 2021 City Council Meeting dates follows the third Tuesday requirement with no exceptions.
She continued and stated the proposed schedule for the Planning and Zoning Meeting dates for
2021 follows the second Wednesday requirement with no exceptions. Mayor Gubler asked the
Council if there were any questions or concerns. Nothing stated.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the
City Council Meeting dates for 2021 and the Planning and Zoning Meeting dates for 2021.
Council Member McNamara seconded the motion. All in favor. Motion carried.
Public Hearing — Ordinance to Amend Iona City Code §§ 10-1-7, 10-1-8, 11-8-4, 11-14-1
and 11-14-3; pertaining to Public Hearing Requirements (Ord. 248-12-20) — Mayor Gubler
stated this item was discussed previously pertaining to the necessity of the Planning & Zoning
Commission (P&Z) holding Public Hearings, in addition to the City Council holding a Public
Hearing. He continued and stated legally only one Public Hearing is required and it has been
determined that it should take place at the City Council Meeting. However, the P&Z will still
review and discuss those applications to determine recommendation to the City Council. He
continued and stated this amendment addresses those changes to the Iona City Code. Clerk West
stated this was discussed and approved by the P&Z at their meeting last week. No comments or
questions asked by Council.

Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve
Ordinance No. 248-12-20, an Ordinance of the City of Iona, Idaho; amending Sections 10-1-7,
10-1-8, 11-8-4, 11-14-1, and 11-14-3 of the Iona City Code; clarifying Public Hearing
Requirements and the conduct of hearings before the Planning and Zoning Commission;
providing methodology; preserving prior Ordinances in each instance; providing for severability;
and establishing an effective date. Council Member Wadsworth also moved to dispense with the
rule of reading the proposed Ordinance in full and on three separate occasions. Council Member
Thompson seconded the motion. A roll call vote was taken:

Public Hearing — Preliminary Plat Application, Eagle Rock Engineering, Elim Estates; a
Subdivision located on the North side of Iona Road, between 45th East and Olsen Avenue
(THIS PUBLIC HEARING WAS CANCELED DUE TO THE APPLICATION BEING
WITHDRAWN BY THE DEVELOPER) — Council President Geray stated he understands this
application has been withdrawn, but he requested some insight on what had recently been
discussed on this situation. He continued and stated he was potentially in favor of commercial
properties on that lot that were previously brought to the City Council. Clerk West stated that
development fell through many months ago and the new owner is considering developing it into
residential, single family lots. Mayor Gubler stated he had a meeting with the developer and
informed them the property required a secondary access to obtain City approval. He continued
and stated they had discussed various options to acquire secondary access to the development.
Clerk West stated the Preliminary Plat that was submitted was met with a lot of opposition by
nearby residents and was not recommended by the P&Z due to concerns brought up by the City
Engineer. Therefore, the developer chose to withdraw his application and will resubmit a new
Preliminary Plat at a future date. Mayor Gubler concurred and stated the City Council may have
to consider a variance on this property at some point for a development to go in, given how the
property is situated. He continued and stated there were things done in the past that make a
development difficult on this property and it may be necessary for the Council to approve a
variance in the future to correct past mistakes.
Ramona McIntire stated they own the field adjacent to the parcel being developed and they own
the lot in Homer Estates where the developer was proposing to add a road. She continued and
stated they are still undecided if they want to develop at this time. Mrs. McIntire expressed her
frustration with the way the developer communicated with them and the negative feedback they
have received from residents in Homer Estates. She continued and stated when Homer Estates
was developed, they were forced to pay full price for a lot to someday turn into a road to access
their property. She then submitted a letter to Clerk West expressing her concerns to share with
the Council and Deputy Williams privately.
General Water System Discussion— Mayor Gubler stated there is nothing to report. The water
project is currently shut down for the winter.
STAFF REPORTS: Clerk West stated she had a company come to the City Building to evaluate
the current audio/visual system and give a quote to update the entire system, including the

addition of a projector and teleconferencing equipment. The total quote was approximately
$38,000. She has submitted the quote for the CARES Act and is still waiting for pre -approval.
She continued and stated the deadline to submit it for the CARES Act was December 11, 2020.
She stated if they approve the amount, the City still has some flexibility on specifics, as long as
they are within the approved amount.
Director Prouse stated he had Clerk West submit a quote for pre -approval with the CARES Act
for external water sampling sites that would help the City be more compliant with state
requirements for the monthly sampling. It also removes the necessity of physically going into
locations, thus allowing for more social distancing and less exposure to the virus for City
employees. He continued and stated the amount was $7,477 and was approved today. Director
Prouse also reported he had a discussion with Progressive Irrigation regarding the surface water
rights for Sunrise Acres. He continued and stated they are not allowing cities to obtain those
water rights for any needs other than irrigation. Director Prouse continued and stated he thinks
the City should move forward with discussing the options available for all potential
developments and their surface water rights. Council President Geray expressed concern
regarding this decision by Progressive Irrigation. Attorney Rawlings confirmed Progressive
Irrigation cannot interfere with the transfer or water rights, but they are legally allowed to
interfere with the uses of the water. Director Prouse stated the City can discuss this with the
current owner of Sunrise Acres and request that he keeps the water rights in his name, rather than
petitioning them to be excluded with Progressive Irrigation. Discussion continued pertaining to
surface water rights and existing developments in the City.
Director Prouse then commended Deputy Williams for the thorough job he is doing for the City
of Iona. He continued and stated he gave Deputy Williams an extensive list of parking violators
and they were handled very quickly.
Council Member Wadsworth, Council President Geray and Council Member Thompson all
stated nothing to report.
Mayor Gubler stated there are two P&Z Members that are at their term limits. He continued and
stated he is looking for suggestions on new people to replace them.
Council Member McNamara stated she has not heard from Arlene Riding with the Iona
Historical Museum. Clerk West stated she has talked to her and was told they may have a
financial donor to help pay off the loan. However, nothing is final at this point.
SUGGESTED AGENDA ITEMS: Clerk West suggested a discussion on the Stanger Building.
