A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
APPROVING THE ACQUISITION OF A UTILITY TRACTOR AND OTHER
ACCOMPANYING ACCESSORIES THROUGH SOURCEWELL AND
MAKING A FINDING, BY WAY OF A FOUR-FIFTHS VOTE OF THE CITY
COUNCIL, THAT SUCH A PURCHASE IS MORE ECONOMICALLY AND
EFFICIENTLY EFFECTED THROUGH THIS USE OF AN ALTERNATE
PROCEDURE AS AUTHORIZED UNDER THE LYNWOOD MUNICIPAL
CODE SECTION 6-3.13(a) (3).
WHEREAS, Staff is requesting approval for the purchase for JOHN DEERE
5075E UTILITY TRACTOR, and TRIMAX ProCut S4 290; and
WHEREAS, pursuant to the Lynwood Municipal Code Section' 6-3.7(b)(2),
purchases of supplies, equipment and routine services where dollar amount involved is
$25,000 or more shall be by formal competitive bid; and
WHEREAS, the Lynwood Municipal Code Section 6-3.13(a)(3) allows for an
exception to the formal bidding process if the City Council finds by resolution adopted
by not less than 45ths of its members that such an acquisition may be more economically
and efficiently effected through the use of an alternate procedure; and
WHEREAS, Sourcewell is a cooperative purchasing orgnaization that holds
hundreds of competitively solicited contracts ready to used by other agencies; and
WHEREAS, Sourcewell offers very competitive pricing on the purchase of a
JOHN DEERE 5075E UTILITY TRACTOR, TRIMAX ProCut S4 290 and accompanying
accessories; and
WHEREAS, by utilizing Sourcewell as an alternate procedure will save labor
hours that otherwise will be spent through a formal bidding process as well as expedite
the acquisition process that otherwise will take 60 days.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That the City Council approves the acquisition of a JOHN DEERE
5075E UTILITY TRACTOR, TRIMAX ProCut S4 290 with accompanying accessories at
a purchase price of $57,914.11 as offered by the authorized dealer Stotz Equipment
utilizing the Sourcewell bid process.

Section 2. That the City Council approves for staff to use existing budget for
this purchase and allows the transfers of funds within and between Public Works
various approved divisions' budget to accommodate this purchase.
Section 3. That the City Council finds by a four-fifths vote of its members that
such acquisition may be more economically and efficiently effected through the use of
an alternate procedure such as Sourcewell , a cooperative purchasing agency, pursuant
to Lynwood Municipal Code Section 6-3.13(a)(3).
Section 4. That the City Council authorizes the payment through pre-pay if the
vendor requires payment upon delivery.
Section 5. The City Clerk shall certify as to the adoption of this City Council
Resolution.
PASSED, APPROVED and ADOPTED this 6th day of April 2021
