HomeMy Public PortalAboutRES 95/01RESOLUTION NO. 95 -1 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, ESTABLISHING FEES FOR THE PROCESSING OF APPLICATIONS FOR DEVELOPMENT APPROVAL; PROVIDING FOR THE RECOVERY OF DIRECT COSTS ASSOCIATED WITH THE PROCESSING OF SAID APPLICATIONS; PROVIDING FOR A WAIVER OF SUCH FEES AND EXPENSES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Town of Gulf Stream Zoning Code requires applications be submitted for various land development proposals and provides for the processing, review and final disposition of such applications; and WHEREAS, the Town staff is required to expend time in performing certain duties in processing applications for development approval; and WHEREAS, the Town may incur additional direct materials and professional review expenses in processing applications for development approval; and WHEREAS, the Town Commission believes those submitting applications for development approval should share in the costs of processing such applications. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA THAT: Section 1. Application Fees: The following fees are hereby established for applications for development approval as necessary to partially off -set the costs of Town staff time and related overhead expenses: Application Fee Comprehensive Plan Text Amendment $500.00 Future Land Use Map Amendment $500.00 Zoning Code Text Amendment $300.00 Official Zoning Map Amendment (Rezoning) $300.00 Development Agreement $300.00 Annexation /Contraction (Voluntary) $300.00 Variance $300.00 Subdivision $150.00 plus $25.00 for each lot Special Exception $150.00 Appeal $100.00 Architectural /Site Plan Review, Level 3 $150.00 Architectural /Site Plan Review, Level 2 $100.00 Architectural /Site Plan Review, Level 1 $0.00 Land Clearing Plan Review $50.00 North Ocean Boulevard Landscape $25.00 Disturbance Permit Sign Review $25.00 Developments of Regional Impact or otherwise (All recoverable subject to review under the provisions direct expenses plus of the Intergovernmental Coordination staff time to be Element of the Comprehensive Plan charged at rates set by the Town Commission at the time the applica- tion is submitted.) Section 2. Recoverable Direct Expenses: In addition to the application fees provided for in Section 1, applicants shall reimburse the Town for all direct expenses associated with processing the application. These expenses shall include, but are not limited to: advertising, postage, copying /duplicating, recording fees, mileage, signs /postings, and similar materials costs. In addition, applicants shall reimburse the Town for any and all professional review fees incurred including, but not limited to: attorneys, engineers, architects, landscape architects, planners, environmentalists, surveyors, utility contractors, building contractors, and other professionals who may be called upon by the Town to review and comment on an application. Use and selection of outside professionals to review applications shall be at the sole discretion of the Town. Within sixty (60) days of final action on an application, the Town shall submit an itemized bill to the applicant which shall include all recoverable direct expenses incurred in processing the application which bill shall be due in full within thirty (30) days of receipt, provided however, that the Town shall not process or grant other development permits or approvals involving the subject property until the bill is paid in full. Section 3. Waiver of Fees and Expenses: The Town Commission may waive all or part of required fees and expenses upon a finding that such a waiver is in the public interest of residents of Gulf Stream or that the fees and expenses pose an undue hardship on the applicant. Motions to approve such waivers shall require three (3) affirmative votes for passage. Section 4. Effective Date: This resolution shall become effective immediately upon passage.
