A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, FLORIDA, ESTABLISHING FEES FOR THE PROCESSING
OF APPLICATIONS FOR DEVELOPMENT APPROVAL; PROVIDING FOR
THE RECOVERY OF DIRECT COSTS ASSOCIATED WITH THE
PROCESSING OF SAID APPLICATIONS; PROVIDING FOR A WAIVER
OF SUCH FEES AND EXPENSES; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
WHEREAS, the Town of Gulf Stream Zoning Code requires
applications be submitted for various land development proposals
and provides for the processing, review and final disposition of
such applications; and
WHEREAS, the Town staff is required to expend time in
performing certain duties in processing applications for
development approval; and
WHEREAS, the Town may incur additional direct materials and
professional review expenses in processing applications for
development approval; and
WHEREAS, the Town Commission believes those submitting
applications for development approval should share in the costs
of processing such applications.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA THAT:
Section 1. Application Fees: The following fees are hereby
established for applications for development approval as
necessary to partially off -set the costs of Town staff time and
related overhead expenses:

Section 2. Recoverable Direct Expenses: In addition to the
application fees provided for in Section 1, applicants shall
reimburse the Town for all direct expenses associated with
processing the application. These expenses shall include, but
are not limited to: advertising, postage, copying /duplicating,
recording fees, mileage, signs /postings, and similar materials
costs. In addition, applicants shall reimburse the Town for any
and all professional review fees incurred including, but not
limited to: attorneys, engineers, architects, landscape
architects, planners, environmentalists, surveyors, utility
contractors, building contractors, and other professionals who
may be called upon by the Town to review and comment on an
application. Use and selection of outside professionals to
review applications shall be at the sole discretion of the Town.
Within sixty (60) days of final action on an application, the
Town shall submit an itemized bill to the applicant which shall
include all recoverable direct expenses incurred in processing
the application which bill shall be due in full within thirty
(30) days of receipt, provided however, that the Town shall not
process or grant other development permits or approvals involving
the subject property until the bill is paid in full.
Section 3. Waiver of Fees and Expenses: The Town Commission
may waive all or part of required fees and expenses upon a
finding that such a waiver is in the public interest of residents
of Gulf Stream or that the fees and expenses pose an undue
hardship on the applicant. Motions to approve such waivers shall
require three (3) affirmative votes for passage.
Section 4. Effective Date: This resolution shall become
effective immediately upon passage.
