Roil Call: Call to Order
The Greencastle Common Council met in regular session August 13, 1996, 7:30 p.m. at
Tzouanakis intermediate School Nledia Center. Mayor !Michael called the meetim to order. On
the roll call, the following were found to be present: COLlnellor Roach Councilor Hammer,
Councilor Green._ Councilor Bavnard and Councilor Masten. Citv Attorney John Zeiner was also
present.
Public Petitions and Comments
Thelma Bumgardner asked if the Citv has a weed control ordinance. Mrs. Bumgardner stated
that there are two properties on Martinsville Street that are overgrown with weeds and are
eyesores. Mavor Michael and Jim Wright will look into these and contact the owners.
Department Reports
Police Chiet'Jack Hanlon reported to the Council that he and Street Commissioner Jim Wright
looked at the space requested by Perry Wainman for handicapped parking on Vine Street and
there don't seem to be any problems.
Fire Chief O'1 -lair reported that the auction at the Elk's for the IRIS fund brought in
approximately S4,500.00.
Street Commissioner Wright stated that he has been notified that the sidewalk at the comer of
Jackson and Franklin Street is caving in. His department has placed barricades at the site, but he
has not had a chance to look at it vet Councilor Hammer asked about the sidewalk in front of
Dogwood Antiques, Commissioner Wright stated that he is working with Phoenix to resolve the
problem.
City Engineer Chris Barnes told the Council that DePauw University is replacing curbs and
sidewalks on Coilege Street and the Citv will do the resurfacing of the street. Resurfacing bids
are to be received by September 3rd. Engineer Barnes reported to the Council that the County is
to ask for bids on the Albin Pond culvert replacement with the County paying 60% and the City

" O r d i n a n c e 1 9 9 6 - 1 0 , A n O r d i n a n c e R e z o n i n g a P o r t i o n o f H u r l e y P r o p e r t y o n R o u n d B a m R o a d
from C -3 to R -P, final reading was read by Mayor Michael. Discussion regarding the
acceleration and deceleration lanes ensued. Councilor Hammer made the motion to approve
Ordinance 1996 -10 with the stipulation that the deceleration lane be extended to 12 feet as first
proposed, Councilor Roach requested that Councilor Hammer add an amendment to change the
word "Town" to "City ", this request was accepted by Councilor Hammer, seconded by Councilor
Masten. Vote was unanimous.
Ordinance 1996 -11, An Ordinance Rezoning a Portion of Wallace Subdivision from C -3 to 1-1,
was read by Mayor Michael. Councilor Masten made a motion to accept with the conditions
placed by the Plan Commission be incorporated into the Ordinance, seconded by Councilor
Hammer. Vote was unanimous.
Mayor Michael told the Council that the request from Ted Driscoll to honor Bob Flanagin has
never been resolved and Mr. Driscoll has contacted her again. Councilor Masten suggested a
plaque be placed on the Band Shell at the Park as a wav of honoring Bob Flanagin. By
consensus the Council requested an Ordinance be prepared for the September meeting.
Engineer Barnes presented the Council with drawings for a proposed City /county parking lot:.
The lot is at the comer of Columbia Lind Indiana Streets. The estimated cost is being looked at
in two phases. Phase I includes: reshaping the lot, add stone, compact, add bumpers and hang a
cable with numbers to be assigned to each office and to reconstruct the sidewalks. The
approximate cost is S34,000.00. Engineer Bames stated that the County has the equipment and
could do most of the work for less. Phase II is capping the lot which would cost approximately
S15,000.00. Councilor Masten stated that the County Commissioners have been involved in this
and are willing to - work with the City to help keep the County employees from parking on the
square. The City will own the lot and the County will do the improvements and upkeep. Mavor
Michael asked what the cost of the lot is. Councilor Masten stated that the owner is asking
approximately 590,000,00, but the lot was appraised for approximately $60,000.00 and there
would be negotiations to try to get it for less. Engineer Barnes stated that one thing he did not
include in his estimates was drainage which would add an additional S15,000.00 to $20,000.00.
By consensus the Council agreed to move ahead with this issue and requested a Resolution be
prepared for the August 19th Special Meeting.
Ordinance 1996 -16, An Ordinance Amending 1995 -13 - Salary Ordinance, first reading, was
read by Mayor Michael. Motion to adopt first reading was made by Councilor Baynard,
seconded by Councilor Hammer. Vote was unanimous.
Ordinance 1996 -15, An Ordinance to Allow the Preapproved Pavment of Certain Claims
Pursuant to I.C. 35- 4 -8 -14, Amending Ordinance 1992 -20, first reading, was read by Mayor
Michael. Motion to adopt first reading was made by Councilor Roach, seconded by Councilor
Baynard. Vote was unanimous.
Resolution 1996 -20, A Resolution Desi3mating CR200 E in Honor of Former Councilman Jerald
D. Calbert, was read by Mayor Michael. Motion to adopt was made by Councilor Roach,
seconded by Councilor Hammer. Vote was unanimous.

Council Comments
Councilor Hammer distributed a letter to Council regarding a businessman locating an adult
bookstore in the downtown area. Councilor Hammer stressed that our Ordinances need to be
updated quickly to keep these types of businesses out of our community. The letter will be
passed on to the Plan Commission.
City Attorney Zeiner updated the Council on a lawsuit regarding Michael Lady who was arrested
and detained and was not the right person. Paperwork has been forwarded to the insurance
company.
Councilmember gave reports on the various board they are appointed to.
Being no further business Councilor Hammer made a motion to adjourn, seconded by Councilor
Green. Vote was unanimous.
