HomeMy Public PortalAboutPC Resolution 2014-10-01 Recommending Approval of the Development Permit For Grand Valley Flooring, Located in a Portion of the Southeast 1/4, Southwest 1/4 of Section 20FRASER PLANNING COMMISSION RESOLUTION NO. 2014-10-01 A RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT PERMIT FOR GRAND VALLEY FLOORING, LOCATED IN A PORTION OF THE SOUTHEAST'/, SOUTHWEST'/ OF SECTION 20, TOWNSHIP 1 SOUTH, RANGE 75 WEST OF THE 6 TH P.M., DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF SAID SOUTHEAST'/, SOUTHWEST % ; THENCE SOUTH 000 26' EAST, ALONG THE EAST LINE OF SAID SOUTHEAST % SOUTHWEST'/ ,259.00 FEET TO A POINT ON THE NORTHERLY RIGHT-OF-WAY LINE OF U S HIGHWAY 40; THENCE NORTHWESTERLY ALONG SAID RIGHT-OF-WAY LINE 607.00 FEET TO A POINT ON THE NORTH LINE OF SAID SOUTHEAST'/ SOUTHWEST'/ ; THENCE NORTH 890 45' EAST, ALONG SAID NORTH LINE, 539.35 FEET TO THE POINT OF BEGINNING, COUNTY OF GRAND, STATE OF COLORADO. At the regular meeting of the Fraser Planning Commission held on October 22, 2014, Carney Investments LLC dba Grand Valley Flooring, requested recommendation of approval for a Development Permit for property located at 76891 US Highway 40, more legally described above, WHEREAS, Carney Investments is the current owner of said property; and WHEREAS, Carney Investments is requesting development permit approval which would permit the construction of a 5,000 square foot pre -manufactured, metal, commercial building to house Grand Valley Flooring and potentially 2 other businesses yet to be determined; NOW THEREFORE BE IT RESOLVED that the Fraser Planning Commission has voted to recommend approval of the Development Permit based on the representations made at the 10/22/14 Planning Commission meeting and in accordance with the documentation that has been reviewed by the Town of Fraser with the following conditions: 1. Correct the Sanitary Sewer Note on Sheet C3.0 of the Construction Plans to address JRS Engineering review comment #1 on memo dated October 20, 2014. 2. Variance to waive stormwater detention requirement, as requested in the Bowman / Vision Land letter dated October 20, 2014, is approved by Staff with the following two conditions: o At such time as future site improvements (development) for this parcel increases the stormwater flow (from the entire site) to one cubic foot per second or more above the site's undeveloped historic flow, the property owner shall construct stormwater detention facilities in conformance with Fraser's Standards in place at that time. Or, o If the "water quality pond" fails to function as designed and stormwater routinely overflows and becomes an off-site nuisance, as determined by Fraser, the property owner shall construct stormwater detention facilities in conformance with Fraser Standards in place at that time. 3. Applicant to provide details on the dumpster enclosure. 4. A Construction Guarantee Agreement and security must be provided in accordance with Town policies prior to building permit issuance. 5. A CDOT utility permit is required to connect to the existing manhole in the CDOT ROW. This permit will be coordinated with the contractor prior to commencing construction. 6. Confirm CDOT acceptance of entrance location and proposed US40 Highway improvements prior to building permit issuance. 7. Increase the height of the wainscoting from 2ft. to aft.
