HomeMy Public PortalAbout19700422CCMeeting85 Savannah Beach, Georgia April 22, 1970 The regular monthly meeting of City Council was held today in the council room at 3:00 P. M., with Mayor Michael J. Counihan presiding and the following councilmen in attendance: John H. Daniels, Edward Jung, Robert F. Cary, C. Louis #-Iohenstein, Milledge Jones and George Schwarz. Also in attendance was City Attorney, Bart E. Shea and Police Chief James W. Price. Councilmen -elect James W. Stettler and Edward Towns sat in on the meeting. Visitors at the meeting were Mr. Guy Waldeck of the Rockwell Manufacturing Company, Mr. Callahan, Mr. Bob O'Neil and Mr. J. L. Bowyer, Jr. The Dilutes of the regular meeting of March 25th and the special meeting of April 6th were approved as written. Councilman Jung introduced Mr. Guy Waldeck of the Rockwell Mfg. Company, whom he stated had come down to check on the performance of the 230 parking meters purchased last year from his company. Mr.. Waldeck stated to Council that he had found the meters perform- ing well and not diving any trouble. He stated that while he was here he wanted to inform Council of some new safeguards in the collection system which his company had developed recently. He stated that the .system was used in cases where keys were lost and fell into the hands of unauthorized persons. The system involved an inner box for each meter from which the contents were poured directly into a locked container to betaken directly to the sorter and counter in City Hall. He stated that in the event someone got possession of a key and was able to gain entrance to the meters they would have.to take the whole.box and you.would.know for certain that some unauthorized person had a key to the meters. Mr. Waldeck stated that in order for the city to convert to this system it would cost approximately $6.90 per kit for each meter, plus $105.00 for each carry -pack needed. Mr. Waldeck was given an inventory of our meters, with the request that he study it and let us know what the cost of converting to this system would be. The Mayor asked the visitors at the meeting if they had anything to say. Mr. O'Neil stated that he was there to observe. Mr. Calla- han, who is a retired civil engineer, stated that he wanted to offer. his help and assistance to the community in: whatever capacity they saw fit to use it. Mr. Bowyer requested aid from the City in an effort to halt the periodic flooding of his property in the Vicinity of First Street 86 and Lovell Avenue. The Mayor stated that the city had checked into this situation and found that a valley existed in this particular area and a big part of this would be overcome when the new beach protection groins were installed. Also, that he would request Mosquito Control to clean out the ditch and culvert which might give some relief. Councilman Daniels displayed four photographs taken of three unsightly locations in the city, two of which belonged to Mr. Edward Pasko, one of Adams Inn and the other an area near the ice house owned by Mr. Malley_ Clark. He then moved that the City Attorney be instructed to initiate action against these people account the deteriorated condition of the property. The motion was seconded by Councilman Hohenstein and unanimously carried. Councilman Daniels' announced that Mr. Reed, Superintendent of Public Works, was in the process of having a sign painted which - will be located near the entrance to the city warning the public of the strict enforcement of our laws regarding speeding, littering, loud mufflers, dogs on the beach, etc. He stated it would be a 4 x 8 plywood sign. Councilman Daniels announced that riot helmets had been ordered and would be used by our foot patrolmen. Councilman Jung stated that our delinquent taxes were $20,000.00 in arrears and that our delinquent water payments amounted to approximately $7,000.00 He further stated that through water cut -offs and fi fas we would use the legal means at our disposal to collect these back taxes and water charges. Councilman Jung requested a second reading on the Ordinance providing for the rate of License -Taxes for doing business and selling at Savannah Beach for the Fiscal Year beginning May 1, 1970 and continuing for each Fiscal Year thereafter unless otherwise altered or amended. He then moved the adoption of the Ordinance. It was seconded and unanimously approved on second reading. O R D I N A N C E Councilman Jung requested that the Ordinance providing for the taxation of real and personal property for the Fiscal Year commenc- ing May 1, 1970 and continuing for each Fiscal Year thereafter unless otherwise altered or amended, be placed on second reading and adopted. The motion was seconded and unanimously carried. O R D I N A N C E 87 Councilman Jung= -rei tt 4 -se c Arviatting on ' an Ordinance to assess and levy a License Tax upon retail dealers engaged in the business of selling malt beverages and wine or spirituous liquors for the Fiscal Year beginning May 1, 1970 and continuing for each Fiscal Year thereafter unless otherwise altered or amended. He then moved the adoption of this Ordinance. The motion was seconded and unanimously carried. O R D I N A N C E , Councilman Cary moved that Atlantic Tank & Tower Company from Atlanta be instructed to come down and complete the work to be performed on our water tank under the original contract; and also, for an additional $1,000.00 to spot prime and apply one complete all -over coat of exterior paint. The motion was seconded and unanimously carried. Councilman Cary moved'that we have the first and second reading at this meeting of an Ordinance amending our Code of Ordinances (Article II - Sect 20 -27) so as to change the minimum annual rate charges and provide for installment discount payments for both residential and commercial water. The motion was seconded and carried unanimously. He then moved the adoption of the Ordinance. The motion was seconded by Councilman Schwarz and unanimously carried. O R D I N A N C E Councilman Cary requested that a water meter be installed at the campsite by May 1st. Mayor Counihan stated that a 1 -1/4' meter will be installed at the campsite by May 1st. Councilman Jones requested that we approve by unanimous consent the enactment of a Refuse Disposal Ordinance, regulating the storage, collection. and disposal of refuse; the licensing of refuse collec- tors and providing penalties for the violation thereof on first and second reading at this meeting. His motion was seconded and unani- mously approved. He then moved the adoption of the Ordinance. It was seconded by Councilman Schwarz and unanimously carried. O R D I N A N C E Councilman Jones put on first reading an ordinance to amend- Article I of Chapter 4, Animals and Fowl, of the Code of Ordinances, City of Sav nnah Beach, Tybee Island, Georgia, providing that it shall be unlawful for any person to have or keep any hor se,t mui e, or 88 pony at . any place . within the municipality. A motion was made to adopt this Ordinance . on first reading. It was seconded and, unanimously,passed on.first reading., Councilman Daniels requested Chief Price to see that a goat which is being kept at one of the unsightly locations previously mentioned, be removed. In regard to the stray dog situation, Councilman Daniels, announced that the dog catcher from the Humane Society was in the City today picking up stray dogs and made eight cases. He said one of our police officers went around with him. He stated futher that we expected to have this dog catcher on the beach about every two weeks to work one day. Councilman Daniels announced that all plans had been finalized for a Red Cross: Safety Clinic to be held"under the direction of Mr. Ken Medernach on May 16th and 17th. He said the City of Savannah Beach will co- sponsor this event. Mayor Counihan.proclaimed Friday and. Saturday, April 24th and 25th as 'Poppy Day and urged everyone to, participate and contribute to this worthy cause. Councilman Jung requested a second reading on the Ordinance adopt - ing and enacting a new Code of Ordinances and . a new Charter for the City of Savannah Beach and providing for the manner of amend- ing such Ordinance. He then moved the adoption of the Ordinance. The motion was seconded and unanimously carried. O R D I N A N C E Councilman Jung presented the proposed Budget of projected appropriations and expenditures for the Fiscal Year beginning May 1, 1970 and ending April 30, 1971 and moved its adoption. The motion was seconded by Councilman- Daniels and unanimously, carried. B U D G E T Bills for the various departments were approved for payment. Councilman Hohenstein moved that a sum of $175.00 be appropriated to purchase four display cases for the Museum. The motion was seconded and unanimously carried. Mayor Counihan announced that he was endeavoring to secure a mosquito fog machine and truck for the beach which would be in 89 addition to the county mosquito truck. He said that he felt we could obtain the insecticide ffom the county if we had the equipment. Mayor Counihan stated that since our state grant money was based on population and the fact that the census takers appear to be slow in picking up completed forms, we should find out what can be done to expedite this. The Mayor asked that all departments hold down expenditures until we 'begin ` receiving income from our tax billing for - this year. Councilman Daniels moved that the sum of $600.00-be appropriated for the use of "the Jaycees to pay 'for the necessary county labor to.complete their recreation park project in Fort Screven over next week -end. The motion was seconded and unanimously carried. Mayor Counihan announced the receipt of bids for roofing work on several city buildings, stating that the low bids were sub- mitted by Smith Roofing Company as follows: (1) Install selvedge edge roof on Recreation Pavilion in Memorial Park $695.00 (2) Install new roof on rest rooms in Memorial Park $110.00 _(3) Clean_ and flood coat roof of Tybee Museum- $450.00 Councilman Hohenstein moved that these bids be accepted and the contradts be °awarded to Smith Roofing Company. The motion was seconded and unanimously approved. • City Attorney Bart Shea stated that our lease with Mr. Embrey called for him to make necessary repairs to the fishing pier which, to date, he has not performed and, in view of this, we should bring him in to a meeting and find out what his intentions are with respect to putting the pier in a safe condition. The Clerk was requested to invite Mr. Embrey to our next agenda meeting to discuss this with him. Councilman Daniels requested unanimous consent to adopt on first and second reading at this meeting, an Ordinance providing that the Mayor or certain Councilmen designated by the Mayor may hold and preside over the Recorder's Court in the absence or disqualifi- cation of the eledted Recorder. The motion was seconded and unanimously carried. He then moved the adoption of the Ordinance. This motion was seconded by Councilman Hohenstein and unanimously carries. Following the adoption of the Ordinance, Mayor Counihan stated that within the next few days he would direct a letter to the Clerk of Council designating three members of Council who, with h ,mself, would be eligible to act as Judge of Savannah Beach Recorder's Court with full power and authority in the absence or 90 disqualification-of the elected Recorder.. Mayor Counihan also requested that this letter be recorded in the Minutes and be made a part of the proceedings of this Council Meeting. O R D I N A N C E With reference to the status of N.aylor's Store and, with the view of instituting condemnation proceedings against it, Attorney Shea stated that Mr.. Aaron Weiner had taken over as County Administrator for this estate and they were in the process of appraising the property as vacant land. Mr. Weiner also wanted . to know if Council would approve the controlled burning of the building. Council was unanimously: opposed to this due to the near proximity of the treee..' and several buildings in the immediate area. It was recommended by Council that we follow the procedures as outlined in our Charter and Housing Code and condemn this and several other buildings in a similar condition as being, unfit for human habitation. There being no further business, the meeting was adjourned to the next regular or special called meeting. Clerk of Council 1 AN ORDINANCE AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSE TAXES FOR DOING BUSINESS AND SELLING IN THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR BEGINNING MAY 1, 1970, AND CONTINUING FOR EACH FISCAL YEAR THEREAFTER UNLESS OTHERWISE ALTERED OR AMENDED; FIXING PENALTIES FOR THE VIOLATION THEREOF: AND FOR OTHER PURPOSES. SECTION I: Be it ordained by the Mayor and Councilmen of Savannah Beach,- Tybee Island, in council assembled, and it is hereby ordained by the authority of the same, that license taxes for doing business and selling in the Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year beginning on May 1, 1970, and continuing for each fiscal year thereafter unless otherwise altered or amended, shall be payable by each person, firm or corporation transacting or offering to transact any of the kinds of businesses hereinafter specified and scheduled, or practising or offering to practise any of the professions or callings hereinafter specified or scheduled, whether in connec- tion with any other business, profession or calling or not, and shall pay the license tax hereinafter prescribed on or before engaging in or practising such profession or calling. The said report to the Clerk of Council of this municipality shall be made within 24 hours after the completion of said trade, purchase or acquisition of said junk or salvage. SECTION III: In the event any business or calling not specifically mentioned in the above list set forth shall be established in the Town of Savannah Beach, Tybee Island, Georgia, the Mayor and Councilmen reserve the right to establish a license fee for same by ordinance, which fee is to be of equal dignity as the license specifically mentioned in the above section provided, however, that such license shall not be more than the sum of $750.00. SECTION IV: This ordinance shall be subject to alteration or repeal in whole or in part at any time during the fiscal year beginning May 1, 1970, should it be deemed advisable, and no such amendment or repeal shall be construed to impair the right of Council to assess or levy tax for the whole of such year whenever made. SECTION V: Any person, firm or corporation owning or operating any riding devices, or passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a policy of insurance against personal injury and property damage, with a receipt showing that the premium thereon has been paid for the length of time covered by the license, in such company and in such amount as may be approved by the Mayor and Councilmen for the benefit of any person or persons who may be killed or injured or sustain damage to property by reason of operation thereof. SECTION Va: In Lieu of such policy of insurance, any person, firm or corporation owning or operating passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a Surety Bond in the amount of $5,000.00 for each vehicle operated by said person, firm or corporation, signed by surety company acceptable to the Mayor and Councilmen of Savannah Beach, said Bond guaranteeing the payment of any loss or damage sustained by any person or persons by reason of the operation of such vehicle, the exact form of such bond to be approved by the Mayor and Councilmen of Savannah Beach. SECTION Vb: In lieu of such policy of insurance and /or such Surety Bond, any person, firm or corporation owning or operating a passenger vehicle for hire, before being issued a, license therefor, shall deposit with the Clerk of Council a Real Estate Bond in the amount of $5,000.00 for each vehicle operated by said person, firm or corporation, signed by an owner of real estate who holds merchantable fee simple title to the same and acceptable to the Mayor and Councilmen of Savannah Beach, said Bond guaranteeing the payment of any loss or damage sustained by any person or persons by reason of the operation of such vehicle, the exact form of such Bond to be approved by the Mayor and Councilmen, of Savannah Beach. If said Real Estate Bond is approved by the Mayor and Councilmen, the applicant for license shall pay the fee for recording of said bond in the Clerk's office of the Superior Court of Chatham County, Georgia. SECTION VI: The Mayor and Councilmen reserve the right to refuse to issue to anyone any licenses for any purposes for reasons sufficient to them. SECTION VII: Half year license -- removed from Ordinance. SECTION VIII: Any person, firm or corporation violating any of the provisions of Section I of this ordinance shall, upon conviction before the Mayor's Court of said Town, be subject to be fined in the sum of not more than $100.00 or be imprisoned, not more than 30 days, either or both, or any portion of either or both, in the discretion of the Court. SECTION IX: All ordinances or parts of ordinances conflic- ing with the provisions of this ordinance are hereby repealed. First Reading: March 25th, 1970 Second Reading: April 22nd, 1970 1 1 AN ORDINANCE �- 2 -7U TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY IN SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY 1, 1970, AND FOR EACH FISCAL YEAR THEREAFTER UNTIL REPEALED OR AMENDED; AND FOR OTHER PURPOSES. SECTION I: BE IT ORDAINED by the Mayor and Councilmen of the City of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority of the same, that the rate of taxation upon real estate and personal property within the limits of said Town of Savannah Beach, Tybee Island, for the fiscal year commencing May 1, 1970, and for each fiscal year thereafter until repealed or amended, shall be Three and No Hundredths (3.0 %) per cent upon the assessed or returned value of same, bearing forty (40 %) per cent of true market value, of real estate improvements to be ascertained from the returns of the Committee on Assessments of said Mayor and Councilmen, and the valuation of personal property to be ascertained from the returns of the owners thereof in pursuance of the applicable laws and ordinances providing for the assessment and valuing of taxable property in the Town of Savannah Beach, Tybee Island, Georgia, and to carry into effect the provisions of the Act of the General Assembly of the State of Georgia approved August 19, 1922, Section 21, as amended; and it is further ordained that if any person or persons shall refuse to pay the taxes hereinable set forth, within thirty (30) days after same shall become due, the Clerk of Council, as Ex- Officio Treasurer of the Town, shall issue execution therefor, and the further sum of $1.00 for costs, and the Chief of Police and Ex- Officio Tax Collector shall proceed with such execution in the same manner as now provided by law in such cases of execution lodged with the Sheriff of Chatham County. SECTION II: Any tax upon real property assessed and due shall be payable in semi - annual payments; the first half being due and payable on or before May 1st of each year; the second half shall be due and payable on or before November 1st of each year. In the event that any tax is not paid when the same is payable, the outstanding amount shall be immediately executed, the fee for execution being $1.00, and in addition thereto an interest charge of one -half (?) of one (1 %) per cent per month shall be assessed. The provisions of this Section shall not apply to licenses for doing business in said Town, said licenses being covered under separate ordinance. The provisions of this Section shall apply, however, to those persons or companies required by the provisions of Section 92 -5902 of the Code of Georgia to make returns to the Comptroller General of Georgia. SECTION III: This ordinance shall continue in effect for each and every fiscal year hereafter unless and until repealed or changed by ordinance. SECTION IV: All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed; provided, however, that so much and such parts of ordinances passed, as provide for the execution of tax assessments, or part thereof, shall continue and remain in force so as to authorize the Clerk of Council and Ex- Officio Treasurer to issue executions, and the Chief of Police and Ex- Officio Tax Collector to collect same until said taxes or assessments shall be fully paid. Clerk of Council 1 1 AN ORDINANCE AN ORDINANCE TO ASSES AND LEVY A LICENSE TAX, UPON RETAIL DEALERS ENGAGED IN THE BUSINESS OF SELLING MALT BEVERAGES, WINE, OR SPIRITUOUS LIQUORS, FOR THE FISCAL YEAR BEGINNING MAY 1, 1970, AND CONTINUING FOR EACH FISCAL YEAR THEREAFTER UNLESS OTHERWISE ALTERED OR AMENDED; TO PROBIDE FOR THE COLLECTION OF SAID LICENSE TAX; TO PROVIDE FOR THE INSPECTION OF RECORDS AND BOOKS, BOTH WHOLESALE AND RETAIL DEALERS ENGAGED IN THE BUSINESS OF SELLING MALT BEVERAGES, WINE AND SPIRITUOUS LIQUORS; TO FIX PENALTIES FOR THE VIOLATION; AND FOR OTHER PURPOSES. SECTION I: BE IT ORDAINED by the mayor and councilmen of Savannah Beach, Tybee Island, in Council assembled, and it is hereby ordained by the authority of the same, that in addition to all other tax or license fees heretofore or hereafter imposed upon retail dealers engaged in Savannah Beach, Tybee Island, Georgia, in the business of selling malt beverages, wine or spirituous liquors as defined under the laws of Georgia, there is imposed and levied upon all such retail dealers within the City of Savannah Beach, Tybee Island, for the fiscal year begin- ning May 1, 1970, and continuing for each fiscal year thereafter unless otherwise altered or amended, license tax for the privi- lege of doing such business in Savannah Beach, Tybee Island, to be computed and collected as hereinafter set forth. The term "Retail dealers" shall include clubs and similar orginazations. SECTION II: The amount of the license tax imposed by this ordinance on such dealers shall be computed on the following basis: (a) 2(34 per case on battled Tait beverages where containers exceed 7 ounces, and 12 per case where containers contain. 7 ounces or less. (b) $1.25 per 1/2 barrel of 15 -1/2 gallons on draught beer, proportionately in larger -and smaller quantities. (c) 15 per quart or 1/5 gallon; 8 per pint or 1 /10 gallon; and 40 per 1/2 pint or smaller, on spirituous liquors. (d) 60 per case on wine. (e) The aforesaid quantity license taxes shall be 50% of the amounts stated on all such legal alcholic beverage6 manufactured or produced in Georgia using all Georgia products in the production or manufacture of such beverages. , The term "case" as applied to wine shall mean a carton or other container containing 24 bottles of pint size or small, or 12 hottles of quart size, or 1/5 size. Fractional parts of cases or barrels, kegs, or drums, or any other size or type containers, shall he computed propor- tionately. SECTION III: (a) The license tax imposed herein on malt beverages and wines shall be computahle and payahle monthly; (b) Each wholesale dealer or distributor selling, shipping or delivering malt beverages or wines to any retail dealers in the City of Savannah Beach, Tyhee Island, whether delivered to the retail, dealer's place of business in Savannah Beach, or elsewhere, for re -sale in Savannah Beach, shall, as a condition to the privilege of carrying on said business in Savannah Beach: 1. Keep true and correct records of all sales, ship- ments or deliveries of such malt beverages or wines to each retail dealer in Savannah Beach, such records to he preserved for a period of one year and to be made availahle on request for the inspection of any duly authorized representative of Savannah Beach, Tyhee, Island; 2. Collect from each such retail dealer in Savannah Beach and add on each invoice at the time of delivery of the malt beverages and wines, the amount of License Tax due under the terms of this ordinance, and hold the same in trust for Savannah Beach, Tyhee Island, until such amount is remitted to the municipality as next provided; 3. On or hefore the 10th day of each calendar month, make a verified return to Savannah Beach, Tybee Island, for the monies collected from retail dealers for the month immediately preceding said report, accompaying said return with a remittance to Savannah, Beach, Tyhee Island, for all license taxes collected. SECTION IV: If any wholesale dealer or distributor fails or refuses to make the returns herein provided, for, the City of Savannah Beach, Tybee Island, shall notify said party in writting, and if the returns are not made and the license taxes remitted within five (5) days from date of said notice, the municipality may withdraw from said wholesale dealer or distri- hutor the privilege of doing business in Savannah Beach by revoking his license. On such failure to make returns and pay the license taxes accrued, Savannah Beach, Tyhee Island, shall proceed to assess the amount of taxes due under this ordinance from retail dealers who have purchased from such wholesale 1 dealer or distributor, from the best information available, and proceed to collect said license taxes as provided by ordinance for the collection of delinquent license taxes. SECTION V: Each wholesale dealer in spirituous liquors (which shall include all alcholic beverages excepting beer and wine) shall keep 51 -A and 51 -B records available for inspection at all times by duly authorized agents and /or representatives of Savannah Beach, Tybee Island. Such records shall show the amount and quanity of each item sold by each wholesaler to each retailer and said wholesaler shall collect at the time of the delivery to said retailer the license tax under this ordinance. SECTION VI: It shall be a violation of this ordinance for any person, firm or corporation to sell at retail within the City of Savannah Beach, Tybee Island, any malt beverages, wines, or spirituous liquours on which the license taxes herein provide6n for have not been paid to the wholesale dealer or distributor for the municipality. SECTION VII: It shall be unlawful and a violation of this ordinance for any wholesale dealer or distributor, person, firm or corporation, to deliver any malt beverages, wines, or spirituous liquours to any retail dealer in the City of Savannah Beach, without first collecting the license taxes. SECTION VIII: It shall be unlawful for any person, firm or corporation engaged in the sale as a retail dealer of alcholic, vinous or malt beverages, to have in his possession any of such beverages unless the tax required by Savannah Beach, Tybee Island, shall first have been paid to the wholesaler, dis- tributor or other source delivering or causing said beverages to be delivered to said retail dealer, and whenever any such bev- erages are found in possession of a retail dealer where records of the payment of said tax shall not appear upon the records of the wholesale liquor dealer to the municipality, it will be pre- sumed that said tax has not been paid and the burden shall be upon the retailer to prove said fact. SECTION IX: Any person, firm or corporation engaged in the distribution by wholesale or any of the beverages mentioned in said ordinance willfully violating the same shall be subject to revocation of their license to do business within the corporate limits of the City of Savannah Beach, and all liquor found in the possession of any retail establishment in said City of Savannah Beach which has not paid said tax or reported same under said ordinance shall be subject to confiscation by the municipal authorities of Savannah Beach, Tybee Island, in addition to the other penalties set forth in said ordinance, and sold by the Chief of Police and Ex- Officio Tax Collector, and the receipts thereof paid to the Clerk of Council and Ex- Officio Treasurer. 1 1 1 SECTION X: Any retailers violating the privisions of this ordinance shall, in addition to the penalties hereinabove set forth, be subject to revocation of their license to do business in said City as provided in other ordinances of Savannah Beach, Tybee Island. SECTION XI: Any person, firm or corporation violating any of the provisions of this ordinance, or who shall assist any retail dealer in malt beverages, wines, of spirituous liquors in Savannah Beach, Tybee Island, to evade or avoid the payment of the license taxes herein provided for shall be guilty of a viola tion of this ordinance and on conviction thereof in the Mayor's Court of said City shall be fined not more than $100.00 or sentenced to imprisonment for not more that 30 days, or both punishments to be inflected, in the discretion -of the Recorder. First Reading : March 25, 1970 Second Reading: April 22, 1970 1 1 AN ORDINANCE 4_ 2) - --7O TO AMEND ARTICLE II, SECTION 20 -27, WATER AND SEWERS OF THE CODE OF ORDINANCES, CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, SO AS TO CHANGE THE MINIMUM ANNUAL RATE CHARGES AND PROVIDE FOR INSTALLMENT DISCOUNT PAYMENTS FOR BOTH RESIDENTIAL AND COMMERCIAL CONSUMPTION. BE IT ORDAINED BY THE MAYOR AND COUNCILMEN of the City of Savannah Beach, Tybee Island, Georgia, in council duly assembled and hereby ordained as follows: SECTION I To amend Section 20 -27, paragraph (a) Residential subparagraph (1) and (2) as follows: By striking paragraph (a), subparagraph (1) and (2) in its entirety and inserting in lieu thereof the following: (1) Minimum annual charge, for up to 100.000 gallons, $30.00. A discount of $3.00 shall be allowed if paid in its entirety by May 31, or such payment may be made in three (3) installments of $10.00 each due and payable August 31, December 31, and April 30. (2) Average, after 100,004 bill same as commercial. SECTION II To amend Section 20 -27 paragraph (b) Commercial, sub- paragraph (1) and (2) as follows: By striking paragraph (b), subparagraph (1) and (2) in their entirety and inserting in lieu thereof the following: (1) Minimum charge for up to 15,000 gallons every two month, $5.00 (2) 15,000 gallons and over, $0.34 per 1,000 gallons. A discount of 10% will be allowed if paid within 10 days following the two month billing. SECTION III' All ordinances and parts of ordinances in conflict herewith are hereby repealed. AN ORDINANCE AN ORDINANCE PROVIDING FOR THE HEALTH AND WELFARE OF THE CITY OF SAVANNAH BEACH BY REGULATING THE STORAGE, COLLECTION, AND DISPOSAL OF REFUSE, THE LICENSING OF REFUSE COLLECTORS, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED by the Mayor and Councilmen of the City of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority of the same: SECTION I: This ordinance shall be knowias the "Refuse Disposal Ordinance." SECTION II: Definitions (a) The term "garbage" shall mean all animal and vegetable wastes resulting from the handling, preparation, cooking, or con- sumption of foods. (b) The term "ashes" shall mean the residue resulting from the burning of wood, coal, coke or other combustible material. (c) The term "rubbish" shall include glass, metal, paper, plant growth, wood, or nun- putrescible solid wastes. (d) The term "refuse" shall mean all solid wastes, except body wastes, and shall include garbage, ashes, and rubbish. (e) The term "disposal" shall include the storage, collection, disposal, or handling of refuse. (f) The term "person" shall include any natural person, association, partnership, firm, or corporation. (g) Other: The singular shall include the plural and the masculine shall include the feminine and the neuter. SECTION III: Storage Practices. (a) Preparation of refuse. 1. Rubbish shall be (1) placed in approved containers or, (2) cut and bailed, tied, bundled, stacked or packaged so as not to exceed 36 inches in length and 50 pounds in weight. 1 1 1 (b) Refuse containers. 1. Refuse containers shall be made of durable, watertight, rust - resistant material having a close - fitting lid and handles to facilitate collection. 2. Refuse containers for residences shall be of not less than 10 gallons, nor more than 32 gallons in capacity. Containers for commercial establishments shall not exceed 30 gallons in capacity. 3. It shall be unlawful to permit the accumulation or residue of liquids, solids or a combination of such material on the bottom or sides of containers, it being the intention of this provision that the interior of containers shall be kept clean by thorough rinsing and draining as often as necessary. (c) Storage of refuse. 1. Each householder, commercial establishment, or person having refuse shall provide himself with approved refuse containers and shall place and keep all refuse therein; except as provided in Section 3, (a), (4), (2), of this ordinance relating to handling of rubbish. 2. It shall be unlawful to place refuse in any street, alley, or any other public place, or upon private property, whether owned or not, unless such refuse is placed in an approved container, except that rubbish may be stored as provided in Section 3, (a), (4), (2), of this ordinance. 3. It shall be unlawful to place refuse in any stream, or body of water, or in any place inconsistent with the provisions of this ordinance. SECTION IV: Collection Practices. (a) Place of collection. 1. Refuse containers shall, for the purpose of collection, be placed at ground level, and be made readily accessible to the collector. They shall be placed on the side of the street from which collection is to be made. 2. Notwithstanding provisions of Section 4, (a), (1), of this ordinance, householders, commercial establishments, or other persons, may, by contract with collectors, be permitted to place containers at agreed places upon their premises. 1 1 (b) Frequency of collection. 1. Refuse shall be collected: (a) Twice weekly. (b) Hotels, restaurants, institutions, and commercial establishments may be required to have more fre- quent collection, if determined by governing body to be essential to protect the public health. (c) Licensing of collectors. 1. No person shall collect, remove, haul, or convey any refuse through or upon any of the streets or alleys of the City of Savannah Beach or dispose of the same in any manner or place without obtaining a license from the governing body of said City. 2. The fee for such license shall be $100.00 per annum, and all licenses shall be issued for the calendar year, or such portion thereof as shall remain after the issuance thereof. There shall be no reduction in the fee for a license issued after the beginning of any calendar year. 3. Every person who shall apply for a license under this section shall state the type or types of refuse to be collected, the manner of collection, and the place and method of disposal. 4. No license shall be granted if the place and method of disposal shall not conform to the requirements of this ordinance, or to the ordinance of any municipal or quasi - municipal corporation, wherein disposal of the refuse is to be made. 5. No licensed collector shall make any change in the arrangements for disposal of refuse collection by him without first receiving the approval of the governing body. 6. It shall be unlawful to permit an unlicensed collector to collect or remove refuse from a household, institution, or commercial enterprise. (d) Collection vehicles. 1. All vehicles used for collection of garbage shall be equipped with compacting devices or equivalent types of closed bodies and shall have enclosed cargo space. 2. It shall be unlawful to collect, haul, transport, or convey garbage in open, unenclosed vehicles. SECTION V: Disposal of Refuse. (a) It shall be unlawful to dump, burn, bury, destroy, or other- wise dispose of refuse within the jurisdictional limits of the City of Savannah Beach except at the City approved refuse disposal site. SECTION VI: Penalties. (a) Any person who violates any provisions of this ordinance shall,_upon conviction, be sentenced and subject to penalties contained in Section 1 -8 of the "Code of Ordinances, City of Savannah Beach, Tybee Island, Georgia ". (b) Each day's continuance of a violation of this ordinance may constitute a separate offense. SECTION VII: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION VIII: This ordinance shall become effective on the 22nd day of April, 1970. AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF ORDINANCES OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA; ESTABLISHING THE SAME; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, EXCEPT AS HEREIN EXPRESSLY PROVIDED; PROVIDING FOR THE MANNER OF AMENDING SUCH CODE OF ORDINANCES: PROVIDING A PENALTY FOR THE VIOLATION THEREOF; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA: Section 1. That the Code of Ordinances, consisting of Chapters 1 to 20 inclusive, is hereby adopted and enacted as the "Code of Ordinances, City of Savannah Beach, Tybee Island, Georgia," and shall be treated and considered as a new and original comprehensive ordinance which shall supersede all other general and permanent ordinances of the City passed on or before June 25, 1969, to the extent provided in Section 2 hereof. Section 2. That all provisions of such Code shall be in full force and effect from and after the•22nd day of April, 1970, and all ordinances of a general and permanent nature of the City of Savannah Beach, Tybee Island, enacted on final passage on or before June 25, 1969, and not included in such Code or recognized and continued in force by reference therein are hereby repealed from and after the 22nd day of April, 1970, except as hereinafter provided. No resolution of the City, not-specifically mentioned, is hereby repealed. Section 3. That the repeal provided for in Section 2 hereof shall not affect the following: (a) Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of this ordinance; (b) Any ordinance promising or guaranteeing the payment of money for the City or authorizing the issuance of any bonds for the City or any evidence of the City's indebtedness, or any contract or obligation assumed by the City; (c) Any administrative ordinance of the City not in conflict or inconsistent with the provisions of such Code; (d) Any ordinance fixing salaries of officers or employees of the City; (e) Any appropriation ordinance; (f) Any right or franchise granted by the Mayor and Council to any person, firm or corporation; (g) Any ordinance dedicating, naming, estab- lishing, locating, relocating, opening, closing, paving, widening, vacating, etc., any street or public way in the City; (h) Any ordinance establishing and prescribing the street grades of any street in the City; (i) Any ordinance pfoviding for local improve- ments or assessing taxes therefor; (j) Any ordinance dedicating or accepting any plat or subdivision in the City or pro- viding regulations for the same; (k) Any urban renewal ordinance; (1) Any ordinance regulating zoning and sub- divisions in the City; (m) Any ordinance making any act or failure to do any act an offense against the City, when such ordinance is authorized under the state law and is not inconsistent with such Code; (n) Any ordinance fixing ad valorem taxes, or providing for the levying or collecting thereof; (o) Any ordinance enacted after June 25, 1969. Such repeal shall not be construed to revive any ordinance or part of an ordinance which has been repealed by a subsequent ordinance which is repealed by this ordinance. 1 Section 4. That whenever in such Code an act is pro - hibited or is made or declared to be unlawful or an offense by the mayor and council, or whenever in such Code the doing of any act is required or the failure to do any act is declared to be unlawful by the mayor and council, and no specific penalty is provided therefor, the violation of any such provisions of such Code shall be punished by a fine of not more than Two Hundred ($200.00) Dollars, or for imprisonment for a term not exceeding two (2) months, or both of these punishments, or by sentence to work on the public works not exceeding sixty (60) days, as provided in Section 1 -8 of such Code. Section 5. That any and all additional ordinances of a general and permanent nature of the City of Savannah Beach, Tybee Island, Georgia, enacted on final passage on or after June 25, 1969, and not included in such printed code, but passed in such form by council so as to indicate the intention of the Mayor and Councilmen to make the same part thereof shall be deemed to be included and incorporated in such code so that reference to the "Code of Ordinances, City of Savannah Beach, Tybee Island, Georgia" shall be understood and intended to include such additional ordinances and amendments. Section 6. That in case of the amendment by the mayor and council of any section of such Code for which a penalty is not provided, the general penalty as provided in Section 4 of this ordinance and Section 1 -8 of such Code shall apply to the section as amended; or in case such amendment contains provisions for which a penalty, other than the aforementioned general penalty is pro- vided in another section in the same chapter, the penalty so . provided in such other section shall be held to relate to the section so amended, unless such penalty is specifically repealed therein. Section 7. That a copy of such Code shall be kept on file in the office of the City Clerk, preserved in looseleaf form or in such other form as the City Clerk may consider most expedient. It shall be the express duty of the City Clerk, or someone authorized by him, to insert in their designated places all ordinances which indicate the intention of the mayor and council to make the same a part of such Code when the same have been printed or reprinted in page form, and to extract from such Code all provisions which may be repealed from time to time by the mayor and council. This copy of such Code shall be available for all persons desiring to examine the same. Section 8. That it shall be unlawful for any person to change or alter by additions or deletions, any part or portion of such Code, or to insert or delete pages or portions thereof, or to alter or tamper.with such Code in any manner whatsoever which will cause the law of the City of Savannah Beach, Tybee Island to be misrepresented thereby. Any person violating this section shall be punished as provided in Section 1 -8 of the Code of Ordinances of the City of Savannah Beach, Tybee Island and in Section 4 of this ordinance. Section 9. SEQ. SO AS TO PROVIDE THAT THE MAYOR, OR ANY MEMBER OF THE CITY COUNCIL DESIGNATED BY THE MAYOR, MAY HOLD AND PREiSIDE OVER THE RECORDER'S COURT IN THE ABSENCE OR DISQUALIFI_ CATION OF THE ELECTED RECORDER, AND TO PROVIDE FURTHER THAT SAID MAYOR, OR ANY MEMBER OF COUNCIL DESIGNATED BY THE MAYOR, SHALL BE DESIGNATED JUDGE OF SAID RECORDER'S COURT, AND SHALL HAVE ALL OF THE RIGHTS, POWERS, PRIVILEGES, DUTIES AND RESPONSIBILITIES OF THE ELECTED RECORDER OF SAID COURT, INCLUDING THE RIGHT TO COMPEL THE ATTENDANCE OF WITNESSES, PUNISH FOR CONTEMPT, SENTENCE UPON CONVICTION FOR VIOLATION OF A CITY ORDINANCE, OR FOR VIOLATION OF A STATE LAW WHERE JURISDICTION IS INHERENT, APPLICABLE OR WAIVED, TO ISSUE CRIMINAL WARRANTS, TO HOLD PRELIMINARY HEARINGS, TO FIX BONDS AND ANY AND ALL OTHER ACTS WHICH MIGHT BE REQUIRED; TO REPEAL CONFLICTING ORDINANCES; AND FOR OTHER PURPOSES. In the absence or disqualification of the elected Recorder of the Municipality, the Mayor, or any member of the City Council designated by the Mayor, shall be the Judge of the Recorder's Court of the Municipality. SECTION II. The Mayor, or any member of City Council designated by the Mayor, as Judge of said Recorder's Court shall have the power to preserve order, compel the attendance of witnesses, punish for contempt, have full power and authority to sentence upon conviction of a violation of a city ordinance, upon conviction of a State law where jurisdiction is inherent, applicable or waived, shall have the right to issue criminal warrants, to hold preliminary hearings and trials, to affix bonds, to commit such offenders to jail, to prescribe acceptable cash bonds, and to do• and perform any other act necessary to assure the continuing operation of such Recorder's Court in the absence or disqualification of the elected Recorder. Shea, elected Recorder of the Recorder's Court of the City of Savannah Beach, Tybee Island, in addition to the undersigned, as Mayor, I hereby appoint the follow- ing members of Council as Judge of such Recorder's Court of the Municipality: JACK H.
