The regular meeting of City Council was called to order at 3:00
P. M. today with Mayor Michael J. Counihan presiding and the
following councilmen in attendance: John H. Daniels, Edward Jung,
Robert F. Cary, C. Louis Hohenstein, Milledge C. Jones and George
Schwarz. Also in attendance was City Attorney, Bart E. Shea and
Police Chief James W. Price.
Also present at the meeting were Michael Bart, James M. Stettler,
and Terrence Seyden. Other visitors present were Mrs. E. F. Rosen,
Mr. Jack Brady and a group of approximately twelve residents of
Thunderbolt who accompanied Mr. Brady to the. meeting.
Mrs. E. F. Rosen, a resident of Eighteenth Street, appeared before
Council o complain about the noise in her neighborhood. She also
requested that sidewalks be placed on Eighteenth Street for the
safety of the children going to the beach. She also protested the
removal of the sand from the area of the Strand and 18th Street.
Mr. Jack Brady, together with approximately twelve residents of
Thunderbolt, attended council meeting for the purpose of securing
a letter from the City addressed to the Department of Housing and
Urban Development stating that the City of Savannah Beach would
grant a building permit to Mr. Brady to erect an apartment complex
for elderly people in the vicinity of Sixth Street and Miller
Avenue, Savannah Beach. In answer to a previous request from Mr.
Brady for this written permission for the housing construction,
which at that time he stated would be for low income housing,
Council agreed to give him a lettercto HUD but that it must con-
tain the qualification that in our new zoning ordinance, which
will be adopted in the near future, this particular area was
designated as 'R -1" - Prime Residential. Also, due to the fact
that no, plans or SpecificationsJof the contemplated improvements
had been submitted,, Council could not definitely state. that: a.'
permit would be issued. Further, Council felt that HUD should be
aware of the fact that there was a water and sewage problem in
this particular area which would have to be resolved and, there-
fore, any such approval would be reserved until all the facts
were known. This letter was not acceptable to Mr. Brady and his
appearance at"this. meeting was for the purpose of securing the
letter stating this permit would, be granted without any qualifi-
cations:
It was the opinion of Council that the letter as previously out-
lined was all that they could give him. He then asked for. that
letter and was told it would be written for him.
Mr. Ted Voight requested relief on a license,- that: was being

assessed him in the amount of $15.00 for alowing customers at his
filling station to use his rest rooms for changing clothes. This
request was referred to Mr. Jung and the licensing committee.
Mrs. Nell Teeple, a resident of North Campbell Avenue, complained
about the bad condition of the street near her house. The Mayor
stated that he would check with Mr. Reed and see what could be
done about it.'
The Minutes of the regular Council Meeting of April 22, 1970 were
approved as written.
Councilman Cary informed Council that Heater Well Company out of
Columbia, S. C. had been retained to check one of our wells in
order to locate a break in the casing and that this work was being
done at the present time.
Councilman Daniels, Police Commissioner, stated that a request had
been received from Mr. Nick Alexander for a retail liquor pouring
license, package shop and malt beverage license to be located at
the present site of the Tel Star Restaurant. He stated that the
building, which had been recently purchased by Mr. Alexander,
would be rebuilt and would comply with all health department re-
quirements. Councilman Daniels stated that it was the recommendation
of his committee that this license be granted and he so moved.
The motion was seconded and unanimously approved.
Councilman George Schwarz announced to Council that Mr. Porter
Dawson had organized a group of young boys, ages 12 to 16 who wanted
to initiate a campaign to help keep litter off the beach, stating
that they would perform this service without charge to the City
and that all they asked was that the City help them get some pub-
licity. There was no objection from Council and approval for this
project was given.
The Clerk of Council read a letter from Mr. Picot Floyd, City
Manager, City of Savannah in regard to our inquiry concerning the
surplus fire engines owned by Savannah in which he stated that the
Board of Purchase had set a price of $350 for each of these old
machines and that they were quite old and totally inadequate and
unreliable as fire protection equipment. He stated further that
they do not meet present ,fire underwriters standards. With this
information, Council was not interested in purchasing this equip-
ment and requested the Clerk to write Mr. Floyd, thank him for his
efforts in our behalf, and tell him they would not be interested
in this equipment.
The Bills for the various departments were approved for payment.
In approving the bills for the Parks and Recreation Committee,
Councilman Hohenstein commented on the purchase of some play-
ground equipment from Thompson Sporting Goods Store py Mrs.

Cooper. He requested that in the future no such purchases be
made without a purchase order and that the store be advised not
to deliver any merchandise to :anyone- without such purchase order.
He also felt it would be good for the incoming chairman of the
Recreation Committee take note of this and also get an inven-
tory of the equipment we now have on hand.
Councilman Daniels presented to Council a new proposed lighting .
plan for Sixteenth Street, and the two parking-areas on the-Strand.
He said the plan; in essence, was=.to remove_28- existing. mercury
vapor lights, and replace .them with 34 of the new high lumen lights
which have two and one -half times the output of. our: existing: iights.
He stated that the cost to the City would be $255.00 per month,
as opposed to the $140.00 per month we are now paying for the lights
in these areas. He stated further that the cost of the poles and
the labor_ would be borne by the .Power Company. This new lighting,
he said, would give us 1,564,000 lumens as opposed to 560,000,
lumens'' at present in these areas. He moved that. Council approve
this plan. The motion was seconded /and unanimously carried
Councilman Hohenstein recommended that the locks on the Community
House be- changed to prevent its use by unauthorized persons.` -He
stated that he had been informed by a local locksmith that they
could change the locks and stamp the keys so that they would not
be duplicated. Mayor Counihan stated that there had been some
misunderstanding with some of the parties involved in the use of
the Community House and that since we were to meet with them
later today he would like any further discussion held off until
that time.
Councilman Hohenstein stated that,.in_ order to fulfill a promise
to certain residents in the area of the Strand and Eighteenth
Street; he was requesting Council to discontinue the removal. of -
sand from that area. He stated that in the opinion of Messrs.
Lance Smith, Dr.._Rosen and Fred Doyle, the removal of this sand
was ill- conceived,.7.and ill- handled.. Mayor. Counihan stated that
if more of this sand is needed, more of it will be removed. He
said further that the clay we put there would be moved also.
Councilman Jones requested. a second reading of: an Ordinance- amend-
ing Article_=I--of .Chapter 4, Animals and Fowl, of the-Code of
Ordinances, City of Savannah Beach,.Tybee Island, Georgia, provid-
ing that it shall be unlawful for any person to have or keep any
horse, mule, or pony at any place within the municipality.
Councilman Jones moved the adoption of this Ordinance on second:
reading. The motion. was seconded by Councilman Schwarz.. and
unanimously passed.

There was also.a lenghty discussion on the. problem of residents...,
and visitors- ,bringing, dogs on: the beach.. It. was the thought of
Council that our Ordinance:should : be enforced and violators_
brought into court.
City Attorney, Bart Shea, read a Resolution setting forth certain
requirements in regard to liability insurance to be carried by
persons owning or operating riding devices,' implementing the
provisions of Section 11 -4 of Chapter 11, Article 1 of the; City
of Savannah Beach: Code:, of. Ordinances. Councilman Cary moved the
adoption of the Resolution and it was seconded by Councilman
Schwarz . and unanimously. carried.

Council was advised by Mayor Counihan that we were again having
trouble with. Mr. Joe- Upchurch_ who, resided - at 18th:. Place. The: Mayor
stated that Mr. Upchurch was again in violation of. our Building
Code. • He informed Council: that, Mr. - Upchurch recently took out = a --
permit to repair his garage and stated on the permit that the
repair work would be of wood and . it is. now - fpund_ that he is using
concrete block and building walls on all four sides up to the level
of the roof which amounts to a new structure. It was the opinion
of Council that the work on this job should be, . stopped until the
proper building, permit has been obtained; ,and his workers secure_ a
license. • Mr;., Kent,, the building inspector, was instructed tq, so
advise. Mr. Upchurch.
Councilman Schwarz inquired as to what had been done about..
eliminating some of the yellow lines, especially in the business
district and Belling .a decal to the business people; also, those
lines adjacent to the homes- on the ocean side of Butler :Avenue
in cases where. these property owners had already been issued
parking decals. He was advised by Mayor Counihan that Chief Price
had been requested to make a survey listing all yellow lines and
traffic signs in the municipality in order that they may be
incorporated .. in. an Ordinance..
After much disucssion regarding traffic congestion on Eighteenth
Street between Butler Avenue__and. the Strand, _Council. decided
to make Eighteenth Street a one -way street for traffic going West
and the City. Attorney was requested to draw up such_a resolution
and submit it. to Council.
City Attorney Shea asked Council.. for some direction-in regard to
the securing of the necessary permission from the Department of
Interior and consumating the lease of the campsite. He stated..that
it was his understanding that one thing we were waiting for was to
complete the negotiations with Herb Electric and Messrs. Smith

and Dyches and settle the payment of the bill for the electrical
work performed by Herb Electric and subsequently destroyed by the
erosion last summer. He was assured that this question had been
settled to the entire satisfaction of Herb Electric. Councilman
Daniels requested that this matter be held up for a discussion
and a decision at a later meeting. This was approved by Council.
There being no further business, the meeting was adjourned to
the nett regular or special called meeting.

AN ORDINANCE TO AMEND ARTICLE I OF CHAPTER 4, ANIMALS AND FOWL,
OF CODE OF ORDINANCES, CITY OF SAVANNAH BEACH, TYBEE ISLAND,
GEORG , SO AS TO PROVIDE THAT IT SHALL. BE UNLAWFUL FOR ANY
PERSO TO HAVE OR KEEP ANY HORSE, MULE, OR PONY AT ANY PLACE
WITHI THE MUNICIPALITY; TO PROVIDE FOR PENALTIES FOR VIOLATION
THERE F; TO REPEAL CONFLICTING ORDINANCES;• AND FOR OTHER PURPOSES.

BE IT ORDAINED by the Mayor.and Aldermen of the City of
,ah Beach, Tybee Island, in council duly assembled, and it
6by ordained by the authority thereof that:
SECTION I.
To amend Article I, Chapter 4, Animals and Fowl, of the
Code of Ordinances, City of Savannah Beach, Tybee Island, Georgia,
by stzlik ing Article I and each subsection thereunder, namely,
Secti4i 4 -1, Section 4 -2, Section 4 -3, Section 4 -4, and Section 415,
and inserting in lieu thereof the following:
"Section 4 -1. Livestock prohibited.
No horse, mule, cow, heifer, bull, steer, calf, goat,
pig, hog, or other type of livestock shall be permitted within
the city."
"Section 4 -2. Riding or driving horses or ponies
prohibited. It shall be unlawful for any person to ride or drive
any hdrse or pony at any place within the City."

SECTION II.
Anyone who violates the provisions of this ordinance
be subject to the fines and penalities set forth in
L
Section I -8 of Chapter I of the Code of Ordinances, City of
Savannah Beach, Tybee Island, Georgia.
SECTION III.
All ordinances or parts of ordinances in conflict herewith
are hereby repealed.

A RESOLUTION
WHEREAS, Section 11 -4 of Chapter 11, Article 1 of the
Code of Ordinances, City of Savannah Beach, Tybee Island, Georgia,
sets forth a certain requirement for any person owning or
operating any riding devices before being issued a license therefor
shall first deposit with the City Clerk a policy of insurance
against personal injury and property damages in such amount as may
be approved by the governing body for the benefit of any person who
may be killed or injured or sustains damage to property by reason
of its operation; and
WHEREAS, the Mayor and Councilmen, by this resolution
desireito implement the provisions of said section of the municipality's
Code of Ordinances by setting forth the amount of insurance coverage
required by the governing body of the municipality for any person
owning or operating such riding devices within the municipality;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen
of Savannah Beach, Tybee Island, in council duly assembled, and it
is hereby resolved by the authority of the same that the following
insurance provisions of coverage shall be the minimum requirements
applicable to carnival operations, consisting of riding devices of
every ]find and description, shows, concessions and appurtenant
grounds, and that the period to be covered by said insurance limits
shall be the applicable fiscal year of the municipality, i.e.
May 1 to April 30.
