NOW,THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Lynwood as follows: Section 1. The Lynwood Planning Commission has determined that the use of FY22 and FY23 PBID Annual Spending Plans funds would be beneficial to the business community. Section 2. The Lynwood Planning Commission recommends that the City Council of the City of Lynwood approve the PBID Annual Spending Plans for FY22 and FY23 (attached hereto as Exhibit "A") and set a public hearing date of June 15, 2021, to obtain public input and comments on the FY22 and FY23 PBID Annual Spending Plans. RECEIVE AND FILE the estimated Parking and Business Improvement District FY 2020-21 (FY21) Annual Spending Report. BACKGROUND On November 27, 1985, Lynwood Ordinance 1262 was adopted into law establishing the Parking and Business Improvement District (PBID). PBID assessments are levied as a fair and equitable way to provide funds to maintain, operate, and improve business areas in the City. The fundamental purpose of the PBID is to promote the economic revitalization and physical maintenance of the Lynwood business community. Section 3 of the Ordinance identifies the PBID Area as all of the territory within the boundaries of the City of Lynwood and Section 4(a) of the Ordinance established the system of charge and the method each business is assessed. The mandated levy imposes an additional 50% fee of the business license tax to all businesses located within the PBID area, which is assessed each year at the same time as the business license renewal, which takes place each December. ANALYSIS & DISCUSSION PBID assessments are levied as a fair and equitable way to provide funds to maintain, operate, and improve business areas in the City. The City expects to receive approximately $115,000 in assessment funds by the end of the current fiscal year (FY21). When combined with FY21 carryover funds (estimated at $160,000), the City anticipates having approximately $275,000 in PBID funds available for FY22. The assumption of $57,300 in contingency carryover from FY22 and historical annual revenue of $125,000 provides the basis of an estimated $182,300 in assessment funds for FY23. Staff has developed spending plans for FY22 and FY23 to be considered by the PBID Board based on the needs of the District, which was determined by the completion of a Needs Assessment to identify costs and issues involved with maintaining and improving the City's business areas. If the Plan does not utilize all available funds, a contingency fund will be set aside to allow for urgent needs and future endeavors. Economic Development Initiative The Economic Development Incentive focuses on the attraction of consumers, support and retention of businesses, and attraction of new businesses through beautification and promotion of Lynwood. It will strive to address business related issues that may arise throughout the year and provide opportunity for the City to advocate for business growth and expansion of our commercial stock. This effort will also provide funds to enhance infrastructure aesthetics that will promote commerce and consumer activity in our business district. The following itemized list of activities is designed to improve the aesthetics of the City's business community and assist in the promotion of commerce in Lynwood. All aspects of these activities are for the benefit and general welfare of Lynwood businesses both year round and in specific seasons where regular consumer activity tends to rise. Attachment "A" provides a summary of the FY22 and FY23 PBID spending plans, which includes the proposed activities and budget for each item. Attachment "B" provides the estimated spending report for the current year (FY21). PUBLIC NOTICE PROCESS This item has been noticed through the regular agenda notification process. CONDUCT a design and location review of subject Pole Sign (Sign "A") and Pylon Sign (Sign "G) 2. APPROVE WITH CONDITIONS the design and location of the signage under consideration in compliance with the Lynwood Municipal Code Chapter 25, Article 70 Background: The applicant, Mr. Curtis Fralin, has submitted a complete signage package that includes a variety of signage subject to the review and approval by Planning Commission (Signs "A" and "G") and other signage (Signs "B" through "F") requiring staff approval per Lynwood Municipal code Chapter 25, Article 70. The application has also requested that Pylon Sign "G" be approved in-concept for an area dedicated to adjacent Parcel 2 for a future automated car wash upon the same development. The subject property is located at 2800 E. Imperial Highway in conjunction with an abutting future car wash all considered one (1) development. The subject site was previously approved for a new automobile fueling station, convenience store, and the sale of beer and wine for off-site consumption associated with the convenience store by Conditional Use Permit No. 2018-04, Site Plan Review No. 2018-06, and Conditional Use Permit No. 2018-01, respectively. For good measure and only for reference, the subject site was also approved for Tentative Parcel Map No. 2018-01 merging three (3) previously existing parcels into one (1) parcel and then 1 subdivided two (2) parcels more in favor of site development. The newly developed Parcel 1 is the parcel that will contain all the signage in the instant application as well as the new convenience store and automobile fueling station. The newly developed Parcel 2 is poised to contain the future automated car wash. Signs "A" and "G" will be the focus of the subject signage application and consists of a 63 foot pole sign and 32 foot pole sign, respectively. Summary of all requested signage: A— one (1) 63 foot high pole sign; B — one (1) wall sign; C —one (1) ATM glass sign; D — one (1) 7-Eleven window sign; E — one (1) wall sign; F —three (3) fueling station canopy signs; and, G — 32 foot high pylon sign. In addition, Planning Division staff recommends that the attached Conditions of Approval be imposed as further described in the "Discussion" section below. The project site is located adjacent to the southerly intersection of Fernwood Avenue and Imperial Highway at 2800 East Imperial Highway. The site is currently undeveloped land and has the Specific Plan zoning designation and General Plan designation of "West Town Center". Discussion: Project Description The project site is located in Lynwood Transit Area Specific Plan and is designated as "West Town Center Neighborhood". The West Town Center land use designation authorizes all signage allowances described in the Lynwood Municipal Code, Chapter 25, Article 70. Lynwood Municipal Code Section 25-70-1 specifies the intent and purpose of the Sign Code, which includes but is not limited to, preventing excessive and confusing sign displays as well as reduce visual blight. To this end, Planning Division considered a review and approval of Sign "G" necessary in addition to the required Highway/Freeway Oriented Sign "A" review and approval by Planning Commission in order to ensure the Sign Code's intent and purposes are preserved. In light of the fact that all the proposed signage will be placed on Parcel 1, or the parcel fronting Imperial Highway, and the developer's ability of later developing additional signage on Parcel 2 such as an additional pylon sign, Planning Division staff chose to impose a restriction upon Parcel 2 prohibiting any additional pole or pylon signs. An additional condition of approval recommended by Planning Division would require Caltrans' review and approve the freestanding signs (pole and pylon) in-line with their requirements. Furthermore, a standard Department of Public Works visibility triangle requirement has been imposed to ensure the health and safety of public. 2 Environmental Determination The subject sign application is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15311 — Class 11 Accessor Structures and none of the exceptions under CEQA Guidelines Section 15300.2 apply. The requirement for Lynwood Planning Commission's review of the subject signage is set forth by Lynwood Municipal Code Section 25-70-4(B), 2 and 25-70-12(I). CONDITIONS OF APPROVAL COMMUNITY DEVELOPMENT DEPARTMENT - PLANNING DIVISION 1. The Project shall comply with all City of Lynwood Municipal Code, California Building Code, Los Angeles County Fire Code and applicable State of California and Federal regulations and shall comply,with requirements of City of Lynwood Departments. 2. Prior to issuance of a Building Permit, the Applicant shall sign a Statement of Acceptance that states he/she has read, understands and agrees to all Conditions of this approval and that acceptance of these Conditions waives any challenge as to the validity of these Conditions. 3. Development of the Project shall substantially conform to the Project depicted on the approved Site Plan and Elevations on file stamped May 21, 2021 or as amended by the Lynwood Planning Commission. Any subsequent modification to the Project site or structures shall first be reported to the Community Development Department, Planning Division for review. 4. Prior to scheduling a final inspection from the Building Division, the Applicant/Property Owner shall obtain final signatures from other Departments indicating compliance with all Conditions. 5. The City has determined that City, its employees, agents and officials should, to the fullest extent permitted by law, be fully protected from any loss, injury, damage, claim, lawsuit, expense, attorney fees, litigation expenses, court cost or any other cost arising out of or in any way related to the issuance of this Sign Approval and the activities conducted pursuant to this Sign Approval. Accordingly, to the fullest extent permitted by law, Sticks Lynwood and SGLA Lynwood, LLC and its representative(s), or its successors shall defend, indemnify and hold harmless the City, its employees, agents and officials, from and against any liability, claims, suits, actions, arbitration proceedings, regulatory proceedings, losses, expenses or cost of any kind, whether actual, alleged or threatened, including, but not limited to, actual attorney fees, litigation expenses and court costs of any kind without restriction or limitation, incurred in relation to, as a consequence of arising out of or in any way attributable to, actually, allegedly or impliedly, in whole or in part, the issuance of the Sign Approval, or the activities conducted pursuant to this sign Approval. Sticks Lynwood and SGLA Lynwood, LLC, and its representative(s), or its successors shall pay such obligations as they are incurred by City, its 3 employees, agents and officials, and in the event of any claim or lawsuit, shall submit a deposit in such amount as the City reasonably determines necessary to protect the City from exposure to fees, costs or liability with respect to such claim or lawsuit. 6. Prior to commencement of sign construction activity, the Applicant shall submit for plan check and approval. Said plans shall contain these Conditions of Approval printed on the plans. 7. Allappeals must be brought within ten (10) business days of the date of the final action by the Planning Commission. An appeal will be scheduled for public hearing before the Lynwood City Council. Persons filing the appeal must submit an application and pay a fee of$1,385.00. 8. The Property Owner shall maintain a proactive approach to eliminate graffiti from the installed signage on a daily basis and shall remove all graffiti within 24 hours of placement of graffiti. 9. Prior to commencement of sign installation, the Applicant or the sign installer shall submit evidence to Building and Safety Division that all contractors working on the signage will have a valid City of Lynwood business license. 10. Prior to submittal of building plans for plan check, the Applicant/Property Owner shall provide proof of LA County Fire Department approval (stamped plans). 11. Anything which is not shown on application/plans, or which is not specifically approved, or which is not in compliance with this section, is not approved. Any application and/or plans which are defective as to, but not limited to, omissions, dimensions, scale, use, colors, materials, encroachments, easements, etc., shall render any approvals granted by this section null and void. Construction (if any) must cease until all requirements of this section are brought into compliance. 12. All conditions of approval must be met prior to building permit final inspection. 13. Per LMC Section 3-11 Loitering and truancy is prohibited on or around the premises. 14. The applicant agrees that applicant shall not be permitted to develop any additional pylon and pole type signs as described in the Lynwood Municipal Code Chapter 25, Article 70 on Parcel 2. In the event that a pylon or pole sign is permitted on the Parcel 2, applicant shall be required to remove the secondary sign on Sign G. All other sign categories and allowances are not prohibited on Parcel 2 and would not trigger the removal requirement contained in this condition. 15. Applicant/property owner shall receive approval Caltrans relative to the subject sign approvals. 4 COMMUNITY DEVELOPMENT DEPARTMENT— BUILDING & SAFETY DIVISION 16. All construction shall meet or exceed the minimum building standards that are referenced in the following: • The California Building Code -2019 edition; • The California Plumbing Code - 2019 edition; • The California Mechanical Code - 2019 edition; • The Los Angeles County Fire Code - 2019 edition; • The National Electric Code - 2019 edition. In cases where the provisions of the California Building Code, the City of Lynwood Municipal Code, or the plans or specifications in these plans may conflict, the more restrictive provisions shall govern. 17. Applicant/property owner must provide a copy of the permit card signed by all departments prior to scheduling a final inspection. DEPARTMENT OF PUBLIC WORKS 18. Applicant/property owner shall receive signage visibility triangle approval. 19. The project shall be reviewed and approved by the City of Lynwood's Public Works, Engineering Department. Submittals to the County of Los Angeles Fire Department Fire Prevention Land Development Unit shall be submitted through https://epicla.lacounty.gov/SelfService/#/home.
