CONDUCT a public hearing and receive public testimony. 2. ADOPT Resolution No. 3423 thereby. approving Conditional Use Permit No. 2021-02 Background: Duke Realty, LP/Polynt Composites USA, Incorporated (hereafter, "Applicant") has submitted an application for a Conditional Use Permit ("CUP") to establish, use and maintain a 139 stall truck container storage facility. The subject site consists of 4.6 acres and will maintain 183,930 square feet of paved area. The property is located at 2801 Lynwood Road in the M (Manufacturing) Zone. The subject site is located on the north side of Lynwood Road between N. Alameda Street and Bellinger Street. A demolition (Permit No. B-008246) permit was issued on June 4, 2018 removing all on- site structure consisting of 32,851 square feet. The property is presently vacant and is not utilized for any use at this time. The site has development constraints associated with contaminated soil that would require remediation (or the clean-up) of site's soil in compliance with County of Los Angeles, State of California and U.S. Federal Government guidelines. As a result, the most suitable use for the subject site is in-line with Applicant's submitted proposal. 1 Discussion: Project Description The applicant is proposing a truck container storage facility consisting of 139 on-site stalls. Ingress and egress for the proposed project will occur from Lynwood Road. Further, all traffic routes will proceed west of the site towards N. Alameda Street. The . project complies with the City of Lynwood's landscape requirements. The existing metal tube fencing will remain and will be maintained to City standards. As conditioned, the parking area will be illuminated in-line with City requirements. The site will install. a swing, metal gate that will be electronically operated either automatically or manually. The proposed truck container storage facility is a permitted use with the approval of a Conditional Use Permit by the Planning Commission. Alameda Street to the west. 2 . • Conclusions Staff is in support the applicant's request with all ingress and egress exclusively from Lynwood Road. Furthermore, trucks and/or trucks with trailers must only be permitted to arrive and leave the site from N. Alameda Street. Truck activity must not originate or proceed east of the subject site from the Lynwood Road entrance. Staff also required the Applicant provide a Trip Generation Memo by a traffic engineer. Environmental Determination The proposed Project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15332 In-fill Development Projects and meets all of the required conditions (a)-(e) set forth under Section 15332 of the California Code of Regulations because the Project is consistent with the applicable general plan designation and policies as well as applicable zoning designation and regulations; the proposed Project occurs within City limits on a project site measuring approximately 4.6 acres and surrounded by existing urban uses; the Project site consists is currently a vacant and fully paved and has no value for endangered, rare, or threatened species; approval of the Project would not result in significant effects relating to traffic, noise, air quality, or water quality; the Project site can be served by all required utilities and public services; and the Project does not trigger the exceptions set forth under Section 15300.2 of the CEQA guidelines. Municipal Code Requirements Per Section 25-130-5 of the Lynwood Municipal Code, the Planning Commission can only approve a CUP if it finds the following true: A. That the proposed conditional use is consistent with the General Plan; The subject site is zoned M (Manufacturing) with a General Plan designation of Manufacturing as well. The zone permits truck container storage facilities with an approved Conditional Use Permit. The relationship between the subject specific plan and municipal code are consistent with the City of Lynwood General Plan. Goal LU-3 of the City's General has set a goal that industrial uses must enhance the employment base of Lynwood through the provision of adequate lands dedicated to industrial uses. The proposed use serves the intent of this goal as the project provides is creating a viable industrial use from land that is presently not serving the public or commerce in any manner. Permitting the proposed truck • container storage facility would increase commerce activity and likely provide more employment opportunities for Lynwood residents for trucking services and the local delivery of products to market. As such, based upon the above findings, the subject conditional use permit is consistent with the Lynwood General Plan. 3 B. That the nature, condition, and development of adjacent uses, buildings, and structures have been considered, and that the use will not adversely affect or be materially detrimental to these adjacent uses, buildings, or structures; Imposing the recommended 'conditions of approval for the proposed truck container storage facility would result in an approval and use that will not be materially detrimental to any adjacent uses, buildings, or structures in the immediate vicinity of the subject site. These safeguards will set in-place conditions of approval listed within CUP No. 2021-02 that will run with land. A visual survey was completed wherein it was determined that the proposed use will not adversely affect or be materially detrimental to any adjacent buildingor structure as the proposed truck container storage facility will be consistent with surrounding development. The proposed use is further safeguarded by the fact that the approved project will be required to complete on-going inspections by the Public Safety Division and other state and federal agencies. These city, state and federal entities will ensure compliance 'with all their respective government codes. Furthermore, the proposed truck container storage facility will be reviewed by and require approval from the Los Angeles County Fire Department to ensure compliance with all current fire protection codes as well. The 'applicant will provide site security and be required to maintain the site free of graffiti as the CUP includes a condition that any graffiti placed within the control of the operator be abated and painted to match the existing surroundings within 24 hours its placement. The operator will also be required to ensure that no loitering occurs, at any time, to preserve a positive image of the community. Similarly, the newly developed site meets all the development standards required of truck container storage facilities as prescribed by the zoning code: The proposed use will add safety to the surrounding area aslighting and security cameras will be installed throughout the site. The recommended conditions of approval required by the Planning Division, in conjunction with the safeguardsdescribed above, have been developed and are intended to mitigate any potential adverse impacts to the adjacent uses and operational activities not, adversely affects pr be materially detrimental to adjacent uses, buildings, or structures. C. That the site for the proposed conditional use is of adequate size and shape to accommodate theuse and buildings proposed; The subject property is sufficient in size and shape' to accommodate 'the conditionally permitted truck container storage facility. The subject project's site is approximately 4.6 acres in size and the proposed use will establish and maintain 139 truck trailer stalls. . 4 The proposed truck container trailer storage design meets on-site circulation requirements and will improve egress and ingress to the entire property in compliance with all City Engineer requirements. The proposed use will serve the applicant's business needs and.a demand in the industry market well served by the proposed use and provide an important service to local and surrounding population. The subject site is well suited for the development of the proposed project due heavy manufacturing zone and designation. In contrast, the subject site is not appropriate for commercial or any near future residential uses. As such, the proposed use is compatible with the surrounding uses, supports the existing character of the area, and serves the needs of those who live, work, and visit the local manufacturing zoned area and compatible uses. D. That the proposed conditional use complies with all applicable development standards of the zoning district; and The proposed conditional use application for a truck container storage facility is a straight forward use that operates in compliance with the city's manufacturing development standards. The proposed conditional use requests have been. analyzed and staff has determined that the proposed use meets all applicable development standards established by the City's zoning code. The project has also imposed conditions will ensure that operation will complement the existing adjacent uses. subject to the review, revision and final approval by the Planning Commission. Based upon the supporting facts, a finding is confirmed in the positive that the proposed conditional use application requests comply with all applicable development ' .standards associated with site's underlying zoning and requirements and development standards. E. That the proposed conditional use observes the spirit and intent of this zoning code; The project proposes to develop a truck container storage facility use or an overflow area in observance with the spirit and intent of the Zoning Code. The project site is presently a vacant and presently paved land. The proposed new truck container storage facility use will be consistent and in greater observance with zoning code regulations and the spirit and intent of the zoning code. Some of the more compliant aspects of the project include the 'creation and development of an more attractive streetscape that upgrades the site in compliance with the goals and objectives of the Lynwood Zoning Code. . As such, the proposed conditional use will result in a project that observes the spirit and intent of the City's zoning code. 5 CONDITIONS OF APPROVAL COMMUNITY DEVELOPMENT DEPARTMENT - PLANNING DIVISION 1. The Project shall comply with all City of Lynwood Municipal Code, .California Building Code, Los Angeles County Fire Code and applicable State of California and Federal.regulations and shall. comply with requirements of.City of Lynwood Departments. • 2. Prior to, issuance of a Certificate of Occupancy, the Applicant shall sign a Statement of Acceptance that states he/she has read, understands and agrees to all Conditions of this approval and that acceptance of these Conditions waives any challenge as to the validity of these Conditions.. 3. Development of the Project shall substantially conform to,the Project depicted on the approved Site Plan and Elevations on file stamped June 8, 2021, unless otherwise amended by these Conditions of Approval. Any subsequent modification to the :Project site or proposed, future structures shall first be reported to the Community Development Department, Planning Division for review. • 4. Prior to scheduling a final inspection from the Building Division to begin operation, the Applicant/Property Owner shall obtain final signatures from other Departments indicating compliance with all Conditions. 5. If this CUP is not used within one (1) year from the date of its approval, the CUP shall become null and void and be of no effect in accordance with the LMC Section 25-13-6. . 6. The City has determined that City, its employees, agents and officials should, to the.fullest extent permitted by law, be fullyprotected from any loss, injury, damage, claim; lawsuit, expense, attorney fees, litigation expenses, court cost or any other cost arising out of or in any way related to the issuance of this Site Plan Review, or the activities conducted pursuant to this Site Plan Review. Accordingly, to the. fullest extent permitted by law, Duke Realty, LP/Polynt Composites USA, Inc. and its representative(s), orits successors shall defend, indemnify and hold harmless the City, its employees, agents and- officials, fromand against any liability, claims, suits, actions, arbitration proceedings, regulatory proceedings, losses, expenses or cost of any kind, whether actual, alleged or 'threatened, including, but not limited to, actual attorney fees, litigation expenses and court • costs of any kind without restriction or limitation, incurred in relation to, as a • consequence of arising out of or in any way attributable to, actually, allegedly or impliedly, in whole or in part, the issuance of the Site Plan.Review, or,the activities conducted 'pursuant to this Site Plan Review. Duke Realty, LP/Polynt Composites USA, Inc., and its representative(s), or its successors shall pay such obligations as they are incurred by City, its employees, agents and officials, and in • 6 • the event of any claim or lawsuit, shall submit a deposit in such amount as the City reasonably determines necessary to protect the City from exposure to fees, costs or liability with respect to such claim or lawsuit. 7. All appeals must be brought within ten (10) business days of the date of the final action by the Planning Commission. An appeal will be scheduled for public hearing before the Lynwood City Council. Persons filing the appeal must submit an application and pay a,fee.of$1,385.00. 8. The Property Owner shall maintain a proactive approach to eliminate graffiti from structures, fences/walls, and accessory buildings on a daily basis and shall remove all graffiti within 24 hours of placement of graffiti. 9. Prior to commencement of Project construction, the Applicant shall submit evidence to Building and Safety Division that all contractors working on the Project site have a valid City of Lynwood business license. 10. Prior to issuance of 'a Building Permit, the Applicant shall remit the following Development Impact Fees, and any other required Fees to the City of Lynwood: • Art in Public Places Fee; • Impact Fee; • Drainage Fee; • Plan Check Fee; and, 11. The Applicant/Property Owner shall provide proof of LA County Fire Department approval by stamped plans. 12. The truck container storage facility shall be operated in a manner which does not create any unacceptable noise levels in violation of the Noise Ordinance or in violation of any other provisions of the Lynwood Municipal Code, state, or federal law. Any nuisances associated with the truck container storage facility must be abated immediately upon notice by the City. 13. The applicant shall design all outdoor lighting including parking lot lighting with full shields, and cut off flat lenses to ensure that all light from any fixture will not direct light skyward, and will minimize light pollution -floodlights are strictly prohibited. 14. The applicant shall ensure that all irrigation for landscaping shall'be on automatic timer. 15. Landscaping on-site must be kept and maintained in good condition at all times. All landscaped areas shall utilize drought-tolerant planting material. 16. Anything which is not shown on application/plans, or which is not specifically approved, or which is not. in compliance with this section, is not approved. Any 7 application and/or plans which are defective as to, but not limited to, omissions, dimensions, scale, use, colors, materials, encroachments, easements, etc., shall render any entitlements granted by this section nulls and void. Construction (if any) must cease until all requirements of this section are brought into compliance. 17. All conditions of approval must be met prior to certificate of occupancy. 18. The project shall exclusively gain ingress and egress from Lynwood Road. Trucks and/or trucks with trailers shall only be permitted to arrive and leave the subject site from N. Alameda Street to the west. 19. All truck route activity shall not permitted to travel east of the subject site along the Lynwood Road. COMMUNITY DEVELOPMENT DEPARTMENT — BUILDING & SAFETY DIVISION 20. As applicable, all construction shall meet or exceed the minimum building standards that are referenced in the following:. • The California Building Code - 2019 edition; • The California Plumbing Code - 2019 edition; • The California Mechanical Code - 2019 edition; • The Los Angeles County Fire Code - 2019 edition; • The National Electric Code - 2019 edition. In cases where the provisions of the California Building Code, the City of Lynwood Municipal Code, or the plans or specifications in these plans may conflict, the more restrictive provisions shall govern. 21. Applicant/property owner must provide a copy of the permit card signed by all departments prior to scheduling a final inspection with the Planning Division. DEPARTMENT OF PUBLIC WORKS 22. The project shall be reviewed and approved by the City of. Lynwood's Public Works, Engineering Department. This class is not intended to be applied to projects which will result in any significant traffic, noise, air quality, or water quality affect; and WHEREAS, on June 8, 2021, the Planning Commission held a duly noticed and advertised public hearing to receive oral and written testimony related to Conditional Use Permit No. 2021-02; and WHEREAS, the Lynwood Planning Commission has sufficiently considered all testimony presented to them in order to make the following determination. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Lynwood as follows: SECTION 1. The Lynwood Planning Commission hereby finds and determines as follows: A. That the proposed conditional use is consistent with the General Plan; 1 The subject site is zoned M (Manufacturing) with a General Plan designation of Manufacturing as well. The zone permits truck container storage facilities with an approved Conditional Use Permit. The relationship between the subject specific plan and municipal code are consistent with the City of Lynwood General Plan. Goal LU-3 of the City's General has set a goal that industrial uses must enhance the. employment base of Lynwood cthrough the provision of adequate lands dedicated to industrial uses. The proposed use serves the intent of this goal as the project provides is creating a viable industrial use from land that is presently not serving the public or commerce in any manner. Permitting the proposed truck container storage facility would increase commerce activity and likely provide more employment opportunities for Lynwood residents for trucking services and the local delivery of products to market. As such,,based upon the above findings, the subject conditional use permit is consistent with the Lynwood General Plan. B. That the nature, condition, and development of adjacent uses, buildings, and structures have beenconsidered, and that the use will not adversely affect or be materially detrimental to these adjacent uses, buildings, or structures; Imposing the recommended conditions of approval for the proposed truck container storage facility would result in an approval and use that will not be materially detrimental to any adjacent uses, buildings, or structures in the immediate vicinity of the subject site. These safeguards will set in-place conditions of approval listed within CUP No. 2021-02 that will run with land. A visual survey was completed wherein it was determined that the proposed use will not adversely affect or be materially detrimental to any adjacent building or structure as the proposed truck container storage facility will be consistent with surrounding development. The proposed use is further safeguarded by the fact that the approved project will be required to complete on-going inspections by the Public Safety Division: and other state and federal agencies. These city, state and federal entities will ensure compliance with all their respective government codes. Furthermore, the proposed truck container storage facility will be reviewed by and require approval from the Los Angeles County Fire Department to ensure compliance with all current fire protection codes as well. The applicant will provide site security and be required to maintain the site free of graffiti as the CUP includes a condition that any graffiti • placed within the control of the operator be abated and painted to match the existing surroundings within 24 hours its placement. The operator will also be required to ensure that no loitering occurs, at any time, to preserve a positive image of the community. Similarly, the newly developed site meets all the development standards required of truck container storage facilities. as prescribed by the zoning code. . The proposed use will add safety to the surrounding area as lighting and security cameras will be installed throughout the site. 2 The recommended conditions of approval required by-the Planning Division, in conjunction with the safeguards described above, have been developed and are intended to mitigate any potential adverse impacts to the .adjacent uses and operational activities not adversely affects or be materially detrimental to adjacent uses, buildings, or structures. C. .That the site for theproposed conditional use is of adequate size and shape to accommodate the use and buildings proposed; The subject property is sufficient in. size and shape to accommodate the conditionally permitted-truck container storage facility. The subject project's site is approximately 4.6 acres in size and the proposed use will establish and maintain 139 truck trailer stalls. The proposed truck container storage facility design meets on-site circulation requirements and will improve ,egress andingress to the entire property in compliance with all City Engineer requirements. The proposed use will serve the applicant's business needs and a demand in the industry market well served by the proposed use and provide an important service to local and surrounding population. The subject site is well suited for the development of the proposed project due heavy manufacturing zone and designation. In contrast, the subject site is not appropriate for commercial or any near future residential uses. As such, the proposed use is compatible with the surrounding uses, supports the existing character of the area, and serves the-needs of those who live, work, and visit the local manufacturing zoned area and compatible uses. D. That the proposed conditional use complies with all applicable development standards of the zoning district; and The proposed conditional use application for a truck container storage facility is a straight forward use that operates. in compliance with the city's manufacturing development standards. The proposed conditional use requests have been analyzed and staff has determined that the proposed use meets all applicable development standards established by the City's zoning code. The project has also imposed conditions will ensure that operation will complement the existing adjacent uses subject to the review, revision and final approval by the Planning Commission. Based upon the supporting facts, a finding is confirmed in the positive that the proposed conditional use application requests comply with all applicable development standards associated with site's underlying zoning and requirements and development standards. 3 • E. That the proposed conditional use observes the spirit and intent of this zoning code; The project proposes to develop a truck container storage facility use or an overflow area in observance with the spirit and intent of the Zoning Code. The project site is presently a vacant and presently paved land. The proposed new truck container storage facility use will be consistent and in greater observance with zoning code regulations and the spirit and intent of the zoning code. Some of the more compliant aspects of the project include the creation and development of an more attractive streetscape that upgrades the site in compliance with the goals and objectives of the Lynwood Zoning Code. As such, the proposed conditional use will result in a project that observes the spirit and intent of the City's zoning code. SECTION 2. Based on the above recitals, the staff report accompanying this Resolution, and public comment, the Planning Commission hereby finds Conditional Use Permit No. 2021-02 is consistent with the goals, policies, and objectives of the land use element, land use plan, and housing element of the City's general plan and that the proposed truck container storage facility will not adversely affect surrounding properties and approves Conditional Use Permit No. 2021-02. SECTION 3. The Lynwood Planning Commission hereby approves Conditional Use Permit No. 2018-04 to allow a truck container storage facility at 2801 Lynwood Road (Assessor's Parcel Number 6169-010-003) subject to the following conditions: CONDITIONS OF APPROVAL COMMUNITY DEVELOPMENT DEPARTMENT - PLANNING DIVISION 1. The Project shall comply with all City of Lynwood Municipal Code, California Building Code, Los Angeles County Fire.Code and applicable State of California and Federal regulations and shall comply with requirements of City of Lynwood Departments. 2. Prior to issuance of a Certificate of Occupancy, the Applicant shall sign a Statement of Acceptance that states he/she has read, understands and agrees to all Conditions of this approval and that acceptance of these Conditions waives any challenge as to the validity of these Conditions. 3. Development of the Project shall substantially conform to the Project depicted on the approved Site Plan and Elevations on file stamped June 8, 2021, unless otherwise amended by these Conditions of Approval. Any subsequent modification to the Project site or proposed, future structures shall first be reported to the Community Development Department, Planning. Division for review. 4 4. Prior to scheduling a final inspection from the Building Division to begin operation, the Applicant/Property Owner shall obtain final signatures from other Departments indicating compliance with all Conditions. 5. If this CUP is not used within one (1) year from the date ofits-approval, the CUP shall become null and void and be of no effect in accordance with the LMC Section 25-13=6. 6. The City has determined that City, its employees, agents and officials should, to the fullest extent permitted by law, be fully protected from any loss, injury, damage, claim, lawsuit, expense, attorney fees, litigation expenses, court cost or any other cost arising out of or in any way related to the issuance of this Site Plan Review, or the activities conducted pursuant to this Site Plan Review. Accordingly, to the fullest extent permitted by law, Duke. Realty, LP/Polynt Composites USA, Inc. and its representative(s), or its successors shall defend, indemnify and hold harmless the City, its employees, agents and officials, from and against any liability, claims, suits, actions, arbitration proceedings, regulatory proceedings, losses, expenses or cost of any kind, whether actual, alleged or threatened, including, but not limited to, actual attorney fees, litigation expenses and court costs of any kind without restriction or limitation, incurred in relation to, as a consequence of arising out of or in any way attributable to, actually, allegedly or impliedly, in whole or in part, the issuance of the Site Plan Review, or the activities conducted pursuant to this Site Plan Review. Duke Realty, LP/Polynt Composites USA, Inc., and its representative(s), orits successors shall pay such obligations as they are incurred by City, its employees, agents and officials, and in the event of any claim or lawsuit, shall submit a deposit in such amount as the City reasonably determines.necessary to protect the City from exposure to fees, costs or liability with respect to such claim or lawsuit. 7. All appeals must be brought within ten (10) business days of the date of the final action by the Planning Commission. An appeal will be scheduled for public hearing before the Lynwood City Council: Persons filing the appeal must submit an application and pay a fee of$1,385.00. 8. The Property Owner shall maintain a proactive approach to eliminate graffiti from structures, fences/walls, and accessory buildings on a daily basis and shall remove all graffiti within 24 hours of placement of graffiti. 9. Prior to commencement of Project construction, the Applicant shall submit evidence to Building and Safety Division that all contractors working on the Project site have a valid City of Lynwood business license. 10. Prior to issuance of a Building Permit, the Applicant shall remit the following Development Impact Fees, and any other required Fees to the City of Lynwood: ` • Art in Public Places Fee; • Impact Fee; 5 •. Drainage Fee; • Plan Check Fee; and, 11. The Applicant/Property Owner shall provide proof of LA County Fire Department approval by stamped plans. 12. The truck container storage facility shall be operated in a manner which does not create any unacceptable noise levels in violation of the Noise Ordinance or in violation of any other provisions of the Lynwood Municipal Code, state, or federal law. Any nuisances associated with the truck container storage facility must be abated immediately upon notice by the City. 13. The applicant shall design all outdoor lighting including parking lot lighting with full shields, and cut off flat lenses to ensure that all light from any fixture will not direct light skyward, and will minimize light pollution —flood lights are strictly prohibited. 14. The applicant shall ensure that all irrigation for landscaping shall be on automatic timer. 15. Landscaping on-site must be kept and maintained in good condition at all times. All landscaped areas shall utilize drought-tolerant planting material. - 16. Anything which is not shown on application/plans, or which is not specifically approved, or which is not in compliance with this section, is not approved. Any application and/or plans which are defective as to, but not limited to, omissions, dimensions, scale, use, colors, materials, encroachments, easements, etc.,. shall render any entitlements granted by this section nulls and void. Construction (if any) must cease until all requirements of this section are brought into compliance. 17. All conditions of approval must be met prior to certificate of occupancy. 18. The project shall exclusively gain ingress and egress from Lynwood Road. Trucks and/or trucks with trailers shall only be permitted to arrive and leave the subject site from N. Alameda Street to the west. 19. All truck route activity shall not permitted to travel east of the subject site along the Lynwood Road. COMMUNITY DEVELOPMENT DEPARTMENT— BUILDING & SAFETY DIVISION 20. As applicable, all construction shall meet or exceed the minimum building standards that are referenced in the following: • The California Building Code - 2019 edition; • The California Plumbing Code - 2019 edition; • The California Mechanical Code - 2019 edition; 6 • The Los Angeles County Fire Code 2019 edition; • The National Electric Code - 2019 edition. In cases where the provisions of the California Building Code, the City of Lynwood Municipal Code, or the plans or specifications in these plans may conflict, the more restrictive provisions shall govern. 21. Applicant/property owner must provide a copy of the permit card signed by all departments prior to scheduling a final inspection with the Planning Division. DEPARTMENT OF PUBLIC WORKS 22. Background: The applicant, John Drake, has submitted an application for a mural at property located at 11619 Atlantic Avenue. The property is 21,903 sq. ft. in area and is composed of a liquor store, a budget store and a laundry mat business. The proposed mural of Mexican painter Frida Kahlo will be located on the Northwest side of the building off Cortland Street (Bubblymat Laundry). Discussion: Currently, the Lynwood Municipal Code Section 25-70-3 (c) requires the review of murals not used for advertising, by the Planning Commission. Review of a mural prior to installation is crucial. A definition of a mural could be "painting applied to and made integral with the surface of a wall or ceiling". Murals are considered artistic expressions not used for advertising purposes. Murals generally do not include numbers, letters, products or services-provided at the location. A mural does not provide facts. 1 It is difficult to limit the size or number of murals as they are artistic expressions. A mural generally encompasses an entire wall or large portion of the wall as opposed to signs that are installed in a limited area. An artist expression may include more than one mural on more than one surface. The proposed Mural is by artist muralist Erick (Sparc) Guadarrama based in the City of Long Beach, dimensions are 17'-3" in height by 21' long for a total 362.25 sq. ft. and will have a pink/purple background, with flowers and a portrait of Mexican painter Frida Kahlo. CONDITIONS OF APPROVAL COMMUNITY DEVELOPMENT DEPARTMENT - PLANNING DIVISION 1. The Mural shall comply with all City of Lynwood Municipal Code, California Building Code, Los Angeles County Fire Code and applicable State of California and Federal regulations and shall comply with requirements of City of Lynwood Departments. 2. Prior to issuance of a Planning Division Permit, the Applicant shall sign a Statement of Acceptance that states he/she has read, understands and agrees to all Conditions of this approval and that acceptance of these Conditions waives any challenge as to the validity of these Conditions. 3. Development of the Mural shall substantially conform to the Project depicted on the approved plans on file stamped June 8, 2021, unless otherwise amended by these Conditions of Approval. Any subsequent modification of the Mural or structures thereon shall first be reported to the Community Development Department, Planning Division for review. 4. Approval of this Mural shall be valid for one (1) year from the date of the approval and shall become null and void and of no effect whatsoever after that • date. 5. .The City has determined that City, its employees, agents and officials should, to the fullest extent permitted by law, be fully protected from any loss, injury, damage, claim, lawsuit, expense, attorney fees, litigation expenses, court cost or any other cost arising out of or in any way related to the issuance of this Mural approval, or the activities conducted pursuant to this Mural approval. Accordingly, to the fullest, extent permitted by law, John Drake, and his representative(s), or his successors shall defend, indemnify and hold harmless the City, its employees, agents and officials, from and against any liability, claims, suits, actions, arbitration proceedings, regulatory proceedings, losses, expenses or cost of any kind, whether actual, alleged or threatened, including, but not limited to, actual attorney fees, litigation expenses and court costs of any 2 • kind without restriction or limitation, incurred in relation to, as a consequence of arising out of or in any way attributable to, actually, allegedly or impliedly, in whole or in part, the issuance of the Mural approval, or the activities conducted • pursuant to this Mural approval. John Drake, and his representative(s), or his successors shall pay such obligations as they are incurred by City, its employees, agents and officials, and in the event of any claim or lawsuit, shall • submit a deposit in such amount as the City reasonably determines necessary to protect the City from exposure to fees, costs or liability with respect to such claim or lawsuit. 6. All appeals must be brought within ten (10) business days of the date of the final . action by the Planning Commission. An appeal will be scheduled for ,public hearing before the Lynwood City Council. 'Persons filing the appeal must submit an application and pay a fee of$1,385.00. 7. The Property Owner shall maintain a proactive approach to eliminate graffiti from mural, structures, fences/walls, and accessory buildings on a daily basis and shall remove all graffiti within 24 hours of placement of graffiti. 8. Anything which is not shown on application/plans, or which is not specifically approved, or which is not in compliance with this section, is not approved. Any application and/or plans which are defective as to, but not limited to, omissions, dimensions, scale, use, colors, materials, encroachments, easements, etc.., shall render any entitlements granted by this section nulls and void. Construction (if • any) must cease untilall requirements of this section are complied with. Development entitlements may be withheld until Code violations are abated. 9. All conditions of approval must be met prior to Planning Division Final inspection. 10. Mural.should not exceed the height of the structure. 11. Mural shouldnot extend more than six inches from the building façade. 12. Mural should not include electrical Or moving components. 13. Mural should not cover windows or doors. . 14. Mural should not promote the sale or use of firearms, or tobacco products. 15. Mural should not promote sexually oriented materials. 16. Mural should not promote any product, service or activity illegal under federal, state, or local law. . 17. His goal is simple: To enrich my community and remind them of our diverse culture through vibrant colors that uplift and nourish our souls. Erick, more commonly known as Sparc has worked in major cities including, but not limited to: Long Beach, Downtown Los Angeles, and San Diego. His work is featured in beautifully designed spaces like restaurants, cafes, and hotels, in addition to blessing the boulevards with his colorful, unique, heritage inspiring and life like artwork. He has been featured in the Long Beach Gazette and Long Beach Post. Erick also takes time to give back. He organized an event to encourage more women to paint and get paid.
