HomeMy Public PortalAbout2021.053 - (06-01-21) RESOLUTION NO. 2021.053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING AND ADOPTING THE 2020 WATER SHORTAGE CONTINGENCY PLAN WHEREAS, in 1983, the State of California Legislature (Legislature) enacted the Urban Water Management Planning Act (Act); and WHEREAS, the law required an urban water supplier (Supplier), providing water for municipal purposes to more than 3,000 customers or serving more than 3,000 acre- feet annually, to adopt an Urban Water Management Plan (UWMP) every five years demonstrating water supply reliability in normal, single dry, and multiple dry water years; and WHEREAS, the UWMP must include an effective Water Shortage Contingency Plan (WSCP) that specifies opportunities to reduce demand and augment supplies under numerous, and even unpredictable, water shortage conditions; and WHEREAS, in 2018, the Legislature modified the Urban Water Management Plan to require a WSCP with specific elements; and WHEREAS, the WSCP is a document that provides a Supplier with an action plan for drought or catastrophic water supply shortage; and WHEREAS, the City's WSCP has been prepared to include elements specified under Water Code Section 10632; and WHEREAS, at least 60 days prior to the public hearing on the 2020 UWMP and 2020 WSCP, the City provided notifications to city or county within which the City provides waters supplies that the City will be reviewing the UWMP and WSCP and considering amendments or changes to the plans; and WHEREAS, on December 7, 2020, the City sent out notifications to cities/counties and other stakeholders on the City's preparation of the 2020 UWMP and WSCP; and WHEREAS, on March 30, 2021, the City sent out notices of the time and place of the public hearing to the cities and county within which the City provides water and the availability of the draft 2020 UWMP and WSCP; and WHEREAS, on May 6, 2021 and May 13, 2021 respectively the City published notice in the Lynwood Press that on June 1, 2021 at 6:00 p.m. or soon thereafter a public hearing regarding the draft 2020 UWMP and WSCP would be held in the City of Lynwood Council Chambers as well as via zoom due to the Covid-19 pandemic at which the public comment on the plan would be received, as required by the California Water Code (CWC) Section 10642; and WHEREAS, pursuant to Water Code Section 1062 to encourage active involvement of diverse social, cultural and economic elements of the population within the service area, on May 17, 2021 at 6:00 pm the City hosted a community and stakeholders meeting via zoom to discuss the draft 2020 UWMP and WSCP; and WHEREAS, on June 1, 2021 at 6:00 p.m. a public hearing was conducted in the Council Chambers and via teleconferencing and video conferencing at which the public was provided the opportunity to comment on the 2020 UWMP and WSCP; and WHEREAS, the WSCP was prepared in accordance with the UWMP laws as modified by the Legislature. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS: Section 1. That the City Council hereby adopts the 2020 Water Shortage Contingency Plan for the City of Lynwood attached hereto as Exhibit A. Section 2. That the City Council authorizes the City Manager or his designee to submit the Water Shortage Contingency Plan to the California Department of Water Resources. Section 3. That this Resolution shall take effect immediately upon its adoption. Section 4. That the City Clerk shall certify to the adoption of this Resolution.
