Savannah Beach, Georgia
September 16, 1970
The regular meeting of City Council was called to order at 3:00
P.M. today with Mayor Michael J. Counihan> presiding and the follow-
ing councilmen in attendance: John H. Daniels, Edward Jung, Robert
F. Cary, James M. Stettler, and George Schwarz. Councilman Edward
W. Towns was not present at the meeting due to his absence from
the city on business. City Attorney Bart E. Shea was also present
at the meeting.
Visitors at the meeting were: Mr. Jim Golden, Chatham County
Recreational Director; Mrs. Lucy Patterson, Savannah Beach Director
of Recreation and Mr. and Mrs. Hubert K. Ellzey.
Mr. Jim Golden, Recreational Director for Chatham County gave a
brief summary of the Chatham County Recreational Program and the
various ways they had been able to work with and help the Savannah
Beach program. He stated that the need for good, well balanced
programs was never greater than it is today and that recreational
programs should include everybody from the very young right on up
to senior citizens. He told Council that Savannah Beach should
strive for a total program -not just athletics.
Mrs. Lucy Patterson, Savannah Beach Recreational Director, gave an
outline of the various summer activities at the beach. She stated
that she had an enrollment of 300 participants in the various pro-
grams which was higher percentage -wise than most of the other areas
in the county. She also requested 19.'.1tter be written by the Mayor
to the Georgia Recreational Commission requesting them to send one
of their representatives here to make a surrey of our recreational
program and give us their advice in what could be done to improve
it. Mayor Counihan said that this would be done.
Mr. Hubert K. Ellzey appeared before Council to request a refund for
a general building contractor's license which he purchased recently,
and to protest the replacement of an existing sewer line across his
property 'which work was now in the process of being done by John
Mock Co.
Mr. Ellzey's request for a refund on the contractor's license was
denied by Council and the Clerk was instructed to advise him
accordingly. In regard to Mr. Ellzey's protest of the sewer work,
he was asked if he would accept the responsibility for the charges
to be incurred for connecting to the new line in the event the City
re- routed the line around his property. He stated that he would.
It was brought out that if this was done, there would be a consider-
able increase in cost to the city for this particular job.
Mayor Counihan informed Council that the parking meter revenue was
up 50% over last year.

The Minutes of the meeting of August 19th were approved as written.
Bills for the various departments were approved for payment.
Councilman Daniels made a motion that the supervision, operation
and maintenance of our parking meters, including revenue, expenses,
salaries etc., be placed under general governt instead of Police
Department, as it is presently. The motion was duly seconded and
unanimously carried.
Councilman Daniels moved that the Georgia Southern Area Planning
and Development Commission be requested to undertake two special
studies for the City of Savannah Beach as follows:
(1) A 5 -year capital improvements program
(2) Downtown and Campsite revitalization and renovation
program
and that a letter be directed to Mr. William T. Greer, Director of
the Development Commission, requesting that his organization assist
us with this study and their recommendations for these two- ` programs.
This motion was seconded and unanimously carried.
Councilman Daniels recommended that the city attorney write Mr.
Julius Kaminsky again in regard to cleaning up his property, which
as of now has not been done. Mr. Shea stated that he would handle this.
Councilman _Jung annbuheed_ that. ±th:e :..public hearing for our Zoning
Ordinance would be held at 3:00 P.M. on Wednesday, October 7th.
He then moved that the legal notice of this hearing be published
in the Savannah Evening Press at least fifteen days prior to the
date of the hearing. The motion was seconded and unanimously carried,
and the Clerk was instructed to publish notice of the hearing in
compliance with the regulations.
Councilman Jung informed Council that we have received a request
from the Trust Department of Savannah Bank and Trust Company to
allow them to create a Trust Account for the city's $150,000 Street
Improvement Bond Issue, dated November 1, 1960, based on the present
fee schedule of $2.50 per 1,000 coupons paid; $1.00 per 1,000 bonds
paid, without a minimum charge of any kind. He stated,that he had
been informed'by the bank that this would enable them to computerize
the handling of these transactions and make for a more efficient
handling. Councilman Jung recommended this action on °the part of
the City and moved the adoption of the following Resolution:

Councilman Cary moved that contractors erecting the modular
type pre -fah houses be subject to on - the -site inspections of
electrical wiring and plumbing; as well as observe all the set-
backs and other requirements of our building code. The motion
was seconded and unanimously carried.
Mayor Counihan informed council that some residents outside the
city limits have been transporting their trash and garbage to the
site of our present sanitary landfill and dumping it on the ground.
He stated that he had instructed Mr. Reed to erect a gate to pre-
vent this in the future.
A motion was made by Councilman Cary that permission to install
certain wave - measuring electronics equipment on top of the
Museum be granted. It was seconded and unanimously carried.
With reference to a letter from the Department of Interior regard-
ing a utilization plan for the Campsite, Council instructed the
clerk to answer this letter and outline our plans for obtaining
recommendations from the Georgia Southern Area Planning and
Development Commission for the best utilization of this property
for public recfeational use.
City Attorney Shea advised council that an acceptance had been
received from Dr. Oliver to our terms to purchase his portion of
the property on which we propose to build the new sewage treatment
plant. On that portion owned by the McDades, Attorney Shea stated
that they were askkng $500 more that our offer, but that he felt
$200 more would be a fair offer. A motion was then made by Council-
man Daniels that the city attorney be instructed to prepare the
sales contracts on this basis and submit them to the two land owners.
It was seconded and unanimously carried.
Councilman Cary asked what, if anything, was going to be done
about our boat ramp which the county was going to help repair.
Councilman Daniels stated that he had been advised by Mr. Lane
that the county equipment had to be brought back to Savannah due
to the flooded condition in the southern section of the city,
but that it would be returned to the beach as soon as the Savannah
emergency was completed.
With reference to a resolution requesting flood insurance
eligibility recently passed by the Chatham County Commission
and the necessary steps to secute -- some- fdr-_municipalities in
Chatham County as suggested by the Metropolitan Planning Commission,
the following proposed resolution was read by City Attorney Shea:

After a discussion on the resolution, Attorney Shea recommended
its passage. Councilman Daniels then moved the adoption of the
resolution. It was seconded and unanimously carried.
City Attorney Shea informed Council that the 1970 Revision of the
Fire Prevention Code had now been published, superseding the 1965
Edition with 1966 amendments which the City had adopted. He
explained that since it would take two readings to enact the Ordinance
to amend Section 7 of our Code of Ordinances to bring this Fire
Prevention Code up to date, we should have the first reading on the
Ordinance to amend at this meeting. A motion was, therefore, made
by Councilman Daniels that this Ordinance to amend Section 7 -1 of
our Code of Ordinances be adopted and placed on first reading at
this meeting. The motion was duly seconded and unanimously carried.
There being no further business, the meeting was adjourned to the
next regular or special called meeting.

A R E S O L U T I O N
WHEREAS, in connection with our $150,000 Street Improvement
Bond Issue, dated November 1, 1960, the Savannah Bank and Trust
Company has requested the City of Savannah Beach to allow them
to create a Trust Account for these bonds based on the present
fee schedule of $2.50 per 1,000 coupons paid; $1.00 per 1,000
bonds paid, without a minimum charge of any kind; and
WHEREAS, the Savannah Bank and Trust Company feels that by
computerizing this operation it will make their work easier as
well as enable the City of Savannah Beach to get an annual state-
ment of transactions; and
WHEREAS, Savannah Bank and Trust Company would debit our
checking account for any interest and principal coming due semi-
annually just before May 1st and November 1st; and
WHEREAS, by naming the Savannah Bank and Trust Company
Fiscal Agent for this Bond Issue would cause no additional ex-
pense to be borne by the City of Savannah Beach; and
WHEREAS, Savannah Bank and Trust Company can be relieved as
Fiscal Agent at any time upon written notice;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen
of Savannah Beach, Tybee Island, in council assembled, that the
Savannah Bank and Trust Company be, and the same is hereby desig-
nated as Fiscal Agent of the City of Savannah Beach for the Bond
Issue herein referred to.
BE IT FURTHER RESOLVED that the Clerk of Council and Ex-
Officio Treasurer of the City of Savannah Beach be and he is
hereby authorized and directed to so notify Savannah Bank and
Trust Company of their appointment as Fiscal Agent for this
Bond Issue on the terms as set forth herein.

R E S O L U T I O N
BE IT RESOLVED by the Mayor and Council of the City
of Savannah Beach, Tybee Island and Council duly assembled on the
16th day of September, 1970 and it is hereby resolved as follows:
WHEREAS, the Congress of the United States has approved
flood control insurance under Title 24, Sub - chapter B - NATIONAL
FLOOD INSURANCE PROGRAM, of the Housing and Urban Development Act
of 1969, Public Law 91 -152, 83 stat. 396 Dec. 24, 1969, 42 U.S.C.
4056; and
WHEREAS, the City of Savanrah Beach, Tybee Island wishes
to avail itself and the members of the community within its cor-
porate boundaries of the provisions of the National Flood Insurance
Program under said act.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council
of the City of Savannah Beach, Tybee Island as follows:
1. That the City of Savannah Beach, Tybee Island recognizes
and will duly evaluate flood hazards in all official actions relating
to land use in the flood plain areas within the municipality which
might be special flood hazards or where special flood hazards might
exist; and the City of Savannah Beach shall enact by December 31,
1971, and shall maintain in force for areas which might be special
flood hazards, adequate land use and control measures having
effective enforcement provisions consistent with the criteria
set forth in Subpart B of Section 1910 of the regulations and
criteria set forth within the provisions of the Housing and
Urban Development Act of 1969; and
2. The City of Savannah Beach, Tybee Island, Georgia
shall also take such other official action as may be reasonably
necessary from time to time to carry out the objectives of such
flood control program; and
3. The Building Inspector for the City of Savannah
Beach, Tybee Island is hereby designated as the official responsible
to implement any regulation and criteria which might be adopted
by the City of Savannah Beach, Tybee Island.
ADOPTED in Open Council Meeting this 16th day of
September, 1970.
