A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, FLORIDA, ESTABLISHING DEADLINES FOR THE
SUBMITTAL OF APPLICATIONS FOR DEVELOPMENT APPROVAL;
PROVIDING FOR AN EXEMPTION TO SAID DEADLINES; PROVIDING
FOR A WAIVER OF SAID DEADLINES; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, the Town of Gulf Stream Zoning Code requires
applications be submitted for various land development proposals
and provides for the processing, review and final disposition of
such applications; and
WHEREAS, the Town staff and other Town review authorities
are required to perform certain duties in processing applications
for development approval; and
WHEREAS, the Town Commission desires that application
deadlines be established to provide for adequate processing time.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA THAT:
Section 1. Application Deadlines: The following deadlines
are hereby established for the processing of all applications for
development approval which require final action by the Town
Commission, including those for which the Town Commission serves
as the Board of Adjustment or Local Planning Agency:
Applications shall be submitted to the Town Planning
and Building Department no later than the fifteenth
(15th) day of each month. However, at least fourteen
(14) days prior to submission of an application, the
applicant shall have arranged for and attended a pre -
application conference with Town staff. Once
submitted, all applications shall be processed as
prescribed in the Zoning Code.
Section 2. Exemption. Town - initiated applications for
development approval are hereby exempt from the provisions of
this resolution.
Section 3. Waiver of Deadlines. The Town Commission may
waive or alter the deadlines contained herein upon a finding that
such a waiver or alteration is in the public interest of
residents of Gulf Stream or that the deadlines pose an undue
hardship on the applicant. Motions to approve such waivers or
alterations shall require three (3) affirmative votes for
passage. In no case, however, shall the waiving or alteration of
application deadlines conflict with any application processing
time specifications contained in the Town Zoning Code.
Section 4. Effective Date: This resolution shall apply to
all applications for development approval submitted after
March 1, 1995.
