OF RICHMOND, INDIANA.
WHEREAS, P.L. 44-1984 allows municipalities to establish a municipal Cumulative
Capital Development Fund; and
WHEREAS, the City of Richmond, Indiana finds that such a fund is necessary and
prudent for the financial well being of the municipality; and
WHEREAS, Ordinance No. 72-1984 originally created a Cumulative Capital
Development Fund for the City of Richmond; and
WHEREAS, the City of Richmond, Indiana desires to continue said Cumulative
Capital Development Fund;
NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana;
SECTION 1. That there is hereby established a Cumulative Capital Development
Fund.
SECTION 2. That an ad valorem property tax levy will be imposed and the
revenues from the levy will be retained in the Cumulative Capital
Development Fund.
SECTION 3. That the maximum rate of levy under Section 2 will not exceed;
a. .15 per $100 Assessed Valuation for 1988 and thereafter.
SECTION 4. That the funds accumulated in the Cumulative Capital Development
Fund will be used for:
I.C. 8-16-3 The construction, maintenance and repair of bridges, approaches and
grade sections;
I.C. 36-8-14 The purchase, construction, renovationor addition to buildings used
by the fire department and for the purchase or rental with option to
purchase fire -fighting equipment and the purchase of police radio
equipment;
I.C. 8-22-3-25 The acquisition of real property and the construction, enlarging,
improving, remodeling, repairing or equipping of buildings
structures, runways or other facilities for use in connection with the
airport operated by the City of Richmond;
I.C. 36-9-48 The acquisition of buses and the planning, establishment and
maintenance of routes and schelules;
I.C. 36-9-16-2 The purchase, construction, equipping and maintenance of buildings
for municipal purposes, including the acquisition of land and
improvements thereon, the demolition of such improvements and
preparation of such land and the acquisition, improvement or
construction of land or rights -of -way to be used as a public way or
other means of ingress or egress to land acquired for the construction
of a municipal building;
I.C. 36-9-16-3 and
I.C. 36-9-16-5 The acquisition of land or rights -of -way to be used for public ways or
sidewalks and the construction and maintenance of public ways or
sidewalks;
I.C. 36-9-16-3 The purchase or lease of land, buildings or heights -of -way for the use
of any utility acquired or operated by the City of Richmond. The
purchase or lease of motor vehicles for the use of the police or fire
department, including ambulances and firefighting vehicles wigh
the necessary equipment, laders and hoses. The purchase or lease of
equipment needed by the City of Richmond for any public
transportation use;
I.C. 36-10-3-21 The purchase or acquisition of land, with or without buildings, for
park or recreation purposes and the building, remodeling and repair
of park and recreation facilities;
I,C. 36-8-17 The construction, repair or improvement of streets, alleys, sidewalks,
curbs and gutters.
SECTION 5. Notwithstanding Section 4, funds accumulated in the Cumulative
Capital Development Fund may be spent for purposes other than the
purposes stated in Section 4, if the purpose is to protect the public
health, welfare or safety in an emergency situation which demands
immediate action. Money may be spent under the authority of this
section only after the Mayor issues a declaration that the public
health, welfare or safety is in immediate danger that requires the
expenditure of money in the fund.
SECTION 6. This fund takes effect upon approval of the State Board of Tax
Commissioners.

COUNCIL OF THE CITY OF RICHMOND. INDIANA
The Common Council of the City of Richmond, Indiana, met in regular session in the Council Chambers in
the Municipal Building of said City on June 1, 1987, at the hour of 7:30 P.M.
Councilmember Brookbank presided with the following members present:
Councilmembers: Elstro, Williams, Hankinson,Whitesell, Parker, Hutton, Morris and Theobald.
Absent: None
The following business was had to -wit:

The Clerk presented Proof of Publication of Notice to Taxpayers printed in the Richmond Palladium
Item, a newspaper of general circulation in the City of Richmond, Indiana, on the dates of May 8th and
May 15th, 1987. Said notice stated that a public hearing would be held on thelst day of June, 1987,
by the Common Council to consider a Cumulative Capital Development Fund as provided for in Ordinance
No. 21-1987, within the City of Richmond, Indiana. The Proof of Publication was examined and found to
be in order. Councilmember Whitesell moved the Proof of Publication be received and filed, seconded by
Councilmember Hutton and on unanimous voice vote the motion was carried.
The Clerk read on second reading Ordinance No. 21-1987.
President Brookbank announced Ordinance No. 21-1987 was on public hearing.
After hearing all persons present, Ordinance No. 21-1987 was placed on final passage or rejection and
on a call of the roll the following was recorded:
Ayes: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, Morris, Theobald and Brookbank
Nays: None
The vote being 9 to 0 in favor of the passage of Ordinance No. 21-1987.

will be fifteen cents C$.15) for 1987 taxes payable in 1988, fifteen cents
($.15) for 1988 taxes payable in 1989, and fifteen cents ($.15) for 1989
taxes payable in 1990.
Fifty (50) or more taxpayers in the taxing unit who will be affected
by the tax levy, may file a petition with the County Auditor of Wayne
County, not later than thirty (30) days after the publication of this no-
tice, setting forth their objections to the proposed levy. Upon filing
of the petition, the County Auditor shall immediately certify the same to
the State Board of Tax Commissioners, which Board will fix a date and con-
duct a public hearing on the proposed levy before issuing its approval or
disapproval thereof.

Before final action on your proposed plan, it will be necessary
for you to submit proofs of publication of the second notice. Also,

Said Cumulative Capital Developmend Fund shall be used for any or all of the following purposes
permitted by law:[

I.C. 36-8-14 The purchase, construction, renovationor addition to buildings used by the fire
department and for the purchase or rental with option to purchase fire-
fighting equipment and the purchase of police radio equipment;[

said tax to be levied in 1988, payable in 1989, and payable annually thereafter at the following
rates per One Hundred Dollars ($100.00) on all taxable personal and real property in
Richmond, Indiana:[

Taxpayers are invited to be present and will have a right to be heard thereon and that thereafter
proof of publication of notice of such public hearing and a certified copy of Ordinance No. 21-
1987, if passed, will be submitted to the State Board of Tax Commissioners of the State of
