HomeMy Public PortalAbout022-1987- AMENDING ARTICLES 13 34 AND 35 OF CHAP 154 KNOWN AS ZONING CODEGENERAL ORDINANCE NO. 22-1987 AN ORDINANCE AMENDING ARTICLES 13, 34 and 35 OF CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, it is the intent of this Ordinance to amend Articles 13, 34 and 35 of Chapter 154 of the Municipal Code; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 28th day of April , 1987, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the City Plan Commission was 9 to 0 in favor of/tMxzPJDzxUA=x= recommending the passage of Ordinance No. 22 , 1987. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That Article 13.109 shall be added as follows: 13.109 Vehicle _Impound Storage Area: Means a storage area for vehicles that have been removed from the scene of an accident or any vehicle that has been removed from public or private property because such vehicle is wrecked, inoperable or abandoned or any vehicle that has been impounded by'action of a law enforcement officer. A vehicle impound storage area shall provide facilities for the parking or storing of vehicles only and shall not include any activities related to the salvage or disassembling of vehicles. A vehicle impound storage area shall not include those areas accessory to a vehicle repair establishment that provide parking facilities for vehicles to be repaired or serviced at said establishment. SECTION 2. That Article 34.016 shall be added as a Special Use as follows: 34.016 Vehicle Impound Storage Area 34.0161 General Requirements: A vehicle impound storage area shall be required to be located not less than three hundred (300) feet from any A or R District and not less than one hundred (100) feet from any other District. A vehicle impound storage shall be required to be enclosed by a well maintained solid fence or wall not less than eight (8) feet high. A vehicle impound storage area shall be required to be surfaced with a material to provide a durable, dustless surface and to prevent the tracking of dirt and mud onto adjacent streets and highways. A surface water drainage system shall be required to be installed inside the fence and around the perimeter of the vehicle impound storage area. The drainage system shall be designed to intercept contaminated surface water and oil and to prevent its discharge onto adjoining property. SECTION 3. That Article 35.004(60) shall be added as a permitted use as follows: 35.004(60) Vehicle impound storage area. SECTION 4 That Article 35.032 shall be amended as follows: 35.032 Junk Yard and Vehicle Impound storage Area - Enclosure: All junk yards and vehicle impound storage areas shall be enclosed by a well maintained solid fence or wall which will effectively conceal such uses from adjoining property, streets and highways, but, in any case, not less than eight (8) feet high. SECTION 5. That Articles 35.033 and 35.034 shall be added as a required conditions as follows 35.033 Vehicle ImpoundStorage Area - Surfacing: All vehicle impound storage areas shall be surfaced with a material to provide a durable, dustless surface and to prevent the tracking of dirt and mud onto adjacent streets and highways. 35.034 Vehicle Impound Storage Area - Surface Water Drainage: A surface water drainage system shall be required to be installed inside the fence and around the perimeter of every vehicle impound storage area. The drainge system shall be designed to intercept contaminated surface water and oil and to prevent its discharge onto adjoining property. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. ATTEST: City C r CITY PLAN COMMISSION RICHMOND, INDIANA May 1, 1987 Mrs. Jane Brookbank, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 22-1987 Plan Commission Case PC-87-2 Dear Mrs. Brookbank, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted public hearings on Tuesday, March 24, 1987 and Tuesday, April 28, 1987 on its own petition, requesting to amend Articles 13, 34 and 35 of the Zoning Ordinance by adding the new use, Vehicle Impound Storage Area. The Zoning Ordinance does not specifically list a Vehicle Im- pound Storage Area as a use in any Zoning District. In 1982, an administrative decision was made by the Plan Director deter- mining that a Vehicle Impound Storage Area could be located in a C-4 District as a permitted use because of similar character- istics to other C-4 uses. The Plan Commission has determined that there are certain elements of a Vehicle Impound Storage Area that have the potential to adversely effect adjoining properties. For this reason, the Commission decided to initiate a study of the issue and deal with the question through an amendment to the Zoning Ordinance. Ordinance No. 22-1987 has been reviewed by the. Board of Public Works and Safety and the Traffic Divi- sion of the Police Department. Ordinance No. 22-1587, as written, adds to the Zoning Ordinance a definition of Vehicle Impound Storage Area in Article 13, and classifies such use as a Special Use in the M-1 District in Article 34 and classifies such use as a permitted use in the M-2 District in Article 35. The proposed Ordinance also sets forth required conditions for the establishment of a Vehicle Impound Storage Area. The Plan Commission voted nine (9) to zero (0) to recommend the passage of Ordinance No. 22-1987.
