A RESOLUTION IN SUPPORT OF THE APPLICATION OF
SYNSTATION, L.P. TO THE TEXAS COMMISSION ON
ENVIRONMENTAL QUALITY FOR A MUNICIPAL SETTING
DESIGNATION FOR PROPERTY AT THE SOUTHEAST
CORNER OF NORWOOD DRIVE AND TRINITY BOULEVARD,
FORT WORTH, TEXAS
WHEREAS, Chapter 361, Subchapter W, of the Texas Solid Waste Disposal Act
authorizes the Texas Commission on Environmental Quality (TCEQ) to
certify Municipal Setting Designations for properties upon receipt and
approval of a property submitted application to TCEQ; and
WHEREAS, as a part of the application to TCEQ for a Municipal Setting Designation,
the applicant is required to provide documentation that the application is
supported by: ( 1) the city council of the municipality in which the site is
located, (2) the city council of each municipality with a boundary located
not more than one-half mile from the Site, (3) the city council of each
municipality that owns or operates a groundwater supply well located not
more than five miles from the Site, and (4) the governing body of each
retail public utility as defined by Section 13.002, Texas Water Code, that
owns or operates a groundwater supply well located not more than five
miles from the Site; and
WHEREAS, Synstation, L.P. (Applicant) filed an application with the City of Fort
Worth, Texas, for the issuance of a Municipal Setting Designation
ordinance for the property located at the southeast comer of Norwood
Drive and Trinity Blvd., Fort Worth, Texas, more fully described in
Exhibit "A" (the "MSD Site"); and
WHEREAS, the City of Fort Worth approved Applicant's application and adopted a
Municipal Setting Designation ordinance for the MSD Site on November
14,2006;and
WHEREAS, the City of Richland Hills owns and operates one or more public supply
wells located within five miles of the MSD Site; and
WHEREAS, the Applicant has appeared before the City Council of the City of Richland
Hills and represented and presented expert engineering reports indicating
that it is extremely unlikely that contamination from the MSD site would
negatively impact the public water supply or public supply wells of
Richland Hills, and poses no appreciable threat to such public water
supply or public supply wells; and
WHEREAS, following the issuance of a supporting resolution by each municipality and
retail public utility for which approval is required, Applicant will submit
to TCEQ an application for certification of a Municipal Setting
Designation for the Site pursuant to Texas Health and Safety Code,
Chapter 361, Subchapter W.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF
THE CITY OF RICHLAND HILLS, TEXAS
The City of Richland Hills supports Applicant's application to the TCEQ for certification
of a Municipal Setting Designation for the Site.

and being a portion of that certain tract of land described by deed to Bell Helicopter
Textron, Inc. as recorded as Parcel H in Yolume -7231, Page 1786, Deed Records, Tarrant
· Co~ty, Texas, and -being more •particularly described.by metes and bounds as follows:
BEGINNING at a 4 inch wood post found at the southwest comer of said Parcel H, said
post also being the northwest comer of that certain tract ofland described by deed to TXI
Operations, Inc. as recorded in volume 13191, Page 252, Deed Records, Tarrant County,
Texas and being in the east right-of-way line of Norwood Drive (an 80 foot public right-
of-way) and being in the approximate south line of said Cotrail Survey, and being in the
approximate north line of the W .P. Burns SUIVey, A~stract Number 121;
THENCE W 00 degrees 07 minutes 58 ·seconds W, 725.95 feet (previously re.corded as· N
00 degrees 23 minutes 17 seconds E, 726.27 feet) along the west · line of said.Parcel Hand
said east right-of-way line of Norwood Drive to a 5/8 inch iron rod with cap stamped
"Carter & Burgess" set at the northwest comer of said Parcel H, said iron rod also being
in the south right-of-way line of Trinity Boulevard (a 120 foot public right-of-way);
THENCE N 88 degrees 39 minutes 32 seconds E, 823.30 feet (previously recorded as N
89 degrees 11 minutes E) along the north line · of said Parcel H and said south right-of-
way line of Trinity Boulevard to a ·5/8" iron rod with cap stamped "Carter & Burgess"
set;
. THENCE S 01 degrees 20 minutes 17 seconds E, 532.28 feet, departing said north line of
Parcel H and said south right-of-way line of Trinity Boulevard to a 5/8 inch rod with cap
