HomeMy Public PortalAbout038-1987- ZONING - 317 SOUTH 4TH STGENERAL ORDINANCE NO. 38-1987 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 317 SOUTH 4TH STREET FROM R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT, TO R--3 SU ONE -TO -EIGHT FAMILY RESIDENCE SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY TO PERMIT THE PLACEMENT OF A CANDLE SHOP AND TAX SERVICE OFFICE. WHEREAS, the zoning map which is part of Ordinance No. 2325-1968 designates and describes as R-3 One -to -Eight Family Residence District certain property located at 317 South 4th Street; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-3 One -to -Eight Family Residence District to R-3 SU One -to -Eight Residence Special Use District and to authorize the Special Use of said property to permit the placement of a a Candle Shop and Tax Service Office. WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the AF8 k day of 1987, at which time remonstrances weife he d from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was L to O in favor of recommending the passage of Ordinance No. 38-1987. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-3 SU One -to -Eight Family Residence Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. That as provided in Articles 21.01 and 48 of Chapter 154 of the Municipal Code, the following described use of the above described real estate is allowed as a Special Use to permit the placement of a Candle Shop and Tax Service Office. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. CITY PLAN COMMISSION RICHMOND, INDIANA July 30, 1987 Mrs. Jane Brookbank, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 38-1987 Plan Commission Case PC-87-6 Dear Mrs. Brookbank, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, July 28, 1987, on the petition of Gary and Lana Mathews, owners, requesting to rezone property located at 317 South 4th Street, from R-3 One -to -Eight Family Residence District to R-3 One -to -Eight Family Residence Special Use District, and also requesting Special Use Authorization for a Candle and Craft Shop and Tax Service establishment. Fifteen (15) notices of public hearing were sent to the surrounding property owners, with three (3) returned in favor of the request. During the public hearing, no one spoke in opposition to the request. The Plan Commission determined the petition fulfills the requirements of Articles 22 and 48 of the zoning Ordinance and voted seven (7) to zero (0) to recommend that Ordinance No. 38-1987 be adopted with the following amendments: The existing Section 3 shall be renumbered to Section 4 and a new Section 3 shall be added to read as follows: SECTION 3. As a condition of being granted the Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a. The conversion of the dwelling unit to a commercial use shall comply with the Indiana Building Code. b. The Candle and Craft Shop and Tax Service Office shall be deemed to be one (1) busi- ness enterprise.
