WHEREAS; Norfolk and Western Railway Company operates certain railroad lines adjacent to the Glen Miller Park area; and WHEREAS; Norfolk and Western Railway Company desires to make certain drainage improvements which will necessitate some additional land area; and WHEREAS; I.C. 36-10-4-18 provides that the Common Council may authorize the Park Board to sell certain lands; NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana that: The City of Richmond Parks and Recreation Board are hereby authorized to sell certain land described in the proposed warranty deed, attached hereto as "Exhibit A", to Norfolk and Western Railway Company on such terms as the Parks and Recreation Board deem appropriate. Mayor ATTESTy1/�i/l tr �i1� City Clerl 13 W A R R A N T Y D E E D THIS INDENTURE WITNESSETH that the CITY OF RICHMOND PARKS AND RECREATION BOARD ("GRANTOR") of Wayne County, in the State of Indiana, conveys and warrants to NORFOLK AND WESTERN RAILWAY COMPANY ("GRANTEE"), a Virginia Corporation, for and in consideration of the sum of One Dollar ($1.00) and other valuable consideration, the receipt of which is hereby acknowledged, the following described Real Estate in Wayne County, in the State of Indiana, to -wit: Being a part of the Northwest Quarter of Section 34, Township 14 North, Range 1 West in the City of Richmond, Wayne County, Indiana, and being more particularly described as follows: Beginning at an iron rod set in the south right-of-way of the Norfolk and Western Railroad, said point being more particularly described as follows: Commencing at the southwest' corner of the Northwest Quarter of said Section 34, and running thence, north 0 degrees, 09 minutes and 40 seconds east, along the west line of said Northwest Quarter, 173.00 feet to a point in a curve in the southeastward right-of-way of said Railroad; thence along the curve in the southeastward right-of-way of said Railroad having 14,900.00 foot radius curve to the right, a chord which bears north 67 degrees, 56 minutes and 50 seconds east, a distance of 787.29 feet to an iron pipe found at the point of tangency of said curve; thence north 66 degrees and 26 minutes east, along said right-of-way, 1036.36 feet to the beginning point of this description; and running thence, from said beginning point, continuing north 66 degrees and 26 minutes -east, along said right-of-way, 260.00 feet to an iron rod set; thence south 44 degrees and 26 minutes west, 106.78 feet to an iron rod set; thence south 66 degrees and 26 minutes west, parallel to the southeastward right-of-way of said Railroad, 62.00 feet to an iron rod set; thence south 88 degrees and 26 minutes west, 106.78 feet to the place of beginning, containing an area of 0.145 acres. il SUBJECT TO: Any easements of record.
