HomeMy Public PortalAbout1998-38 Local mitigation strategy, Floodplan Management Plan, compensation interlocal agreement; Miami-Dade CountyRESOLUTION NO. 98-38 A RESOLUTION OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; AUTHORIZING THE VILLAGE MANAGER TO EXECUTE THE ATTACHED INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY, MARKED EXHIBIT I, FOR JOINT COMPLETION OF A LOCAL MITIGATION STRATEGY, INCLUDING COMPENSATION TO THE VILLAGE FOR WORK THEREUNDER IN AN AMOUNT NOT TO EXCEED $30,000; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Miami -Dade County has entered into an Agreement with the State of Florida Department of Community Affairs (DCA) to prepare a county wide single, unified Local Mitigation Strategy (LMS); and WHEREAS, said Agreement provides $527,500.00 in State funds for Miami -Dade County and its municipalities to work together to develop the LMS; and WHEREAS, the Village of Key Biscayne has been allocated the sum of $30,000.00 from the State funds available for this purpose in consideration for its participation in the LMS as specified in the "Scope of Work" of the Interlocal Agreement; and WHEREAS, the development of the LMS serves to advance many of the goals in the Village's Floodplain Management Plan and its position in the NFIP Community Rating System. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA AS FOLLOWS: Section 1. That the Village Manager is hereby authorized to execute the Interlocal Agreement attached hereto as Exhibit I and to participate in the performance of the Scope of Work as required under the Agreement. Section 2. Funds to cover the costs required to meet the Village obligations under the Interlocal Agreement shall be provided, up to $30,000.00 by Miami -Dade County, in accordance with the terms of the Agreement. WEISS, VILLAGE ATTORNEY INTERLOCAL AGREEMENT FOR JOINT COMPLETION OF A LOCAL MITIGATION STRATEGY This Interlocal Agreement is being entered into this 26 day of August, 1998, by and between Miami -Dade County ("County") and the Village of Key Biscayne ("Village") in order to jointly complete a Local Mitigation Strategy as described in the attached Scope of Work and in the Department of Community Affairs (DCA) publication The local Mitigation Strategy: a Guidebook for Florida Cities and Counties, hereafter referred to as "the Guidebook" It is agreed that the Village shall assist in the development of the Local Mitigation Strategy ("LMS") using the Guidebook as well as other applicable guidance. The Village shall participate in this process in order to achieve a single, unified LMS for the County. It is agreed that the County will pay compensation at the end of each contract period based on completion of activities identified in this Scope of Work. The payment will be made after the subcontractor submits all deliverables, within the scheduled time frame, and a determination is made by the County that the Village has satisfactorily completed the pertinent activities and deliverables. All payments will be made as soon as possible, following receipt of payments from the DCA, to the County. It is agreed that at the end of the first contract period, the Village is to be paid $6,000.00 (i.e. twenty (20) percent) of the total $30,000.00 contract amount, $6,000.00 (i.e. twenty (20) percent) at the end of the second contract period, $12,000.00 (i.e. forty (40) percent) at the end of the third contract period, and the remaining $6,000.00 (i.e. twenty (20) percent) of the total contract amount at the end of the fourth and final contract period. The Village shall submit all deliverables in the format prescribed by the County. The final deliverable shall be an agreed -upon local mitigation strategy document submitted by the County to the DCA. This agreement shall remain in effect throughout the life of the Local Mitigation Strategy program, currently scheduled to expire July 1, 1999. This agreement may be modified by the mutual written consent of both parties and as required by revisions to the statute. This agreement may be terminated by either party provided that such termination be given in writing to the other party at least ninety (90) days prior to the date of termination. Mlami+Dauie County SCOPE OF WORK Purpose The Village shall assist in the development of the Local Mitigation Strategy (LMS) using the Department of Community Affairs (DCA) publication The Local Mitigation Strategy: a Guidebook for Florida Cities and Counties, hereafter refereed to as "the Guidebook" as well as other applicable guidance. The Village shall participate in the process, in order to achieve a single, unified Local Mitigation Strategy for Miami -Dade County. Payment and Deliverables Schedule The County will pay compensation at the end of each contract period based on completion of activities identified in this scope of work. The payment will be made after the Village submits all deliverables, listed below, within the scheduled time frame, and a determination is made by the County that the Village has satisfactorily completed the pertinent activities and deliverables. The Village shall submit an invoice to the County for payment of compensation at the conclusion of each contract period. All payments will be made as soon as possible following receipt of payments from the Department of Community Affairs to the County. At the end of the first contract period, the Village is to be paid twenty (20) percent of the total $30,000.00 contract amount, twenty (20) percent at the end of the second contract period, forty (40) percent at the end of the third contract period, and the remaining twenty (20) percent of the total contract amount at the end of the fourth and final contract period. The Village shall submit all deliverables in the format prescribed by the County. The final deliverable shall be an agreed -upon local mitigation strategy document submitted by the County. All submissions to the County shall be addressed to: Chief Charles V. Lanza, Director Miami -Dade County Office of Emergency Management 5600 Southwest 87th Avenue- Miami, Florida 33173 I. First contract period - to be determined A. Identify the municipal contract person for this subcontract, to include phone number and fax number. B. At least one municipal representative shall actively participate in all Working Group Meetings. C. A municipal representative shall actively assist in the development of procedures to resolve conflict between government entities that may arise from the development of the local mitigation strategy. D. A municipal representative to the Working Group shall actively assist in the development of evaluation criteria and procedures, to: regularly review, update and revise the local mitigation strategy. 1 E. A municipal representative to the Working Group shall actively assist in the development of community guiding principles. These principles will: 1. Provide a listing of municipal agencies and mitigation functions they perform. Include a narrative description of how these agencies help reduce losses from hazards. 2. Provide a listing on existing municipal policies, ordinances and programs that affect mitigation. II. Second contract period - Deliverables due by September 15, 1998 A. As outlined in section 4 of the Guidebook and drawing from the evaluation of existing mitigation policies, ordinances and programs completed in the previous contracting period, actively assist in the development of: 1. A single list of mitigation goals and objectives that will serve to guide a coordinated and comprehensive strategy to address hazard mitigation. 2. An analysis of how existing policies, ordinances and programs could be strengthened to achieve the mitigation goals and objectives of the community. 3. A hazard identification and vulnerability assessment, assist in the identification of municipal data and data sources, and assist in the collection of data. 4. The identification of private sector interest, and methods for private sector involvement. 5. Procedures to prioritize municipal and county mitigation initiatives. III. Third contract period - deliverables due March 15, 1999 A. A municipal representative to the Working Group shall actively assist in the gathering of the following information: 1. Critical facilities inventory. 2. Listing of other public buildings and facilities. 3. Repetitive Loss Data. 4. Hazardous materials sites. 5. Historical flood data. B. Subcontractor shall submit a list of potential mitigation initiatives which: 1. Reduce vulnerability. 2. Study and identify cost beneficial mitigation activities, including engineering studies. 3. Identify mitigation initiatives found in existing local government Capital Improvement Plans for future funding consideration. 4. Recommend program and policy actions and revisions to further promote effective hazard mitigation. C. A municipal representative to the Working Group shall actively assist in the identification of potential funding sources. D. Subcontractor shall review and comment on all hazard identification and vulnerability assessment activities conducted by the County an on the list of potential mitigation initiatives. IV. Fourth contract period - deliverables due by July 1, 1999 A. Subcontractor shall agree to the final local mitigation strategy as a compiled document to be submitted to the local governing body for formal adoption.
