HomeMy Public PortalAbout2021.081 - (07-20-21) RESOLUTION NO. 2021.081 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING AND DIRECTING THE COUNTY ASSESSOR TO LEVY AND COLLECT DELINQUENT UTILITY CHARGES AGAINST SINGLE FAMILY RESIDENTIAL PARCELS (UP TO THREE UNITS) IN CONNECTION WITH ITS WATER, SANITATION, STORM DRAINAGE, OR SEWER SYSTEM ON THE TAX ROLL FOR FISCAL YEAR 2021-22 FROM THE CITY OF LYNWOOD AS A SPECIAL ASSESSMENT TO BE COLLECTED AT THE SAME TIME AND IN THE SAME MANNER AS COUNTY TAXES FOR FISCAL YEAR 2021-2022 WHEREAS, Section 54354 of the California Government Code authorizes cities that undertake the collection, treatment, or disposal of sewage or supply water, or collect, treat or dispose Of storm water, to collect delinquent utility charges via a special assessment to be collected with county taxes; and, WHEREAS, the City Council adopted Resolution No.2021.081 which provides for collection of delinquent utility charges in accordance with California Government Code Section 54354; and, WHEREAS, the City's delinquent charges in connection with water, sanitation, storm drainage or sewerage system may include unpaid water consumption charges, utility user tax, readiness to serve charge, sewer fees, street sweeping, livable environment fee and/or late payment penalty fees; and WHEREAS, in accordance with Resolution No. 2021.081, property owners can pay their delinquent bill following the July 20, 2021 public hearing up to July 29, 2021 to avoid the special assessment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Each delinquent utility bill shall be increased by an amount not to exceed the actual costs incurred by the County of Los Angeles, and charged to the City of Lynwood for placing the delinquent bills on the property tax roll via a special assessment. Section 2. Each delinquent utility bill shall be increased City's own administrative cost to compensate the City for administrative costs incurred by collecting delinquent refuse bills via a special assessment. The City's administrative cost, calculated at $7,532, was distributed among all parcels on the list based on percentage share of each parcel's delinquent amount to the total delinquent amount for all parcels. Section 3. The list of properties and the amount to be collected, attached as Exhibit "A," shall be forwarded to the Los Angeles County Office of the Assessor for 1 posting on the tax bill as a special assessment. Exhibit "A" may be modified by the City Manager prior to placing the delinquent bills on the property tax roll where delinquent utility charges are paid following the July 20, 2021 public hearing.
