HomeMy Public PortalAbout2021.090 - (07-20-21) RESOLUTION NO. 2021.090 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD OF ITS INTENTION TO LEVY AND COLLECT ANNUAL REFUSE CHARGES AGAINST SINGLE FAMILY RESIDENTIAL PARCELS (UP TO THREE UNITS) FOR THE FIRST TIME IN FISCAL YEAR 2021-2022 ON THE COUNTY TAX ROLL AND AUTHORIZING AND DIRECTING THE COUNTY ASSESSOR TO INCLUDE ANNUAL REFUSE CHARGES AS A SPECIAL ASSESSMENT TO BE COLLECTED AT THE SAME TIME AND IN THE SAME MANNER AS COUNTY TAXES AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS AS AUGUST 3, 2021 WHEREAS, the City Council of the City of Lynwood desires to keep the refuse collection costs at a minimum within the City and require that all persons pay their fair share of these collection costs in order to keep fees as low as possible; and WHEREAS, the City Council of the City of Lynwood has determined that the best method of achieving this goal is to establish permanent procedures whereby the City can place annual refuse charges on the property tax assessment rolls of single family residential parcels (up to three units) so as to better ensure payment; and WHEREAS, Health and Safety Code section 5471 authorizes the City to prescribe, revise and collect, fees, rates, or other charges for services and facilities furnished by it, either within or without its territorial limits, in connection with its water, sanitation, storm drainage, or sewerage system; and WHEREAS, Health and Safety Code section 5471 authorizes the City to collect annual refuse bills by an ordinance or resolution approved by a two-thirds vote of the members of the legislative body; and, WHEREAS, Health and Safety Code Section 5473 allows any entity, by a two- thirds vote of the members of the legislative body, to elect to have refuse and garbage collection on property tax rolls; and WHEREAS, various cities and counties have placed annual refuse charges on the property tax roll as a mechanism of collection; and WHEREAS,the City Council of the City of Lynwood believes that these procedures are in the best interest of the City of Lynwood. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOO DOES HEREBY RESOLVE AS FOLLOWS: Section 1. a. On July 20, 2021, the City Council set the public hearing as August 3, 2021 to hear protests and objections as to the inclusion of annual refuse charges to the county 1 tax roll, 6:00 p.m. or soon thereafter, in the Council Chamber of the City Hall Annex, 11350 Bullis Road, Lynwood, California. Given the Covid-19 Pandemic, this Public Hearing may be held telephonically or by video conferencing to protect the health and well-being of the meeting participants. Participants can join via Zoom or by telephone: 1-669-900-9128 or 1-253-215-8782, Meeting ID: 835-2029-8238. If interpretation services are needed, participants can dial (310) 372-7549; conference code 673120. Information on the telephonic or video conferencing access to the City Council Meeting may change. To receive the most updated information on whether the Public Hearing is accessible telephonically or videoconferencing; and/or changes on the phone numbers as well as access code and password, this information will be included in the August 3, 2021 Agenda. At the hearing, the City Council shall hear any objections or protests of landowners liable to be assessed for fees. At the conclusion of its public hearing, the City Council shall determine and approve, as an assessment against the property, all annual refuse fees owing prospectively. If there is a majority protest of the total number of property owners notified, the report shall not be approved. Section 2: The City Clerk shall certify as to the adoption of this City Council Resolution. PASSED, APPROVED and ADOPTED this 20th day of July, 2021.
