HomeMy Public PortalAbout2021.021 - (02-16-21) RESOLUTION NO. 2021.021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING A SPECIAL EVENT PERMIT FOR LA CARE HEALTH PLAN / NORTH STAR ALLIANCES TO OPERATE A COVID-19 DRIVE-THRU VACCINATION CLINIC ON THE GROUNDS OF CITY HALL WITHIN THE MONTH OF MARCH AND APRIL, 2021 WHEREAS, a request has been made by LA Care Health Plan / North Star Alliances to operate a COVID-19 Drive-thru Vaccination Clinic on the grounds of City Hall within the month of March and April, 2021; and WHEREAS, LA Care Health Plan has partnered with USC Pharmacy who has requested an order for COVID-19 vaccines on behalf of LA Care Health Plan; and WHEREAS, in preparation of receiving the vaccine, LA Care Health Plan / North Star Alliances has requested to host a countywide COVID-19 Drive-thru Vaccination Clinic within Lynwood with the 1st dose being administered in March followed by the 2nd dose in April; and WHEREAS, while the event would be open to all qualified LA County residents, LA Care has committed to conducting outreach specifically to Lynwood residents about this event; and WHEREAS, vaccinations are prioritized according to age and risk. The State of California has developed a detailed tier system for vaccine distribution whereby vaccinations are prioritized according to age and risk; and WHEREAS, based on this tier system, LA Care Health Plan / North Star Alliances would be administering the vaccine to those grouped within Phase 1A and 1B, which include healthcare workers, long-term care residents, individuals 65 and older, and essential workers in the education, childcare, emergency services and food and agriculture sectors; and WHEREAS, the City Council of the City of Lynwood is committed to partnering with an eligible provider to locate a COVID-19 vaccination site in Lynwood. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. The City Council approves the Special Event Permit to allow LA Care Health Plan / North Star Alliances (Applicant) to operate a COVID-19 Drive-thru Vaccination Clinic on the grounds of City Hall within the month of March and April 2021, per the submitted application attached hereto as Exhibit A and included as part of this resolution. 1 Section 2. Event Information. The City Council acknowledges the Applicant has tentatively set the 1st vaccination date for March 12, 2021 followed by the 2"d vaccination date for April 2, 2021. The City Council understands that these date will not be confirmed until the Applicant receives notice that they have received their requested vaccine orders. Therefore, the City Council approves the option to move the event dates to another date that falls on a Friday, Saturday, or Sunday, within the month of March and April, as long as it does not in conflict with any other scheduled event the City has planned at the requested location and provided no less than 5 working days' notice is given by the Applicant to the City. Section 3. Overview of Event. This event will take place a maximum of two times and be by appointment only (no walkups will be allowed). The first time would be to administer the 1st dose of the COVID-19 vaccine and the second time would be to administer the 2nd dose of the COVID-19 vaccine. The Applicant anticipates receiving 1,000 vaccine dosages for each event. Only FDA approved vaccines may be administered at the event, which currently include Pfizer-BioNTech and Moderna. While the time of each event would be 9:00 a.m. to 6:00 p.m., setup of the event will begin by 5:00 a.m. and should be dismantled by 8:00 p.m. on the same day. The Applicant will be responsible for registering LA County residents for the event. The Applicant will be providing the needed staff for this event (including staff to handle the traffic circulation) and providing all needed supplies (i.e. vehicle barriers, canopies, portable restrooms for event staff only, etc.). Section 4. Event Location. The City Council approves the use of the parking lots at City Park and the City Hall grounds for the queueing of vehicles with the actual setup of the vaccination being done in the parking lot between the back of City Hall and the Senior Center. Section 5. Street Closure. The City Council approves the closure of Bullis Road from Martin Luther King Jr. Boulevard to the end of the City's south property line (i.e. armory building) and Ernestine Avenue between Martin Luther King Jr. Boulevard and Platt Avenue each day the event is held along with the site plan, included as Exhibit B to this resolution. Section 6. Community Outreach. The Applicant will make a concentrated effort in conducting outreach specifically to Lynwood residents by working with City staff in promoting the event to residents who fall within Phase 1A and 1B of the State of California's tier vaccine system. In addition, the Applicant will dedicate staff to the outreach of their members 65 years and older who reside in the City. Section 7. City Resources. City staff resources will be limited to the Public Works Department closing down Bullis Road from Martin Luther King Jr. Boulevard to the end of the City's south property line (i.e. armory building) and Ernestine Avenue between Martin Luther King Jr. Boulevard and Platt Avenue the morning of the event (around 5:00 am) and opening both streets back up at the conclusion (around 8:00 pm) as well as Public Safety Division periodically inspecting the area to ensure there is no backup 2 on City streets causing traffic delays. In addition, the Public Works Department will post "No Parking" signs no less than 72 hours prior to each event within the affected City properties and along the area of Bullis Road to be closed to thru traffic. Section 8. The City Council further finds that all City and County laws and regulations must be obeyed and complied with during all activities of the event including but not limited to the following: a. All patrons receiving the COVID-19 vaccination must stay in their car at all times (no walk-ups allowed). b. All patrons receiving COVID-19 vaccination must obey all traffic laws. c. All patrons receiving COVID-19 vaccination must wear a facemask at all times they come into contact with Applicant staff or volunteers. d. No walk-up COVID-19 vaccination is allowed. e. The Applicant must obtain a City of Lynwood Business License prior to start of event. f. All Applicant staff and volunteers must maintain a minimum of 6-feet from each other. g. All Applicant staff and volunteers must wear a facemask and gloves at all times when participating in the vaccination clinic. h. There may be no posting of signs within the public right-of way or on poles, traffic lights, etc. i. No banner is allowed, unless the City's Planning Division has issued a permit prior to the event date. j. Applicant must comply with NPDES regulations k. Applicant must coordinate with Public Works Department five (5) working days prior to each event date to review and receive approval of the traffic control plan for the event. I. All temporary power hook-ups or connections must be approved by the City's Building Division prior to commencement of the event. m. The Applicant shall furnish and make available refuse containers and service, and leave the grounds clean of all refuse and restored to their original condition after each event. n. Emergency access to all areas of the property shall be maintained throughout the entire event. o. No outside vendors shall be allowed on the designated premises. p. Applicant must provide security personnel onsite each day of event. q. Applicant must provide a minimum of one (1) staff person at each designated barrier along Bullis Road and Ernestine Avenue and the entrance to the event (Martin Luther King Jr. Boulevard and Community Center parking lot) for the entire time of the event. r. Applicant must provide written notice to all residential properties (both property owner and residential address) located on Ernestine Avenue between Martin Luther King Jr. Boulevard and Platt Avenue of the street closure five (5) days prior to each event. The written notice must include the date and time of street closure and list a contact person (name and phone number) in case of issues the 3 day of the event. In addition, Applicant must allowed all residents within this area access in and out of Ernestine Avenue. s. Applicant must provide written notice to all commercial properties (both property owner and business address) located on the south side of Martin Luther King Jr. Boulevard between Bullis Road and Ernestine Avenue must receive notice of the street closure of Bullis Road and Ernestine Avenue five (5) days prior to each event. The written notice must include the date and time of street closure and list a contact person (name and phone number) in case of issues the day of the event. t. Applicant must provide written notice to the Lynwood Unified School District of all street closures five (5) days prior to each event. Applicant must allowed all Lynwood Unified School District employees accessing 11321 Bullis Road, from the south of the event, in and out of the listed address. u. Applicant must maintain the required liability insurance of $1 million per occurrence/$2 million aggregate and naming the City of Lynwood as and additional insured on the Certificate of Liability Insurance. v. Applicant (as "Indemnifying Party") shall protect, indemnify, defend, and hold harmless the City of Lynwood andits elected and appointed officials, officers, agents, employees and independent contractors (collectively, the "Indemnified Party") from and against any and all claims, losses, damages, liabilities, fines, penalties, liens, judgments, awards, settlements, actions, causes of action, suits, demands, fees, costs and expenses (including, without limitation, reasonable attorneys' and expert fees and costs) based on claims for personal injury and/or wrongful death (collectively, the "Claims") caused by an individual's participation in the COVID-19 Drive-thru Vaccination Clinic. Section 9. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect.
