CITY PLAN COMMISSION RICHMOND, INDIANA December 4, 1987 Mrs. Jane Brookbank; President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 62-1987 .:Plan Commission Case PDP-87-1 Dear Mrs. Brookbank, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on November 24, 1987, on the petition of the Richmond Coca- Cola Bottling Company, Inc., Robert O'Maley, Attorney, Agent, requesting to vacate that portion of Northwest 2nd Street running north off of West Main Street to the first north/ south alley. Eighteen (18) notices of public hearing were sent to the surrounding property owners, with seven (7) returned in opposition to the request. During the public hearing, eight (8) property owners and Councilman Marion Williams spoke in opposition to the request. The vacation petition filed by the Coca-Cola Bottling Company, Inc., indicates that numerous times during the day in the normal conduct of its business it is necessary for company vehicles to cross Northwest 2nd Street. The vacation is requested to alleviate safety hazards to pedestrians and to facilitate the operation of the busi- ness. In making its recommendation to Common Council, the Plan Commission considered the facts set forth in the vacation petition and the grounds found in the State Law, I.C. 36-7-3-13 (see attached) regarding the filing of remonstrances in Court to a proposed vacation peti- tion. The Plan Commission voted eight (8) to one (1) to recommend that Ordinance No. 62-1987 be denied. Respectfully submitted, C—CITY PLA MMISSION Daniel S.
