HomeMy Public PortalAbout2007-05 ORDINANCE NO. 24-2006 AN ORDINANCE TO AMEND THE CODE OF ORDINANCES SECTION REGARDING NEPOTISM FOR THE CITY OF TYBEE ISLAND, GEORGIA WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of the citizens of Tybee Island, Georgia, and WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is the Mayor and Council thereof, and WHEREAS, the governing authority desires to adopt an ordinance under its home rule powers, and WHEREAS, the governing authority desires to amend the Code of Ordinances for the City of Tybee Island, Georgia, regarding nepotism. NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee Island that Section of the Code of Ordinances of the City of Tybee Island is hereby amended so as to create a new provision hereafter read as follows: Section No member of the immediate family of a Department Head may be hired or transferred into a department where a potential supervisor- subordinate relationship would exist. No relative of the City Manager may be employed with the City. If two employees marry or become related, only one of the employees will be permitted to remain employed in the department. In addition, immediate family members should not be employed in the same City Departments. Nothing in this section shall affect persons hired or transferred prior to the adoption of this policy. The City may consider requests for variance from this section on a case -by -case basis, and upon City Manager approval. As used herein "related" and "immediate family" are synonymous and are to include spouse, child, step - child, grandchild, parent, grandparent, brother, sister, half - brother, half - sister, uncle, aunt, niece, nephew, or the spouse of any of them. These relationships shall include those arising from adoptions, persons who are married by common law marriage or who are living together without the benefit of matrimony are also considered related under the intention of this rule. This Ordinance shall become effective on ( day of 200T.
