November 17, 1971
A Special Meeting of City Council was held this evening at 7:00 P.M.
for the purpose of entering into an agreement to hold harmless the
United States of America and its construction contractors from
any and all claims for damages whatsoever growing out of or inci-
dent to the performance of the construction contract within the
area of the emergency repair facilities; also, to adopt a reso-
lution authorizing the Mayor to obtain the necessary rights -of-
way for ingress, egress and regress to and from the construction -
and the Clerk of Council be authorized to issue the required
licenses and permits for performance of the work by the construc-
tion contractors.
The meeting was presided over by Michael J. Counihan, Mayor, and
the following councilmen were in attendance: Edward Jung, James
Stettler, Bob Cary, Edward Towns and George Schwarz. Mr. Perry A.
Zittrauer, Jr. was a visitor at the meeting. He will be sworn in
as Councilman at the next regular meeting on November 24th.
City Attorney Bart Shea was also present at the meeting.
Councilman Robert F. Cary requested a reading on the Resolution to
authorize the Mayor to obtain the necessary rights -of -way for
ingress, egress and regress to and from the construction, and the
Clerk of Council authorized to issue the required licenses and
permits for performance of the work by the construction contractors.
He then moved its adoption. The motion was seconded by Council-
man Jung and unanimously approved.
R E S O L U T I O N
An Agreement was read by the City Attorney agreeing to save harm-
less the United States of America and its construction contractors
from any claims that could or may arise as a result of the con-
struction of said emergency repair facilities. Councilman Cary
moved that the Mayor be authorized to enter into this Agreement
with the United States of America; and that it be attested to
by the Clerk of Council. This motion was seconded by Councilman
Jung and unanimously carried.
A G R E E M E N T
There being no further business, the meeting was adjourned to the
next regular or special called meeting.

A RESOLUTION
WHEREAS, the United States of America will make award of a con-
tract for certain emergency repairs to the existing sea wall at
Savannah Beach, Georgia, consisting generally of the construction
of a rock sea wall; and
WHEREAS, it has been determined that the location of the temporary
construction will cover an area from Center Street to approximately
350 feet south therefrom; and
WHEREAS, licenses and permits will be required for the performance
of the work by the construction contractors in an area described
as being 50 feet on the seaward side of the existing sea wall and
18 feet on the landward side measured from the existing sea wall
or the breached area, beginning at the end of the existing stone
shore protection (Center Street) and extending 350 feet south; and
WHEREAS, Savannah Beach, Tybee Island, wishes to indemnify the
United States of America and its construction contractors from
claims or damages growing out of or incident to the performance of
the construction within the area herein defined.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of
Savannah Beach, Tybee Island, in council assembled, that the Mayor
of Savannah Beach, Tybee Island, be authorized to obtain necessary
rights -of -way for ingress, egress and regress to and from the
construction and the Clerk of Council be authorized to issue the
required licenses and permits for performance of the work by the
construction contractors.
BE IT FURTHER RESOLVED that the Mayor of Savannah Beach, Tybee
Island, be authorized to execute, and the Clerk of Council to
attest, the necessary indemnification in connection with said
construction
This is to certify that the Above Resolution is a true copy of the
Resolution passed in meeting of Town Council held on November 17th, 197].
Given under my hand and seal of the Town of Savannah Beach, Tybee
Island, Georgia, this 17th day of November, 1971.

WHEREAS, the United States of America has laid out and designated
as area for emergency repair to the existing sea wall at a loca-
tion which is 50 feet on the seaward side of the existing sea wall
and 18 feet on the landward side measured from the existing sea
wall or the breached area, beginning at the end of the existing
stone shore protection (Center Street) and extending approximately
350 feet south, at Savannah Beach, Tybee Island, Georgia; and
WHEREAS, the aforesaid protective work is for the benefit of
Savannah Beach, Tybee Island.
NOW, THEREFORE, for and in consideration of the sum of One ($1.00)
Dollar and in consideration of said protective work, said Munici-
pality, Savannah Beach, Tybee Island, hereby agrees to save harm-
less the United States of America and its construction contractors
from any and all claims for damages whatsoever growing out of or
incident to the performance of the construction contracts within
the above described area; it being the intention of this agreement
to save harmless the United States of America and its construction
contractors from any calims that could or may arise as a result
of the construction of said emergency repair facilities.
IN WITNESS WHEREOF, these presents have been executed on this 17th
day of November, 1971 by the duly authorized officers of Savannah
Beach, Tybee Island.
