HomeMy Public PortalAbout19711208SCMeeting1 1 27 Savannah Beach, Georgia December 8, 1971 A Special Meeting of City Council was held this evening at 7:00 P.M. for the purpose of: (1) Revising the Resolution and the Agreements previously entered into with the United States of America and its construction contractors, to hold them harmless from any and all claims for damage whatsoever incident to this construction contract. (2) Considering a request from Councilman Towns, proposed purchaser of the Eagles Nest Property, for the City of Savannah Beach to quit -claim any interest or right -of -way it may have in the Eagles Nest Property. The meeting was presided over by Mayor Michael J. Counihan and the following councilmen were present: Edward Jung, James Stettler, Robert F. Cary, Perry A. Zittrauer, Jr., Edward Towns and George Schwarz. City Attorney Bart Shea was also present. City Attorney Shea read the revised Resolution authorizing the Mayor to obtaiiplthe necessary rights -of: way °for ingress and egress. These distances were revised since the Special Meeting of November 17th, due to increased damage done to the seawall. R E S O L U T I O N Councilman Stettler moved that the Resolution be adopted. It was seconded by Councilman Zittrauer and unanimously carried. The revised Agreement was then read by the City Attorney. A G R E E M E N T Councilman Stettler moved that the agreement be approved. It was seconded by Councilman Zittrauer and unanimously approved. Councilman Cary moved that the City disclaim and quit claim any interest or right they may have to any of the streets in the Fort Ward property known as Eagles Nest and to authorize the Mayor to execute such deed. The motion was seconded by Councilman Stettler and unanimously carried. There being no further business, the meeting was adjourned to the next regular or ppecial called meeting. CLERK OF COUNCIL 28 1 1 A RESOLUTION WHEREAS, the United States of America will make award of a contract for certain emergency repairs to the existing sea wall at Savannah Beach, Georgia, consisting generally of the construc- tion of a rock sea wall; and WHEREAS, it has been determined that the location of the temporary construction will cover an area from Center Street to approximately 375 feet south therefrom; and WHEREAS, licenses and permits will be required for the per- formance of!the work by the construction contractors in an area described as being 50 feet on the seaward side of the existing sea wall and 100 feet on the landward side measured from the existing sea wall or the breached area, beginning at the end of the existing stone shore protection (Center Street) and extending 375 feet south; and WHEREAS, Savannah Beach, Tybee Island, wishes to indemnify the United States of America and its construction contractors from claims or damages growing out of or incident to the perfor- mance of the construction within the area herein defined. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, that the Mayor of Savannah Beach, Tybee Island, be authorized to obtain the necessary rights -of -way for ingress, egress and regress to and from the construction, and the Clerk of Council be authorized to issue the required licenses and permits for performance of the work by the construction contractors. BE IT FURTHER RESOLVED that the Mayor of Savannah Beach, Tybee Island, be authorized to execute, and the Clerk of Council to attest, the necessary indemnfication in connection with said construction. This is to certify that the Above Resolution is a true copy of the Resolution passed in meeting of Town Council held on December 8th, 1971. Clerk of Council 1 1 1 1 STATE OF GEORGIA ) CHATHAM COUNTY ) WHEREAS, the United States of America has laid out and designated an area for emergency repair to the existing sea wall at a location which is 50 feet on the seaward side of the exist- ing sea wall and 100 feet on the landward side measured from the existing sea wall or the breached area, beginning at the end of the existing stone shore protection (Center Street) and extend- ing approximately 375 feet south, at Savannah Beach, Tybee Island, Georgia; and WHEREAS, the aforesaid protective work is for the benefit of Savannah Beach, Tybee Island. NOW, THEREFORE, for and in consideration of the sum of One ($1.00) Dollar and in consideration of said protective work, said Municipality, Savannah Beach, Tybee Island, hereby agrees to save harmless the United States of America and its construction contractors from any and all claims for damages whatsoever growing out of or incident to the performance of the construction contracts within the above described area; it being the intention of this agreement to save harmless the United States of America and its construction contractors from any claims that could or may arise as a result of the construction of said emergency re- pair facilities. IN WITNESS WHEREOF, these presents have been executed on this 8th day of December, 1971 by the duly authorized officers of Savannah Beach, Tybee Island.
