HomeMy Public PortalAbout19720119CCMeeting1 1 1 33 Savannah Beach, Georgia January 19, 1972 The regular meeting of Savannah Beach City Council was -_held this afternoon at 3:00 p.m. with Mayor Michael J. Counihan presiding and the following councilmen in attendance: Edward Jung, Robert Cary, James Stettler and Perry A. Zittrauer, Jr., City Attorney Bart Shea and Police Chief John J. Price was also in attendance. Councilman Schwarz had an excused absence and Councilman Towns was out of the city attending the funeral of a relative. Visitors and petitioners at the meeting were Mrs. Evelyn Butler, Matthew Doyle and Mr. Edward Lee, attorney. Mr. Lee appeared on behalf of Mr. E. M. Carpenter and once again petitioned Council for a permit to build a Land Cruizer Park, which would be a club type affair limited to self - propelled camping vehicles but prohibiting trailers, Recommendations, in writing, from the Savannah Beach Planning Commission were read by the Clerk. It reflected disapproval by that body due to the fact that it did not meet the development plan for Savannah Beach adopted by the Savannah Beach Planning Commission. It further stated that approval of this would open the door to further developments not in conformity with the development plan for Savannah Beach. Mrs. Evelyn Butler stated to Council that she had appeared before them last October and had petitioned Council, and in particular, the Police Committee, to go back to the communication set -up we had with the ChatharfCounty, stating that our present set -up of having the Savannah Police Dispatcher, dispatch our police cars was not working out in all cases. Mayor Counihan stated that we were, at the present time, in contact with Chatham County Police Officials, discussing this with them. He said that he felt that we would be able to accomplish this in the very near future. The Minutes of the Meeting of December, 15, 1971, were approved as written. COMMUNICATIONS: A letter of resignation from Police Lieutenant Lawton Daly was read. Police Commissioner Robert F. Cary moved that the resigna- tion be accepted. The,motion was seconded and unanimously carried. A letter was read from Thomas and Hutton Engineering Company en- closing eight copies of Engineering Report of January 14, 19710 to support a proposed Revenue Bond Issue of $1,.350,000. A letter from Col. Strohecker, D. E., .Savannah District, Corps of Engineers, advising the receipt of official authorization to use $75,000 of non - federal funds for pre - construction planning. 34 Attorney Bart Shea read a letter to Mr. Henry Struble, of the State arks Department, beginning negotiations to secure these funds for pre - construction planning. A letter was read from Savannah Beach Golden Age Club, thanking the Mayor for their Christmas Gift of a set of dishes. A letter from Tybee Teen Club, thanking the Mayor for his assistance in helping_to get their club started. A letter from Mrs. Louise Shaw, thanking the Mayor and Council for a most worth -while project - our ceramics classes. It was moved, seconded and unanimously carried that all these communi- cations be received as information, except the -letter • from Thomas & Hutton in which they requested authorization from the City of Savanah Beach for them to prepare an application for additional grants for treatment facilities which Mr. Hutton stated we may be eligible for. Mr. Hutton-stated-that he has now leaned there is some Federal Legislation in process at the present time which provides 60% Grants for treatment facilities and some parts of the collection system. Mr. Hutton stated further that this legislation, in its present form will be retroactive for projects started in 1972 under the 33% Grant. It was moved, segonded and unanimously carried that City Council authorize Thomas & Hutton to prepare this application. Councilman Jung moved that a separate bank account be opened for our Sewer Department Revenue and disbursements when the time comes where a'separate account will be required. The motion was duly seconded and unanimously approved. Councilman Cary moved the adoption of the following Resolution authorizing the acquisition of certain parcels of land needed for new lift stations in the Pollution Abatement Program: R E S O L U T I O N The motion was seconded by Councilman Jung and unanimously carried. Councilman Cary reported on a meeting he had attended with Council- man Towns and members of Savannah Beach Volunteer Fire Department with reference to the purchase of a new fire truck. He moved that the cost of the new equipment be put in the budget for next year. The motion was seconded by Councilman Stettler and unanimously carried. It was recommended by the City Attorney that the cost of this equipment be apportioned over a period of several years. Councilman Sty ttler read a letter from Mr. W. W. Henry of the Savannah Beach Library Board with reference to Savannah Beach Library be- coming a member of the Regional Library System. Mrs. Henry stated in this letter that it was felt by the Savannah Beach Library Board that this merger would not be in the best interest of our Savannah Beach Library and a vote taken at this meeting reflected this 1 1 35 decision. Councilman Stettler, therefore, moved that Council concur with the wishes of this Board. The motion was seconded by Councilman Jung and unanimously carried. Councilman Zittrauer read a letter from the Federal Insurance Administration, Department of Housing and Urban Development, advising that the eligibility of the City of Savannah Beach for Flood Insurance would continue in force pending detailed examination. City Attorney Bart Shea requested permission of Council to amend the contract that was signed by the City to adhere to Mr. Hutton's recommendation that the payments be made through 1998 on the Chatham County Pollution Contract. Unanimous approval was given by Council for this. On behalf of Councilman Towns who was absent, - .Mayor Counihan asked for a motion of Council to grant permission to Ed. Towns et at., to build a fishing pier -at some location that is picked out by the Town. Councilman Zittrauer moved that this permission be granted. It was seconded by Councilman Cary and unanimously carried. City Attorney Shea informed Council-that it appeared that Mr. Lyppert on Campbell Avenue was operating an auto repair business in a residential area and if this was true, he should be told that this action must cease. Chief Price was instructed by Council to check and see if he was repairing and /or selling these :vehicles with power to act. Mayor Counihan stated that if there were no objections from Council, he would like to appoint Mrs. Phyllis Cary as a Deputy Registrar to help with the voter registration. Council unanimously approved this appointment. Mayor Counihan informed Council that in the past, it has been the practice of the City to pay for the gas used by the Marine Rescue Squardron when they were called out on searches or train- ing runs. In lieu of this, Mayor Counihan said_the Marine Rescue Squardron would henceforth be paid a flat $25.00 per,' month gasoline expense. City Attorney Shea stated that since the application for a Land Cruizer Park had been in for several months now, some action one way or the other should be taken on it. The history of this application was then outlined by Mayor Counihan to refresh the minds of the councilmen. He also reminded the members of Council that this was turned down by the Savannah Beach Planning Commission because it did not meet the development Plan for Savannah Beach and that they (the Planning Commission) felt that granting this request would open the door to further development not in conformity with the development plan for Savannah Beach. After a general discussion, Mayor Counihan 36 called for a vote of FOR or AGAINST approval of the application. Councilmen Cary, Stettler and Zittrauer voted against approval of the application; and Councilman Jung voted for approval of the application. The application was, therefore, turned down. There ..being no further business, the meeting was adjourned to the next regular or special called meeting. CLERK OF COUNCIL 1 1 R E S O L U T I O N BE IT RESOLVED BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, IN COUNCIL DULY ASSEMBLED THIS 19th DAY OF JANUARY, 1972 AND IT IS HEREBY RESOLVED AS FOLLOWS: WHEREAS, the Municipality is currently under Court Order to construct a new sewage treatment plant and connecting facilities so as to eliminate pollution in the waters surrounding the municipality and Chatham County; and WHEREAS, the City has been informed by its engineering company that it will be necessary to acquire property in which to place one of the five sewage pumping stations included in such project of pollution control; and WHEREAS, said engineers have so informed the City that the property required is a site fronting on Campbell and Linton streets, the same being a portion of lot 11, Pamela Terrace Subdivision, and owned by Harry H. and Irving R. Barr, as shown being a copy of the attached plat of said engineers: WHEREAS, the said Harry H. and Irving R. Barr are the owners of lots 1 -9 and the remaining lot 11, lots 12 -20, Pamela Terrace Subdivision, and are willing to grant to the City the portion of lot 11 required by the City for construction of said sewage pumping station without charge in return for the municipality keeping the debris off of the remaining said lots and cut and clean any heavy undergrowth from said lots for a period of five years from the date hereof; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Councilmen of the City of Savannah Beach, Tybee Island, Georgia hereby: 1. Agree to accept from Harry H. and Irving R. Barr a portion of lot 11, Pamela Terrace Subdivision located on the northeast corner of Campbell Street and Linton Street in the City of Savannah'Beach, Tybee Island, Chatham County, Georgia without charge or cost to the municipality. 2. In return for such conveyance the municipality agrees to keep the debris off of and clean the heavy undergrowth therefrom for a period of five years from the date hereof, the remaining lots owned by Harry H. and Irving R. Barr, namely lots 1 -9, and the remaining portion of lot 11 and lots 12 -20, Pamela Terrace Subdivision. ADOPTED in open Council this 19th day of January, 1972. ATTEST: By 1'1 (SEAL) CITY OF SAVANNAH BEACH Mayor 1 1 1 1 R E S O I U T I O N BE IT RESOLVED BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, IN COUNCIL DULY ASSEMBLED THIS 19th DAY OF JANUARY, 1972 AND IT IS HEREBY RESOLVED AS FOLLOWS: WHEREAS, the Municipality is currently under Court Order to construct a new sewage treatment plant and connecting facilities so as to eliminate pollution in the waters surrounding the municipality and Chatham County; and WHEREAS, the City has -beep :informed by its engineering company that it will be necessary to acquire property in which to place two of the five sewage pumping stations included in such project of pollution control; and WHEREAS, said engineers have so informed the City that the property required are sites at or near Highway 80 and Campbell Avenue and Highway 80 and Jones Avenue as shown by copies of the attached plats of said engineers; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Councilmen of the City of Savannah Beach, Tybee Island, Georgia hereby: 1. Direct the City Attorney to enter into negotiations with the respective owners of said parcels of property, namely, Harry H. and Irving R. Barr, for the property at the intersection of Highway 80 and Campbell Avenue and W. C. Fleetwood, for the property located at Highway 80 and Jones Avenue, in an attempt to arrive at a purchase price agreeable to both the .City and said property owners and consummate the purchase of the said parcels of property. 2. In the event that the City Attorney is unable to negotiate a purchase agreement with either or both of said owners of such parcels of property, then the City Attorney is directed to institute condemnation proceedings so as to acquire same for use by the City in its pollution control project.
