The regular meeting of Savannah Beach City Council was held
this afternoon at 3:00 P. M. with Mayor Michael J. Counihan
presiding and the following councilmen in attendance: Edward
Jung, Robert Cary, James Stettler and Perry A. Zittrauer, Jr.
City Attorney Bart E. Shea was also in attendance.
Visitors and petitioners at the meeting were Mr. and Mrs. Jack
Brady.
Mr. Brady stated that he was appearing before council to request
a letter from them which he could present to the Corps of
Engineers with his application for a permit to fill in some
highland and marshland along Sixth Street from the north side
and also from the south side, here at Savannah Beach. Mr. Brady
stated that he had been assured by the Corps that they would
grant him this permit provided he met certain requirements, one
of which was a letter from Savannah Beach Town Council. He said
this letter would simply state that Council had no objections to
this. Mr. Brady said actually two letters would be necessary,
one for the northern side and one for the southern side of
Sixth Street. After a lengthy discussion, Mayor Counihan stated
that since there were no objections from Council, the City
Attorney would prepare the letters requested by Mr. Brady.
The Meeting was formally opened by Mayor Counihan.
Bills for the various departments were approved for payment.
Minutes for the Meeting of January 19th were approved as written.
Police Commissioner, Bob Cary, announced that the Police Committee
had promoted Police Lieutenant Charles Bishop to the rank of
Captain as of February 16, 1972.
Councilman Towns advised Council that Mr. Bob Hester of the
Small Business Administration would be in Savannah on March 1st
and at the time, discussions in regard to building a new fishing
pier would be continued with him. Mayor Counihan stated that
Councilman Towns was to be congratulated for his efforts to get
thisjpier for Savannah Beach as it was urgently needed.
Councilman Jung informed Council that since they were opposed to
the method of financing the new Trade Center in Atlanta due to
the fact that Savannah Beach and all municipalities need funds
so badly, he felt we should go on record by directing a letter
to our representatives in the General Assembly. Following the
reading of the letter by City Attorney hea, Councilman Jung
moved that the letter be sent. The mot on was seconded and
unanimously carried.

City Attorney, Bart Shea, informed Council that in accordance
with our Charter, and in particular that part pertaining to the
holding of elections, that it would be necessary for Council to
adopt two resolutions, one for the purpose of naming the Election
Superintendent and the other for the purpose of giving public
notice through a legal advertisement in the newspaper. Attorney
Shea then read the first Resolution:

Councilman Jung moved the adoption of this Resolution. It was
seconded by Councilman Stettler and unanimously carried.
City Attorney Shea then read the newspaper notice of the coming
Savannah Beach Municipal election concerning the hours during
which the polls would be open, the dates and time for candidates
to qualify, etc. Councilman Stettler moved that this Notice be
approved. The motion was seconded and unanimously carried.
NEWSPAPER NOTICE
Mayor Counihan announced the receipt of $75,000 from the State
Parks Department, a part of the $419,000.00 State Grant, which
is to be used for pre- construction planning.
Mayor Counihan requested the reading of a Resolution in regard
to notices to be given both by the City and the new owners of
the property being used as a sanitary landfill in the event
either party would like to discontinue the landfill operation.
R E S O L U T I O N
Councilman Stettler moved the adoption of this Resolution. The
motion was seconded by Councilman Schwarz and unanimously carried.
Councilman Cary read a letter from Mrs. William Randolph, III in
Warrenton, Florida, complimenting the police department for the
good work performed during the wind high waters recently.
This was received as information.
There being no further business the meeting was adjourned to the
next regular or special called meeting.

R E S O L U T I O N
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF SAVANNAH
BEACH, TYBEE ISLAND IN COUNCIL DULY ASSEMBLED, AND IT IS HEREBY
RESOLVED AS FOLLOWS:
WHEREAS, the City of Savannah Beach is currently using
for sanitary land fill purposes the property owned by Mrs. Evelyn
Haar Mullens, such property being designated as a 17.8 acre, more
or less tract of land located within the City of Savannah Beach,
Tybee Island, north of the northern right of way of U. S. Highway
80 and bounded as follows: South by U. S. Highway 80; West by
lands of Hardaway Dredging Company; North by the Atlantic Ocean
and East by lands of Henry M. Buckley; and
WHEREAS, the said Evelyn Haar Mullens is currently in
the process of selling such property to Nathan Portman, Portman
Realty Company, 202 E. Hall Street in Savannah, Chatham County,
Georgia; and
WHEREAS, the said Nathan Portman, purchaser thereof, and
the City of Savannah Beach, Tybee Island desire that such sanitary
land fill operation be continued on said property in view of the
mutual benefits to be derived by both the City and said purchaser,
and that no charge be made by either the City or the purchaser for
the continuation of said sanitary land fill operation; and
WHEREAS, both the City and the purchaser thereof are
entitled to and shall have a period of time designated as 90 days
in which each shall give to the other written notification that
such sanitary land fill operation shall cease and discontinue.
NOW, THEREFORE, BE IT RESOLVED and it is hereby resolved
under the authority of the foregoing as follows:
1. The City of Savannah Beach, Tybee Island shall continue
to use the property hereinabove described as a sanitary land fill
operation at no charge or costs to it and with the express consent
and permission of said purchaser, Nathan Portman, Portman Realty
Company, 202 East„ Hall Street in Savannah, Georgia for an indefinite
period of time.
2. Both the City and Nathan Portman, Portman Realty Company,
202 E. Hall Street, Savannah, Georgia, shall have the right to dis-
continue and cease such sanitary land fill operation upon first
giving the other written notification of 90 days to either the
City at is address of Post Office Box 128, Savannah Beach, Georgia
or to Nathan Portman, Portman Realty Company, 202 E. Hall Street,
Savannah, Georgia.
The foregoing resolution is hereby adopted this 16th day of
February, 1972.

SAVANNAH BEACH ELECTION
Notice is hereby given in accordance
with the provisions of Section 34A -702 of
the Georgia Municipal Election Code that
the City of Savannah Beach, Tybee Island,
will hold a General Election on Monday,
April 3, 1972, from 7:00 a.m. to 7:00 p.m.,
for the purpose of electing a Mayor and six
Councilmen, and candidates are required
to qualify before 5:00 p.m. on Saturday,
March 4, 1972 in the office of the City Clerk
of the City of Savannah Beach, Tybee Is-
land, Georgia. No qualifying fee is re-
quired of any candidate.

RESOLUTION
A RESOLUTION BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH
BEACH, TYBEE ISLAND, GEORGIA, TO CONDUCT AN ELECTION FOR THE
OFFICE OF MAYOR AND SIX COUNCILMEN IN ACCORDANCE WITH THE APPLI-
CABLE LAWS OF THE STATE OF GEORGIA AND CHARTER OF THE MUNICIPALITY.
BE IT RESOLVED by the Mayor and Councilmen of the City of
Savannah Beach, Tybee Island, in Council duly assembled, and it is
hereby resolved as follows:
WHEREAS, in accordance with the provisions of Section 34A-
101 et seq. known as the ."Code of Georgia Municipal Election Code"
and in conformity with the provisions of Section Nineteen of the
Charter of the municipality, the city shall call an election for
the purposes of electing the Mayor and six Councilmen of the
municipality; and
WHEREAS, in accordance furthermore with the provisions of
Section Twenty -three and Twenty -four of the Charter of said
municipality various election offices are created and are to be
appointed by the governing body of the city in connection with
the conduct of said elections;
NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY RESOLVED
as follows:
1. That the City of Savannah Beach, Tybee Island, shall
conduct an election on April 3, 1972, from seven a.m. to seven p.m.
for the purpose of electing a Mayor: and six Councilmen to hold
office from the first Monday in July, 1972, until the first Monday
in July, 1974, or until their successors have been duly elected
and qualified.
2. The Municipal Election Superintendent of said election
shall be Shelby Myrick, Jr., , who is authorized to incur expenses
for the preparation and conduct of such election as authorized by
Section Twenty -four of the Charter of the municipality.
3. Furthermore, the governing body of said city does hereby
appoint the following poll officers to conduct and assist the
Municipal Election Superintendent in such election.

The foregoing resolution is adopted in open Council duly
