A SPECIAL ORDINANCE VACATING THE PUBLIC PLACE DESCRIBED
AS 17 FEET IN EQUAL WIDTH EAST OF THE ENTIRE EAST SIDE OF
LOT NUMBER 48 IN M. PARRY'S ADDITION TO GREENWOOD, NOW
A PART OF THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA.
Whereas Marvin Jett has petitioned Common Council of Richmond, Indiana,
requesting the vacation of the public place described as 17 feet in equal
width east of the entire east side of Lot Number 48 in M. Parry's Addition
to Greenwood, now a part of the City of Richmond, located at the
northwest corner of South M and 1 lth Streets, the same being Vacation
Petition No. 8-1997, and
Whereas all of the owners of all land abutting the above described public way
have 3oined in said petition requesting vacation, and
Whereas the abutting land owners have waived notification by the City Clerk as
required by statute, and
Whereas said Council, pursuant to Indiana Code 36-7-3-12, conducted a public
hearing on said petition October 6, 1997, after publishing legal notice
thereof at least 10 days in advance of said hearing as required by statute,
and
Whereas the Richmond Advisory Plan Commission, pursuant to Richmond Code
155.04(b), conducted a public hearing on said petition September 25, 1997,
after publishing legal notice thereof at least 10 days in advance of said
hearings as required by ordinance, and
Whereas it is desirable to vacate said public way,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, that subject to the preservation of easements for existing utilities, the public way
described below is hereby vacated and the abutting property owners shall acquire
ownership of the land heretofore dedicated as a public way as indicated below, to wit:
The public place described as 17 feet in equal width east of the entire east side of
Lot Number 48 in M. Parry's Addition to Greenwood, now a part of the City of
Richmond, located at the northwcst corner of South M and I 1 th Streets.

VACATION PETITION NO. �Z/ -1997
A PETITION TO VACATE A PUBLIC PLACE
Comes now the owner of the real estate abutting the east end of a public place
more particularly described herein and, pursuant to Indiana Code 36-7-3-12, petition for
vacation of said public place.
The public place to be vacated is shown in yellow on attached Exhibit A and is
described as 17 feet in equal width east of the entire east side of Lot Number 48 in M.
Parry's Addition to Greenwood, now a part of the City of Richmond, Wayne County,
Indiana.
The public place to be vacated is of no use to anyone except the undersigned
owner of Auditor's Map No. 50-09-110-317.000-29, who currently maintains said public
place.
The undersigned owner hereby waives notice of the filing of this petition from the
Clerk of Richmond Common Council as required by Indiana Code 36-7-3-12(c) because
the undersigned is the owner of all land that abuts the property proposed to be vacated.
Wherefore, the undersigned owner requests that the City of Richmond Common
Council adopt an ordinance vacating said public place.

RE: Vacation Petition No. 8-1997 (Ordinance No. 96-1997)
Dear Mr. Dickman:
Please advise the members of Common Council that the Richmond Advisory Plan
Commission conducted a public hearing, Thursday, November 20, 1997, on the
petition to vacate the public place described as 17 feet in equal width east of the
entire east side of Lot Number 48 in M. Parry's Addition, located at the northwest
corner of South M and llth Streets.
The owners represent that:
(1) The additional right-of-way is not necessary to promote adequate and proper
traffic flow; and
(2) There are no plans or circumstances under which the future use of said public
way would be necessary; and
(3) The requested change would provide clear title for the property without
creating any practical effect.
No one returned written comments against the request, nor did anyone appear at
the hearing to speak against the petition.
The Commission voted 9 in favor and none opposed, with 2 absent, to recommend
the passage of Vacation Petition No. 8-1997 and Ordinance No. 96-1997.

Dear Council Member:
This ordinance relates to vacating the public place described as 17 feet in equal width east of the
entire east side of Lot Number 48 in M. Parry's Addition to Greenwood, now a part of the City of
Richmond, located at the northwest corner of South M and 11th Streets, Wayne County, Indiana.
The ordinance should be referred to Plan Commision for public hearing at its meeting on
November 20, 1997.
The ordinance should be back to Council for second reading on December 1, 1997.
