The Board of Trustees of the City of Beauatont dol ordain as follows: -- Section 1. There shall be and is hereby eetablisYed in the City of Beaumont a Pound to be looated at such place as the Poulndmaster shall from time to time select. Section 2. The running at large of any horde, mulls, donkey, Kine, hog, sheep, goat or eattld of any kind within or upojn any street, avenue, alley or any public plane in the City of Beaumont Glared to be a nuisance, and it shall be unlawful for the is hereby de- pwner or per- son in ehaltge of any such animal to suffer or permit the Same to run at large in or upon any such street, avenue, alley or public place with- in said City, • Section 3. It shall be the duty of the Poundmaste* to take up and safely keep in the Pound any animal mentioned in the plreoeding sea - tion that may be found at large within the City limits in any street, avenue, alley or public place, but he shall not take up ani animal that is in the immediate charge of any person who is driving it in or through said City, Section 4. The Poundmaster shall receive the follCwing fees and charges from the owners redeeming animals so impounded or From the pro- ceeds of the, sale thereof, viz: - ?or taking and impounding each animal mentioned sin section 2 of this ordinance, *1.00. For feeding and keeping each horse, mare, gelds , bull-, steer oow, mule or donkey, fifty cents for each day4\the same shall remain in his custody, and for feeding and keeping any other animal thirty five cents for each day the same shall remain ,.in his cu:"ltody. 1 For adYertising each notice of sale of any such animal , one dollar together with the cost of publication. For selling any such animal a commission of five per cent on the gross proceeds of the sale. Section 5. Any impounded animal may at any time be redeemed and taken away upon payment to the Poundmaster of such fees and charges aw may have already accrued. Section 6. Within not less than two nor more than ten days from the impounding of any such animal the Poundmaatershall gil►e notice by publication in some newspaper published in said City by one insertion of such notice therein, giving a description of each animal impounded with the natural and artificial marks or brands if any, and than if such an- imal or animals be not sooner r;deemed the Poundmaster wil:L at a time and place named in the notice sell such animal or animals Fit public auc- tion to pay the charges and costs as provided in this ordinance. If no redemption be made the Poundmaster shall sell such animal car animals at the time and place stated. Every such sale shall be for each and shall take place between the hours of ten o'clock A. M. and two Ocloak P. M. on a day not less than five nor more than ten days after the publication of the notice. Upon receiving the purchase money the Poundmaster shall deliver to the purchaser the animal or animals with a•bill of sale sign- ed by himself as Poundmaster. Section 7. The Poundmaster shall pay the balance of all money received on any such sale after deducting the costs, , charges and expen- ues of sale as provided in this ordinance to the City Treasurer for the use of the owner of the animal or animals sold if claimed within six months thereafter. If not so claimed said balance shall be applied to the use of the general fund of said City. Section 8. Tho4City Marshall shah be ex --officio the Pound - master of the City of Beaumont. The Poundmaster shall keep a book in which he shall enter a descrip- tion of each animal impounded, with brand or marks, if any, the time when, and the place where tar up, the date redeemed and by whom, the amount paid, the costs, charges and expenses, the date it was sold, to whom sell, and the pride, the paper in which notice of sale was given, and the date and duration of such notice and the balance paid to the City treasurer. Such book shall be accessible to all persons at all reasonable hours and shall rP delivered by the Poundmaster to his suc- cessor in office. Section 9. Any person who shall interfere with, op:,?ose opt re- sist the Poundmaster or any of his assistants or deputies tTrJAile engaged in performing any duty imposed by this ordinance or shall without the permission of the Poundmaster remove or take away any animal from the Pound, or remove any fence, bar or barrier, or open any gale for the purpose•of enabling any animal to escape from the Pound shall be guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not ]less than five dollars and not more than fifty dollars or by imprison- ment in the City jail for a period not exceeding ten days ger by both such fine and imprisonment.
