HomeMy Public PortalAboutOrdinance 83ORDINANCE NO. 83 AN ORDINANCE OF THE CITY OF BEAUMONT CALLING A SPECIAL ELECTION TO BE FIELD IN THE CITY OF BERUMONT ON THE 9DAY OF JANUARY, 1923, AND SUBMITTING TO T� QUALIFIED VOTERS OF SAID CITY THE PROPOSITION OF INCURRING INDEBTED - NESS FOR THE CONSTRUCTION AND COMPLETION BY SAID CITY OF A CERTAIN MUNICIPAL IMPROVEMENT, TO -WIT: CERTAIN STREET WORK CONSISTING OF GRADING AND PAVING A PART OF THE SURFACE OF PORTIONS OF CERTAIN STREETS AND AVENUES IN THE CITY OF BEAUMONT, INCLUDING THE CONSTRUC- TION OF THE NECESSARY CULVERTS, CROSSINGS AND GUTTERS THEREON AND THEREUNDER, PROVIDING FOR THE ISSUANCE OF BONDS THEREFOR AND PROVIDING FOR ONE ELECTION PRECINCT IN SAID CITY, DES- IGNATING THE POLLING PLACE AND APPOINTING THE ELECTION OFFICERS FOR SAID ELECTION. WHEREAS, the Board of Trustees of the City of Beaumont, being the legislative body thereof, at its regular meeting held on the 10th day of November, 1922, by a vote of two- thirds of its members, duly passed and adopted a resolution determining that the public interest and necessity demand the construction and completion by the City of Beaumont of a certain municipal improvement, to -wit: Certain street work consisting of grading and paving a part of the surface of the following portions of certain streets and avenues in the City of Beaumont, California, to -wit: West Fifth Street from the west line of Veile Avenue to the east line of California Avenue; Egan Avenue from the right of way of the South- ern Pacific Railroad to West Sixth Street; West Sixth Street from the west line of Egan Avenue to California Avenue; Grace Avenue from West Fifth Street to Calif- ornia Avenue; California Avenue from West Fifth Street to Sixth Street; Sixth Street from the west line of California Avenue to the east line of Beaumont Avenue; Beaumont Avenue from Sixth Street to Fourteenth Street; including the construction of the necessary culverts, crossings -1- and gutters thereon and thereunder; that the said improvement is necessary and convenient to carry out the objects, purposes and powers of the said City of Beaumont; that the estimated cost of said improvement is $52,000.00; that the cost of said Improvement is and will be too great to be paid out of the ordinary annual income and revenue of said City. NOW, THEREFORE, the Board of Trustees of the City of Beaumont do ordain as follows: Section 1. It having been determined and declared by the resolution that the public interest and necessity demand the construction and completion by the City of Beaumont of a certain municipal improvement, to -wit: Certain street work consisting of grading and paving a part of the surface of the following portions of certain streets and avenues in the City of Beaumont, California, to -wit: West Fifth Street from the west line of Veile Avenue to the east line of California Avenue; Egan Avenue from the right of say of the South- ern Pacific Railroad to West Sixth Street; West Sixth Street from the west line of Egan Avenue to California Avenue; Grace kvenue from West Fifth Street to Calif- ornia Avenue; California Avenue from West Fifth Street to Sixth Street; Sixth Street from the west line of Calif- ornia Avenue to the east line of Beaumont Avenue; Beaumont Avenue from Sixth Street to Four- teenth Street; Including the construction of the necessary culverts, crossings and gutters thereon and thereunder; that the said improvement is necessary and convenient to carry out the objects, purposes and powers of the said City of Beaumont; that the estimated cost of said improvement is $52,000.00; that the cost of said improvement is and will be too great to be paid out of the ordinary annual income and revenue of said City. -2- It is hereby further determined and declared that the Board of Trustees of the City of Beaumont propose to incur a bonded debt to pay the cost of the construction and completion of said municipal improvement and to issue and sell the bonds of the City of Beaumont to pay the cost thereof; Section 2. The object and purpose for which the indebtedness is proposed to be incurred is to pay the cost of the construction and completion of said municipal improvement described in Section 1 hereof; Section 3. The estimated cost of the construction and completion of said municipal improvement described in Section 1 hereof is $52,000,00; that the amount of the principal of the indebtedness to be incurred therefor is the sum of $52,000.00, and that the maximum rate of interest to be paid on the prinet- pal of said indebtedness is 699 per annum, payable semi - annually. Section 4. The Board of Trustees of the City of Beaumont hereby orders the submission of the above stated pro - position incurring bonded indebtedness by the City of Beaumont for said purpose, and in the mount above stated, to the quali- fied voters of the City of Beaumont, and for that purpose a special election is hereby called and ordered to be held at and within the Ctty of Beaumont, on Tuesday, the 9th day of January, 1923, which day is hereby fixed as the date on which said elec- tion shall be held. Section 5. The polls for said election shall be opened at six o'clock of the morning of the day herein fined as the day of said election, and shall be kept open until seven o'clock of the afternoon of the same day when the polls shall be closed; provided, however, that if at the said hour of clos- ing there are any voters in the polling place or in line at the door thereof, who are qualified to vote and have not been able to do so since appearing, the polls shall be kept open a suf- ficient time to enable them to vote, but no one who shall arrive -3- at the polling place after seven o'clock in the afternoon shall be entitled to vote, although the polls may have been open when he arrives. The ballot to be used at said election shall be printed in substantially the following form: "Mark Crosses (X) on ballot ONLY WITH RUBBER STAMP: Never with pen or pencil. INSTRUCTIONS TO VOTERS. To vote on the proposition stamp a cross (X) on the voting square after the word "Yes" or after the word "No" ALL MARKS EXCEPT THE CROSS (X) ARE FORBIDDEN. ALL DISTINGUISHING MARKS OR ERASURES ARE FORBIDDEN AND MAKE THE BALLOT VOID. That for the holding of said election the City is and every precinct therein is hereby districted and con- solidated into one election precinct, to be 'mown as Municipal Election Prec'_!cint No. 1„ The following is a description of said precinct and the polling place therein and the following named persons are hereby appointed officers for such election precinct, being registered qualified electors therein. MUNICIPAL ELECTION PRECINCT NO. 1. The boundaries of the Municipal Election Precinct No. 1, shall be coincident with the boundaries of the City of Beaumont, and all of the City of Beaumont shall constitute said Municipal Election Precinct No. 1. Polling Place: Office of W. A. Sewell, Justice of the Peace, on Egan Avenue, in the City of Beaumont. Inspector: W. L. Percy. Judges: Fred Stahl and A. L. Davis. Clerks: Mrs. Minnie Dunlap, Mrs. Lenora Anderson, and -)4 . g sue_ If any of said persons do not appear at the opening of the polls, the qualified electors present, including members of the board, shall appoint in his or her place one who is qx alified. Section 7. That in all particulars not recited in this ordinance, such election shall be held as provided by law for holding municipal elections in said City. Section 8. The Board of Trustees of. the City of Beaumont will meet to canvass the votes of said election on Monday, the 15th day of January, 1923, at 7:30 o'clock P.M. of said day at their place of meeting at the office of W. A. Sewell, Justice of the Peace, on Egan Avenue, in the said City of Beaumont. -5- Section 9. The City Clerk shall certify to the passage and adoption of this ordinance by a vote of two- thirds of all the members of the Board of Trustees, and cause the same to be published once a week for two weeks in the "Beaumont Leader ", a newspaper printed, published and circulated less than six days a week i_n said City, and one i nserti_on each week for two successive weeks shall be sufficient publication in such newspaper. GREEN, Clerk of the City of Beaumont, hereby certify that the foregoing ordinance, being Ordinance Number 83, was i.ntroduced at a regular meeting of the Board of Trustees of the City of Beaumont held on the 17th day of November, 1922, and was passed and adopted by a vote of more than two- thirds of all the members of said Board of Trustees, signed by the President of said Board and attested by the Clerk of said City at a regular meeting of said Board of Trustees, held on the Iday of 1922, and that the same was passed by the following vote: AYES: ABSENT: L - --
