' w6 AN ORDINANCE REGULATING THE COTJ.I+,CTION O G RB GE The City Council of the City of Beaumont do ordain as follows: Section 1: The word "garbage" as used herein shall mean and include all animal and vegetable refuse and household waste which shall have been prepared for or intended to be used for food, and all animal and vegetable refuse from places where food stuff intended for human consumption are handled commercially. Section 2: The word "rubbish* as used herein shall mean and include all refuse other than garbage, including papers, rags, leaves, grass, vines, saw -dust, sweepings, plaster, cement, glass, crockery, metals, cans, ashes and tree trimmings. Section 3: It shall be unlawful for any person in possession of or having charge or control of any boarding house, lodginghouse, restaurant, hotel, apartment, or eating house, or flat, or dwelling house, within the City of Beaumont to keep or deposit any garbage on any premises in said City, except in a v ter-tighu meta-32ic c- --ar- meta. -lined box., with suitable bail or handles and tight fitting cover, with a capacity of not less than11allona and not to exceed 450 gallons, or to bury any garba c, or to keep or deposit any rubbish on any premises in the City of Beaumont for a longer time than may be reasonably necessary for purposes of destruction or burial of such rubbish, and no such person shall throw or deposit any rubbish or garbage on any alley, sidewalk, or street, other than in such receptacles* -A Section 4: at le, it - eek, and as often as may be necessary to keep sid receptacle from over -flowing, the contents thereof must be delivered to some responsible person to be hauled and carried away from said premises and to he disposed of according to law. Section 5: It shall be unlawful for any peraon to move or carry through any public street or alley of the City of Beaumont any garbage or rubbish except in vehicles havinmetallic or metal - lined beds, and the grVbage or rubbish shall be so loaded that none of it shall fall, drop -or spill upon the ground. Every vehicle used in the .:fork of collecting and disposing of garbage r and rubbish shall be kept clean. Section 6: P'At such times as there is in force a contract entered into by the City of Beaumont with any person, firm or corporation for the collection and disposal of garbage and rubbish in the City of Beaumont, it shall be unlawful for any person other than the contractor, or a person or persons in the employ of such contractor, to collect any garbage or rubbish within the City of Beaumont, or to remove or carry any garbage or rubbish through any public street or alley of the City of Beaumont; provided, however, that the word "garbage" as used herein shall not include what is commonly termed "swill" from .1riy boarding house, restaurant or hotel. Provided Further that any peraon other than said contractor removing such "swill" must first obtain a permit from the it of the City of Beaumont, and. the said have the power -to grant permits fur the removal of such swill only after he shall have satisfied himself that the applicant is properly equipped to remove and handle such swill in.a satisfactory manner. Section 7: The rates; fp collection of garbage and rubbish to be charged by the contractor shall betas follows: For all private residences in the City of Beaumont, �? collection per week, 50 cents per auonth; and for each additional collection per week 25 cents per month; For apartment houses and flats where one garb ,,ge can and_ 41.4 one receptacle for rubbish are used in coimnon oiiections per week, for each apartment or flat,, cents per .month; and for each additional collection per week, for each apartment or flat, ' 5)6- cents per month;' For apartment houses and flats, where separate garbage cans are used, AJC collections ;ger week, for each apartment or flat, cents per month; and for each additional collec- tion per week, for each apartment or flat, five cents per month. ]?or unusual accumulations of garbage or rubbish, and for places not herein otherwise provided, such rates shall be charged as may be agreed upon between the garbage collector and the person from whom suer'. garbage is collected; provided, that in all cases ;there dispute axises- as to the rate charged or to be charged for any service provided in this ordinance, the matter shall be re- ferred to the City Council of the City of Beaumont, and the City Council shall, upon due investigation,' determine and fix such price as it may deem just and equitable and the determination of the City Council thereon in all cases shall be final and conclu- sive. Section 8: The contractor shall pay to the City of Beaumont, monthly, on the first day of the month, __ a of the gross revenue collected by or for the contractor during the pre- ceding month for the collecting and disposal of rubbish and garbage. Section 9: Any person violating any of the provisions of this ordinance shall de deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not exceeding Three Hundred Dollars (4300.00), or by imprisonment in the City Jail of the City of Beaumont, or the County Jail of the County of riverside, for a period not exceeding three months, or by both such fine and imprisonment. Section 10: The Clerk shall certify to the adoption of this ordinance and shall cause the same to be published once in the Beaumont Gazette, a newspaper of general circulation, printed published and circulated in the City of Beaumont, and thirty days after its adoption, shall be in full force and effect. aDOPTED this -25- day of 6 � , 1934. attest: r of the ty of - aumont. rL L Clerk.
