HomeMy Public PortalAboutOrdinance 1601 ORDINANCE NO i64 5 AN ORDINANCE OF THE CITY OF BEAUMONT REPEALING ORDINANCE NO. 105, ADOPTED JULY 26, 1925, AND PROVIDING FOR SALE AND 6 DISTRIBUTION OF MILK FOR HUMAN CONSUMPTION, FEES FOR MILK IN- SPECTION SERVICE, AND PENALTIES FOR VIOLATIONS THEREOF. 7 THE CITY COUNCIL OF THE CITY OF BEAUMONT DO DORDAIN AS FOLLOWS: 8 Section 1. That it shall be unlawful for any person, 9 firm, corporation or association, to sell, offer for sale, distribute, or have in his, her or its possession for sale 10 or distribution, any milk for human consumption that has not been inspected, graded and labeled in compliance with and 11 in acoordance with the laws of the State of California, or does not conform at least to the standards and requirements 12 of the laws of the State of California providing for and defin- ing Grade A milk. Section 2. That it shall be unlawful for any person, firm, 1.4 association or corporation to sell or distribute or offer for sale or distribution or have in his, her or its possession, 15 in the City of Beaumont, milk for human consumption, without first obtaining a permit so to do, and paying a fee of $0.00275 16 per gallon, payable on the first day of each and every month, for all milk sold or distributed for human consumption, not 17 less however than $1.00 per month, which minimum fee is hereby set and established, Application for said permit shall be made 18 to the City Clerk, and each applicant shall before said permit /.3 1554,,a4 siss14 make aff idavit as to the number of gallons of milk sold 19 or distributed for the month preceding the application, on which statement the amount of fee shall be based and computed. 20 The Clerk shall issue a receipt for all fees paid, and such receipt shall congtitute said permit. Section 3. That the City of Beaumont may organize its 22 own milk inspection service or contract with any milk inspec- tion service approved by the Director of Agticulture of the 23 State of California for milk inspection for the City of Beaumont, 24 Section 4. That this ordinance shall not be construed to conflict with any of the provisions of Ordinance No, 141 25 of the City of Beaumont as amended. 13 21 26 Section 5. That Ordinance No. 105 of the City of Beaumont, adopted July 26, 1925, be and it is hereby repealed. Section 5. That for the purpose of holding the said 5 election there shall be one consolidated voting precinct in said 6 City, which consolidated voting precinct shall be designated 7 "Consolidated Voting Precinct A" and shall embrace all the 8 area within the boundaries of the City of Beaumont. The polling place in said Consolidated Voting Precinct A shall 10 be at the City Hall building, in said city, and the persons 11 hereinafter named, being competent and qualified electors and 12 residents of said city and of said consolidated voting prec indt , 13 are hereby appointed officexsof election' for the said consolidated 14 voting precinct and they shall hold said election and make re— it') turn thereof in the manner provided by law. INSTRUCTIONS TO VOTERS: To vote on any question, proposition or constitutional amendment, stamp a cross (X) in the voting square after the word "Yes" or after the word "No." All marks, except the cross (X) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. A cross (X) stamped in the voting square after the word "Yes" shall be counted in fagor of the adoption of the question or paoposition and for the issuance of the bonds. That the objects and purposes for which said 5 indebtedness is proposed to be incurred and bonds issued therefor 6 are as follows: 7 PROPSOTION: The acquisition, construction and completion 8 of a municipal building and acquisition of the land necessary 9 therefor. 10 Seotion 3. That the estimated cost of the proposed muni- 11 cipal improvement described in the proposition stated in Section 12 2 hereof tc said city is FIFTY THOUSAND DOLLARS ($50,OOO,00); 13 that the amount of the principal of the indertedneas to be 14 incurred therefor is the sum of FIFTY THOUSAND DOLLARS 15 ($50,000,00), and that the maximum rate of interest to be paid 16 on said indebtedness shall be six per cent per annum, payable 17 semi--annually. 18 That if the proposition to incur said indebtedness for 19 said purpose so submitted receives the requisite number of 20 votes, to wit, two—thirds of the votes of the qualified 21 electors voting at said election on such proposition, bonds of 22 said city in not exceeding the principal amount of FIFTY 23 THOUSAND DOLLARS (t50,OOO.00) shall be issued and sold for the 24 objects and purposes aforesaid. --25 Section 4.
