ORDINANCE OF THE CITY OF BEAUMONT, CALIFORNIA, PROVIDING
FOR'MILK AND DAIRY INSPECTION AND PENALTY FOR VIOLATION
THEREOF AND REPEALING OF ORDINANCES CONFLICTING THEREWITH.
THE CITY COUNCIL OF THE CITY OF BEAUMONT DO ORDAIN
AS FOLLOWS:
SECTION 1. It shall be unlawful for any person,
firm, or corporation to in the City of Beaumont sell, offer
for sale, distribute or possessfor sale or distribution,
any milk or cream for human consumption as milk or cream un-
less it conforms to the standards of, and requirements for
the production of, milk or cream provided by Division IV of
the Agricultural Code of the State of California and such
other requirements as may hereafter be provided by due process
of legislative enactment.
SECTION 2. It shall be unlawful for any person,
firm, or corporation, or agent or employ of the aforesaid,
to bring or receive into the City of Beaumont, for sale or to
sell, offer for sale, or have in possession for the purpose
of sale or distribution for human consumption within the City
of Beaumont, any milk or cream, unless such person, firm or
corporation shall first have obtained a permit so to do from
the Health Officer of Riverside County, as provided in Divi-
sion IV, Chapter 2, Section 492 of the Agricultural Code, and
the rules and regulations for its enforcement promulgated by
the Director of Agriculture. Said permit shall be applied for
in writing and upon a for supplied for that purpose by the
Health Officer, and all information required and so indicated
upon said for shall be given by the applicant in writing
therein.
SECTION 3. The Health Officer, upon notice and
hearing., and upon finding that the standarde of grading milk
or cream, or the requirements for the production of milk or cream
herein established, have been violated, may revore such permit.
SECTION 4. No milk or cream, intended for human
consumption within the City of Beaumont shall be sold or offered
for sale which is not produced on dairies that score at least
eighty (80) on the form provided for dairy inspection by the
Department of Agriculture of the State of California. No milk
sold or offered for sale for human consumption within the City
of Beaumont shall have a butter fat content of less than three
and five -tenths per cent (3.5) by volume as determined by
the Babcock teslt,
SECTION 5. Any person violating any of the pro-
visions of this Ordinance shall be deemed guilty of a mis-
demeanor, and upon conviction thereof shall be punished by a fine
of not less than twenty-five dollars (25.00) nor more than
three hundred dollars (000.00), or by imprisonment in the county

jail for not less than ten (10) days nor more than ninety (90)
days, or by both such fine and imprisonment.
SECTION 6. All ordinances or parts thereof in con-
flict herewith are hereby repealed .
SECTION 7. The City Clerk will certify to the passage
of this ordinance ana aaail cause the same to be published
once in the Beaumont Gazette, a weekly newspaper of general
circulation, printed, published and ciroulatea in the City
of Beaumont, and thirty days after its adoption it shall be
in full force and effect.
