AN ORDINANCE OF THE CITY OF BEAUMONT,
GRANTING TO SOUTHERN PACIFIC RAILROAD
COMPANY, A CORPORATION, AND SOUTHERN
PACIFIC COMPANY, A CORPORATION, ITS
LESSEE, THEIR SUCCESSORS AND ASSIGNS,
THE RIGHT TO CONSTRUCT, RECONSTRUCT,
MAINTAIN AND OPERATE THEIR RAILROAD
TRACK UPON AND ACROSS PENNSYLVANIA
AVENUE IN THE CITY OF BEAUMONT.
THE CITY COUNCIL OF THE CITY OF BEAUMONT DO ORDAIN AS,
FOLLOWS:
Section 1, That the right, privilege and franchise be
and the same is hereby granted to the Southern Pacific Railroad
Company, a corporation, and Southern Pacific Company, its lessee,
their successors and assigns, to construct, reconstruct, maintain
and operate for a period of fifty -years their standard gauge
railroad track upon and across Pennsylvania Avenue in the City of
Beaumont, along the route, the center line of which is described as
follows:
Beginning at a point in the westerly line of
Pennsylvania Avenue distant thereon 86 feet
northerly from the southerly line of Southern
Pacific Companyts right of way; thence easter-
ly parallel with said southerly line a dis-
tance of 80 feet more or less to a point in
the easterly line of said Pennsylvania Avenue.
Section 2. That the line of its said track across the
said avenue hereinbefore named shall conform in all cases to the
established grades of said avenue where such grade, before the
same shall be laid, have been established; and in all other cases
the said track shall conform as nearly as practicable to the natural
grade of the avenue over and across which it may be constructed.

Section 3. It is further made a condition hereof that
the City of Beaumont expressly reserves the right to grade sewer,
pave, macadamize, repair, improve or alter said street or any part
thereof, and to lay down pipes for water, gas, or other purposes
therein, all such work to be done by said city in a manner to injure
or obstruct the track and business of said railroad company as little
as possible, and in no case so as to endanger said railroad or the
operation of trains thereon.
Section L.. The track shall be kept constantly in repair
at all crossings flush with the streets, and paved or planked bet«
ween lines two feet outside of the outside rails.
Section 5, That the cars upon said railroad track shall
not be allowed to extend from the street intersection in such
manner as to unnecessarily obstruct the use of said street by
vehicles or pedestrians.
Section 6. That the grantee hereof, by the acceptance of
this franchise, hereby agrees to pay to the City of Beaumont the
expenses necessary for the publication of this ordinance in the
manner required by law.
Section 7. That the grantee hereof shall file with the
City Clerk a written acceptance of the franchise hereby granted
within thirty days after the passage of this ordinance.
Section 8, The City Clerk shall certify to the passage
of this ordinance by a two-thirds vote of all members of the City
Council of the City of Beaumont, and shall cause the same to be
published once in the , a newspaper
of general circulation printed and published daily in said City of
Beaumont, and thereupon and thereafter it shall take effect and be
in force.
