Savannah Beach, Georgia
August 16, 1972
The Regular Monthly Meeting of City Council was held this afternoon
at 3 :00 P.M. in City Hall and was presided over by Mayor Michael J.
Counihan with the following members of Council present: James
Stettler, Robert F. Cary, Edward Towns, Perry A. Zittrauer, Jr.,
George Schwarz and Edward Jung. City Attorney Bart E. Shea was
also present.
Visitors at the Meeting were Mr. Jim Fabrikant, Mrs. Carolyn Golden
of the Interested Voters Association and Mr. Earl Anderson.
Minutes for the Meetings of June 21, 1972 and July 19, 1972, were
approved as written,
Bills for the various departments were approved for payment.
City Attorney Bart Shea read for the second time, the amendment
to the alcoholic beverage Ordinance, the purpose of which is to
re- define the time and hours during which alcoholic beverages
may be sold. Attorney Shea explained that what this amendment
does generally is to follow the language of the State Code which
says that alcoholic beverages may not be sold after Midnight, It
does not say that places that may have food or other things to
sell, must close at Midnight.
ORDINANCE
Councilman Zittrauer moved that this amendment be adopted on second
reading. The motion was seconded by Councilman Cary and unanimously
carried.
Attorney Bart Shea informed Council that a petition, resolution
and quit claim deed had been received from Mr. John Brennan,
attorney for Mr. John Kuhne and Helen Kuhne, requesting that Lot
34, Pamela Terrace Subdivision which was sold for taxes in 1970;
and on which all back taxes, penalties and other charges had now
been paid, be quit claimed back to them. He then read the
following Resolution:

was seconded by Councilman Stettler and unanimously carried.

sea wall and the Strand Line; from 15th to 16th Streets, a parking
area and thoroughfare. Then you would still have valuable
ocean -front property which could be sold to developers for the
same amount that was paid for the whole tract; thereby, getting
this valuable piece of property at no cost to the City. The Clerk
then read a portion of a recent appraisal of this property the City
proposes to keep, This appraisal was done by Charles Steward and
Associates and they placed a value of $82,500.00 on this portion.
Mayor Counihan stated that the City needed this piece of property
very badly in order to connect the two parking areas. In further
defense of the purchase of this property, Mayor Counihan stated
that the present Council voted unanimously for the purchase of
this property and he is happy that he went along with them because
he feels that they made a great buy for something the City has been
needing for a long time,
Councilman Cary informed Council that Mr. Aliffi was endeavoring
to develop some property in the Fort Screven area which was
formerly owned by Mrs. Naylor and is running into some trouble
due to the new zoning ordinance. Mr. Cary then called on Mr. Earl
Anderson to explain Mr. Aliffi's problem to Council. Mr. Anderson
explained that Mr, Aliffi had bought some property in Fort Screven
in our R -1, prime residential area, which calls for a building lot
to be 12,000 sq. ft. He stated that if this were virgin territory,
this large area requirement would be alright. He stated further
that the only way we could help Mr. Aliffi would be to amend the
Ordinance so that there would be some sections of this area where
the lot size would not be this great; such as R1 -a., R1 -b, R1-c,
etc. each one of these classifications carrying a lower area
requirement. Mr, Anderson informed Council that he was helping to
prepare an amendment at the present time which will modify some of
the more restrictive requirements in our present zoning ordinance
and thereby give Mr. Aliffi some relief. Mayor Counihan asked Mr.
Anderson what Mr. Aliffi should do to get some relief now. Mr.
Anderson stated that Mr. Aliffi should put in a rezoning request
which will have to be advertised, the land posted, and a public
hearing held, at which time a decision would be made on the request
for a zoning change.
There being no further business, the meeting was adjourned to the
next regular or special called meeting.

COUNTY OF CHATHAM ) A RESOLUTION
WHEREAS, the election Superintendent, in accordance with
the provisions of an order of the Honorable Paul E. Caswell, Judge,
Atlantic Judicial Circuit, presiding, dated July 18, 1972, calling
for a special run -off election for August 31, 1972 for purposes
of electing a Myor and six Councilmen of the Municipality of the
City of Savannah Beach, Tybee Island, Georgia, to hold office until
the first monday in July, 1974, or until their successors have
been duly elected and qualified, has conducted said special second
run -off election and has made the consolidated return of the
results of said special election by resolution to the Mayor and
Councilmen of the Municipality; a copy of such certified return
being attached hereto; and
WHEREAS, it appears that William Allen Hendrix has
received the highest number of votes for the office of Mayor
of the City of Savannah Beach, Tybee Island, Georgia; and
WHEREAS, Ernest C. Hosti; Walter Parker; Edward W. Towns;
Edward Jung; Earl Anderson and Perry Zittrauer, Jr., have received
the highest number of votes for the six Councilmen of the City of
Savannah Beach, Tybee Island, Georgia;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen
of the City of Savannah Beach, Tybee Island, Georgia, in Council
duly assembled and it is hereby resolved by the authority of the
same, that the results of said election be, and the same are,
hereby certified and declared as electing:

officially made a part of this resolution and the minutes of
said Council meeting.

I, the undersigned, who was duly appointed as election
Superintendent of the second special run -off election for Mayor
and Councilmen of the City of Savannah Beach, Tybee Island,
Georgia, by order of the Honorable Paul E. Caswell, Judge,
Atlantic Judicial Circuit, presiding, the same being an order
entered in Michael J. Counihan vs. William Allen Hendrix,
et al, civil action 8256, and Karen Losey vs. Michael J. Counihan,
et al, civil action 8260, dated in open court, July. 18, 1972,
calling said special election for August 31, 1972; the undersigned
having conducted said second special run -off election on August 31,
1972, in accordance with the provisions of the Georgia Municipal
Election Code and contents of provisions of said order dated July
18,1972 as well as the laws of the State of Georgia applicable
thereto, and I do hereby certify that said second special run-
off election was held on August 31, 1972 in accordance with such
court order and laws, and that the following candidates received
the number of votes set forth opposite their names for said
offices in such election.

I, THEREFORE, CERTIFY that William Allen Hendrix has received
the highest number of votes cast for any candidate for Mayor of the
City of Savannah Beach and that Ernest C. Hosti; Walter Parker; Edward
W. Towns; Edward Jung; Earl Anderson aid Perry Zittrauer, Jr., have
received the highest number of votes for six offices of Councilmen.
