AN ORDINANCE REGULATING TIIJ COLT) CTION OF GARBAGE.
T iE CITY COUNCIL OF THS CITY OF BEAUPvMONT DO ORDAIN A5 FOLLOWS:
Section to The word "garbage" as used herein shall mean and include
all animal and vegetable refuse and household waste which shall have
been prepared for or intended to be used for food, and all animal and
vegetable refuse from places where food stuff intended for human
consumption are handled commercially.
Section 2. The word "rubbish" as used herein shall mean and include
all refuse other than .garbage, including rags, sweepings, plaster,
cement, glass, crockery, metals, cans and ashes.
Section 3. (a) It shall be unlawful for any person in possession of
or having charge or control of any boardinE, house, lodgin;_=house,
restaurant, hotel, aparti:iient, eating house, flat or dwelling house,
within the City of Beaumont to ee;D or deposit any garbage on any
premise s in said City, except in a suitable container with bail
or handles and tight fitting cover, with a capacity of not less than
four and a half (4,-) _salons and not to exceed thirty (30) callons,
or to bury any F.arbae ut any tiiiie, or to keep or deposit any rubbish
on any premises in the City of Heaumont for a longer time than may be
reasonably necessary for purposes of destruction or burial of such
rubbish, and no such ;person shall throw or deposit any rubbish or
garbage on any alley, sidewalk, or street, other than in such
receptacle.
(b) All garbage shall be placed in covered container, all
rubbish in separate container, and alltin cans and other metalic
articles shall be placed in separate container.
(c) It shall be unlawful to place broken L1ass of any kind
in container with y_•arba€.e or swill.
(d) It shall ue the duty of any resident to either burn or
otherwise dispose of all paper, leaves, rays, vines, saw -dust, and
tree trimmings or employ the Garbage Collector, 4ith additional fee
to be levied by the Collector to haul away such paper, leaves, ,:__cuss,
vines, saw -dust end tree trinellings.
Section 4. As often as may be necessary to keep said receptacle
from over -flowing, the contents thereof iLust be delivered to some
responsible person to be hauled and carried away from said premises
and to ue disposed of according to law.
Section 5. It shall be unlawful for any person to niove or carry
through any public street or alley of the City of eea mont any garbage
or rubbish except in vehicles havin`; metallic or netal-lined beds, and
the `;arbaCe or rubbish shall be so loaded that none of it shall fall,
drop or spill upon the (round. Every vehicle used in the work of
collecting and disposing of „:arbaLe and rubbish shall be kept clean.
Lection 6. anyone farming premises of one acre or more may apply to
the Chief of Police for a special permit to dispose of his own garbage
or rubbish on said premises in a manner approved by the City Council.
Section 7. tit such times as there is in force a contract entered
into by the City of Beaumont with any person, firm or corporation for
the collection and disposal of garbage and rubbish in the City of
Beaumont, it shall be unlawful for any person other than the Contractor,
or a person or persons in the employ of such contractor, to collect any
garbage or rubbish within the City of Beaumont, or to remove or carry
any garbage or rubbish through any public street or alley of the City
of Beaumont; provided, however, that the word "garbage" as used herein
shall not include what is commonly termed "swill" from any boarding
house, restaurant or hotel. Provided further that any person other
than said Contractor removing such 'swill" must first ootain a permit
from the Health Officer of the City of . eaumont, and the said Health
Officer shall have the power to grant oer_mits for the removal of such
swill only after he shall have satisfied himself that the applicant is
properly equipped to remove and handle such swill in a satisfactory
manner, and that said Permit will in no way conflict with any existing
garbage collection contract.
Section 8. The rates for collection of garbage and rubbish to be
charged by the contractor shall be as specified in a written agreement
or contract oetween The City of Beaumont and Contractor, and shall
be in proportion to service required. In all cases where dispute
arises as to proper containers or to the rate charged or to be charged
for any service provided in this ordinance, the matter shall be referred
to the City Council of the City of Beaumont, and the City Council shall,
upon due investiation, determine and fix such orice as it may deem
just and equitable and the determination of the City Council thereon
in all cases shall be final and conclusive.
ection 9. The Contractor shall pay to the City of Beaumont, monthly,
on the 10th. day of the month 2% of the gross revenue collected by or
for the Contractor durinthe preceding month for the collection and
disposal of rubbish and garbage.
Section 10. The Contractor shall collect all fees and issue his
receipt for same. should a resident fail or refuse to pay for
collection ofgarbage or rubbish, such failure shall ue reported by
contractor to the Chief of Police who will immediately see that the
provisions of this ordinance are enforced
;rection 11. rin.y person violating any of the provisions of this
ordinance shall ue deemed ,uilty of a zisdeueanor, and upon conviction
thereof shall be punished by a fine not exceedint; Three Hundred Dollars
(300.00) or by in--pri soninent in the City Jail of the City of neauinont,
or the County Jail of the County of riverside, for a period not to
exceed ninety days, or by both such fine and irmprisorment.
Section 1g. This ordinance is hereby declared to be an emergency
ordinance necessary for the immediate preservation of public peace,
health and safety, and the facts constituting its urgency are declared
to be as follows: That the City is at this time experiencing a great
increase in population and that the City has no ordinance governing
the collection of garbage, and is not in a position to award a Garbage
Collector's Contract, and that there is a great derhand for tarbage
service due to the added population and health menace.
Section 13, That this ordinance shall go into effect immediately
upon its adoption. That the City Clerk shall cause this ordinance
to be published once in the Beaumont Gazette, a newspaper of Eeneral
circulation, printed and published in the City of Beaumont, California.
